Hearinqs
1. A Public Hearing was held to consider the rezoning of property at 820 North Sprigg Street from
the C-1 (General Commercial) District to the R-5 (High Density Multifamily Residential) District.
Mrs. Melanie Cantrell with Gertis, Lester, Dameron & Associates, Inc. and Mr. Bill King with
Crown Development of Jackson, LLC spoke for the application. Mrs. Cantrell explained that
the request is for rezoning the east 183 feet of the lot to the R-5 Zoning District. Mr. King
explained they also own other surrounding lots and are proposing the rezoning to build
apartment buildings to do what they can to help with the University's housing problem. Due to
staff concerns regarding shared parking with the commercial uses, the applicant presented a
revised plan of rezoning only part of the lot for the Commission's review. The Commission
also expressed concerns with shared parking and the required number of parking spaces, only
one entrance into the development, and the requirement for 20% open space. Since staff, nor
the Commission, had seen the revised plan, Mr. Haubold made a motion seconded by Mr.
Maxton which passed unanimously to table the request until the staff had time to review the
new plan. Mr. Hinkley also requested to have the Fire Department review the plan for any
emergency access issues. Mr. Haubold would like the Engineering Division to take a look at it
for any future street plans in the area which might affect the development.
 2. A Public Hearing was held to consider revisions to the Chapter 12 Floodplain Management
Regulations of the City Code. Mrs. Casey Brunke, Civil Engineer, presented a model
floodplain ordinance which was given to the City by the State Emergency Management

Association (SEMA). She explained that the Chapter has been revised to coincide with the
updated Flood Insurance Rate Maps that will become effective September 29, 2011. SEMA
requires the City to adopt an updated Floodplain Management Chapter for the Code in order to
continue participation in the National Flood Insurance Program. The Commission expressed
concerns regarding the Board of Adjustment being responsible for variance requests. Mrs.
Brunke told the board that this issue was discussed with the City Attorney who suggested to
leave the appeals process with the Board of Adjustment because of the reference to section
89.110 RSMo. No one spoke in favor or opposition to the recommended changes. Mr.
Bertrand made a motion to recommend approval of the updated Floodplain Management
Chapter of the Code of Ordinances. Mr. McClanahan seconded the motion. The
recommendation passed with a vote count of 8 in favor, 0 in opposition and 0 abstaining. Mrs.
Brunke explained that to meet the timeline established by SEMA a draft ordinance has to be
submitted to SEMA by September 15, 2011.
3. A Public Hearing was held regarding updates to the Water and Sewers Chapter of the Code of
Ordinances. Mrs. Kelly Green, City Engineer, presented the Commission with information on
the revisions. She explained that Chapter 29 of the Code previously contained all the
information on water and sewers. Since the adoption of the Development Code recently there
has been conflicting information between the Development Code and Chapter 29. Therefore, it
is proposed to repeal Chapter 29 in its entirety and replace it with the proposed ordinance
presented to the Commission. She reported that there were only minor revisions being made
except for the addition of a Fat, Oil and Grease control section. Mrs. Green answered
questions from the Commission and informed them that this hearing was for informational
purposes. No one spoke in favor or opposition to the revisions of Chapter 29. The Commission
agreed with the need for the update and recommended the Engineering Division move forward
with the revisions. Mrs. Green stated the proposed ordinance would be presented to the City
Council on August 1, 2011.
4. A Public Hearing was held to consider updates to the Stormwater Management Chapter of the
Code of Ordinances. Mr. Stan Polivick, Stormwater Coordinator, presented the proposed
changes at the hearing. He explained that nothing was being deleted from the Chapter, but
language was being added from changes received from DNR. These changes will keep the
City in compliance with the MS4 permit. Mr. Hinkley asked if the developers will be surprised
with these changes. Mr. Polivick explained that several meetings have been held with the
developers and the only surprise should be that the changes are finally being implemented.
Mr. Polivick mentioned that one main change in the Chapter is that Stormwater permits will
now expire after three years. Currently there are no expiration dates on Stormwater permits.
Also, Federal mandates on maintenance will be added. Mr. Hinkley recommended a definition
of gray water be added to the revision being proposed. After further discussion and questions
of Mr. Polivick, the Commission understood the need for the revisions and agreed with the
revisions being proposed.
Adiournment
Upon motion made by Mr. Haubold and seconded by Mr. Bertrand, the meeting was adjourned
unanimously at 8:00 p.m.
Respectfully submitted,
