The future land use plan for this area recommends high density residential uses and highway commercial uses. Ken Eftink gave staff's recommendation stating that the lot with the living facility could be zoned to the R-4 (Multi-Family Residential) District at this time and the applicant could come back at a later date to rezone the remaining area to the C-1 (Local Commercial) District or to the C-2 (General Commercial) District. A request of property owners within the area roughly bounded by Broadway Street to the south, Henderson Avenue to the east, West End Boulevard to the west, and includes the 300 block of North Park Avenue and all of Highland Drive, Hillcrest Drive, and Rockwood Drive, to designate the Boulevard Local Historic District and establish design guidelines. Scott House, Chairman of the Historic Preservation Commission, provided a history of the process that the proposed district has taken and stated that the Historic Preservation commission is in favor of this request. Scott Rhodes asked if the district extends south to the commercial properties along Broadway. Staff informed the Planning and Zoning Commission that the proposed district does include the commercial properties. Scott House informed the Commission that if any of the buildings should ever be demolished or have an exterior change, that they would need a Certificate of Appropriateness. It was also added that none of those property owners have asked to be removed from the district. Ralph Maxton inquired if this would be the first historic district. Scott House mentioned that this would be the first Local Historic District and added that we have several National Register Historic Districts, which are different from Local Historic Districts. Richard Reinhardt informed the Commission that the signatures were recounted and signatures where the address was left off or did not correspond with the property ownership were not counted. After the recount of signatures there were 69 out of a possible 124. The percentage of signatures was 55%. Charles DiStefano of 360 North Park Street spoke on behalf of the district designation stating that it is a way to keep the neighborhood preserved. DiStefano added that he will probably be one of the first to apply for a Certificate of Appropriateness to replace his front steps and is also looking to make other changes to his home to meet the design guidelines. Jim Beise of 373 North Park asked that the commercial lots along Broadway remain in the district and added that a poorly planned parking lot could be a detriment to the neighborhood. Lynn McClain of 1208 Hillcrest spoke in opposition to the designation stating that it would take away individual rights. Ron Haas of 621 North Henderson stated that he has worked to maintain the historic appearance of his home which is included in the proposed district. Chris Goeke of 377 North Park spoke in favor of the district designation and stated that everyone has received the mailings and that every property owner within the district has had an opportunity to state whether they are for or against the designation. Upon motion made by Charles Haubold and seconded by Ray Buhs, the Planning and Zoning Commission voted to recommend approval of the district designation and establishment of design guidelines. Trisha Mothershead and Trae Bertrand abstained for financial reasons. No one voted in opposition. The designation of the Boulevard Local Historic District and the establishment of design guidelines will go to City Council for a public hearing on August 31, 2009. Subdivision Plats 4. Cape West Crossings Phase II, Record Plat. Jeff Maurer spoke on behalf of this request stating that Phase II is the northern portion of his property to be developed. Richard Reinhardt commented on a concern regarding the access road off of Bloomfield and suggested that it could be a right-in and right-out only. Chris Koehler mentioned that he spoke with the City Engineer and it was decided that the left turns would be allowed. Ken Eftink spoke on the future development along Bloomfield and added that increased ""', traffic is anticipated. The Commission discussed that left turns onto the access road off of Bloomfield could be allowed for now but changed at a later date if it becomes a problem. Scott Rhodes abstained from this item. Upon motion made by Charles Haubold r and seconded by Harry Rediger, the motion to recommend approval was passed with a vote of 7 in favor, 1 abstaining, and 0 in opposition. 5. Jeff Jackson Subdivision, Record Plat. Jeff Jackson appeared on behalf of his request stating that he could answer any questions that the Planning and Zoning Commission has. Richard Reinhardt informed the Commission that this request is taking the west portions of Lots 1 and 2 to form Lot 3. The person purchasing Lot 2 did not wish to purchase the entire property and as a result, the applicant is requesting to subdivide the property. Richard also informed the Commission that Koehler Engineering has submitted a letter requesting a variance for the minimum lot size since Lot 1 is less than 10,000 square feet and also for the street frontage since it is less than 80 feet along West Rodney. Richard also informed the Commission that there has been confusion as to whether or not Bevin Drive was public or private. This plat is designating 12 feet of Bevin Drive public right of way since it has been maintained by the City. Upon motion made by Scott Rhodes and seconded by Trisha Mothershead, the motion to recommend approval with the required variances was passed unanimously. Other Items and Communications 6.
