Discussion and Votinq on Applications
3. Development Code— Streets and Access Management. Upon motion made by Charles
Haubold and seconded by Scott McClanahan, the sections on streets and access
management were unanimously recommended for approval.
4. Revision to the Zoning Ordinance in regards to Domestic Servants. Charles Haubold made
the motion to recommend approval and the motion was seconded by Trae Bertrand. Bill
Hinckley pointed out that the house that caused this revision to be made is grandfathered in
and will be a nonconforming use. The motion was approved unanimously.
Subdivision Plats
 5. Record Plat of Smiths Subdivision. Richard Reinhardt informed the Commission that this is
a three lot subdivision located adjacent to Cape LaCroix Creek and east of Walnut and
Locust Street. Acceptable plats have been submitted. The Commission was informed that
the applicants have requested a variance for the minimum street width on Walnut. The
minimum street width is sixty (60)feet in an industrial area however the plat only shows fifty
 (50) feet of right of way for Walnut. Staff's recommendation is for approval with the
requested variance. The Commission unanimously recommended Smith's Subdivision for
approval with the variance.
6. Record Plat of the Resubdivision of Lot 25 of Lexington Place Second Subdivision. Richard
Reinhardt informed the Commission that this is a vacant lot located at 3040 Patriot Drive
that the developer is planning to build a duplex on. The plat shows the lot being divided so
that it will divide the duplex and the land around the duplex. Acceptable plats have been
submitted. A letter requesting a variance was submitted for the setbacks on the common lot
line between lots one and two. Staff's recommendation is for approval with the requested
variance. The Commission unanimously recommended the Resubdivision of Lot 25 of
Lexington Place Second Subdivision for approval with the variance.
7. Record Plat of Thorngate Subdivision. Richard Reinhardt informed the Commission that this
is a two lot subdivision located at 1507 Independence Street. Blair Leasing is interested in
purchasing the old Thorngate Factory building. Since Tipton's plans to expand in the future,
the property is being subdivided with the understanding that Tiptons will purchase the east
lot and join that with their property some time in the future. The applicants have submitted a
letter requesting a variance to not have a utility easement on the east property line. If the
engineering surveyor showed an easement there, then it would need to be vacated in the
future when Tiptons joins that lot with their property. Staff has received corrected plats,
however is still checking for corrections. Staff recommends approval on the condition that
all corrections are made and that the variance is granted. The Commission unanimously
recommended Thorngate Subdivision for approval with the variance.
 Other Items and Communications
8. Discussion on revisions to the Planned Development District. This item came up because of
the situation with Good Shepherd Lutheran Church at 1904 West Cape Rock Drive. They
used the Planned Development District as a way to get a telecommunication tower on their
property. Martha Brown mentioned that the intent of the Planned Development District was
to allow for developments where all facets could be handled and that variances could be
granted with developments if requested and acceptable. Bill Hinckley stated that the
Planned Development district was meant for subdivisions with a mix of housing and shops.
It was added that the ordinances from other Cities would be examined to see what they
have for telecommunication towers.
9. Staff Time.
Ken Eftink informed the Commission that the Proposed County Subdivision Regulations will
be going to Jackson's Council meeting next Monday night at 7:30.
Ken Eftink mentioned that there would be a Public Hearing at the County Commission
meeting on November 30th for Peripheral Zoning.
The City is proceeding with the annexations for Fruitland Livestock Market and Lynwood
Baptist Church. Charles Haubold mentioned that the church did not want their property in
the County annexed into City Limits anymore.
Charles Haubold gave an update on the casino. They have bought fifteen properties and
have contracts on more than forty properties. They will be submitting a rezoning application
for the Planned Development District.
 10. Adjournment. Upon motion made by Charlie Haubold and seconded by Marcia Ritter, the
meeting was adjourned unanimously at 8:30 p.m.
Respectfully submitted,
