Hearinqs, Discussion, and Votinq on Applications
 1. Request of Terry Allison and Susan Allison for a Special Use Permit to operate a daycare
for no more than ten (10) children at their home located at 1341 Vantage Drive. Susan
Allison stated that she has been operating a daycare out of her home for the past three (3)
years with fewer than four (4) children. However, now she desires to be able to have up to
ten (10) children. She added that she keeps her yard picked up and in order, her hours of
business are from 7:30 a.m. to 5:30 p.m. and her neighbors have never complained. There
was discussion on Veterans Memorial Drive that is being constructed. It was discussed that
it would end up using Vantage and result in a lot of traffic there. Ken Eftink informed the
Commissioners that the original plan was to use Vantage for Veterans Memorial Drive, but
the new plan is to have it run along side the interstate. Vantage Drive will remain a local
residential street for the subdivision. There was discussion on parking at the site and
whether or not there would be enough room for multiple people to drop children off at the
same time. Susan Allison stated that her driveway accommodates four (4) cars so that
should not be a problem. Susan Allison also stated that she has purchased the two (2) lots
behind her home and plans to keep those vacant and she added that the daycare is not on
either of those lots.
In favor of the request:
Jane Gockel of 1351 Vantage Drive spoke in favor of the request. She stated that there has
never been any traffic problems along Vantage Drive while the daycare has been there She
added that the children have always been in the fenced in area in the Allison's back yard
and that there has never been a problem in the past.
Marty Niswonger of 1342 Vantage Drive spoke in favor of the request. He stated that there
has never been a problem with noise or traffic and that there have never been any negative
comments in regards to the daycare.
Darlene Cowan of 1329 Vantage Drive spoke in favor of the request. She stated that she
can see everything in the Allison's backyard and it is no problem at all.
In opposition to the request: None.
2. Upon motion made by Charles Haubold and seconded by Marcia Ritter, the request for a
Special Use Permit to operate a daycare for no more than ten (10) children was
unanimously recommended for approval.
Subdivision Plats
3. Record Plat of Route K North Second Subdivision. Richard Reinhardt informed the
Commission that this is a minor subdivision located on William Street The applicant is
requesting a variance for the utility easement request along the western boundary of the
subdivision and also on the north side of Lot 2 because the grease trap and transformer for
the new building will be within the easement. Ken Eftink added that with the sixty (60)foot
of right of way for Gordonville Road, this should not be a problem. Upon motion made by
Ray Buhs and seconded by Scott McClanahan, Route K North Second Subdivision was
unanimously recommended for approval.
Other Items and Communications
4. Staff Time.
Ken Eftink informed the Commission that the Council gave final approval to the Final
Development Plan for Isle of Capri at their meeting on Monday, February 7, 2011.
r Chairman Hinckley asked why sign variances went before the Zoning Board of Adjustments
'"" instead of the Planning and Zoning Commission. The Commission discussed that with all
the work that the Development Code had put in to working on sign regulations for the
Development Code, the Planning and Zoning Commission should at least be able to
provide input for sign variances. Ken Eftink mentioned that staff can look at this closer.
Ray Buh's great-grandson, Collin Enderle was in attendance at the meeting. Collin Enderle
is on his way to becoming an eagle scout and needed to attend a public meeting where
different opinions were expressed.
5. Adjournment. Upon motion made by Charles Haubold and seconded by Thomas Welch, the
meeting was adjourned unanimously.
