Staff Present: Carol Peters and Ryan Shrimplin

Approval of Minutes
The minutes of the April 11, 2012 meeting were unanimously approved upon motion made by
Mr. Bowen and seconded by Mr. Welch.
Public Hearinqs
1. A Public Hearing was held on the request of The Landing Point RV Park, LLC to rezone
the property at 3020 Boutin Drive from the RMH (Manufactured Home) District to the C-2
(Highway Commercial) District, and for a Special Use Permit to construct and operate an
RV/travel trailer park in a C-2 zoning district. Mark Rademaker of The Landing Point
expressed to the Commission his desire to continue cleaning up the property by
converting the spaces previously occupied by mobile homes to pads for RV's and travel
trailers. Mr. Hinckley and Mr. Bowen commended Mr. Rademaker for his efforts and the
improvements made thus far. Mr. Maxton asked Mr. Rademaker if the neighbors had
been notified of his intentions. Mr. Rademaker responded that letters were sent to each
of the neighboring properties. He mentioned he had not spoken to all of the neighboring
property owners, but those whom he had spoken with were pleased with the
improvements being made. No one spoke in favor of or opposition to the rezoning and
Special Use Permit requests. A motion was made by Mr. Hinckley and seconded by Mr.
Bowen, to recommend approval of the rezoning request for 3020 Boutin Drive from the
RMH (Manufactured Home) District to the C-2 (Highway Commercial) District. The
motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining. The
Commission discussed limiting the time frame an RV or trailer can stay in the park. Mr.
Rademaker commented that the RV park on North Kingshighway limits their tenants to
twelve (12) months and he would like to be consistent with that policy. A motion was
made by Mr. Hinckley and seconded by Mr. McClanahan to recommend approval of the
Special use Permit to construct and operate an RV/travel trailer park at 3020 Boutin
Drive, subject to the following conditions: 1) This permit shall cover the proposed uses
and improvements as indicated on the application and on the accompanying site plan.
Substantial modifications to the special use and/or the site plan shall require the
approval of the City Council. 2) The existing wooded area located along the east
property line shall remain undisturbed. The wooded area shall be in lieu of the required
bufferyard. 3) This permit shall automatically expire twelve (12) months from the date of
recording if the use for which it was granted does not commence. 4) This permit is not
transferable without the consent of the City Council. 5) No RV or travel trailer shall be
occupied within the park for more than twelve (12) months. The motion passed with a
vote of 8 in favor, 0 in opposition, and 0 abstaining.

2. A Public Hearing was held on the request of Dr. Michael Jessup for a variance from Sec.
25-604 of the Development Code for his property at 80 South Plaza Way. The variance
request consists of two parts. The first part is to allow a seven and one-half foot (7'/z')
tall fence in the front yard along Merriwether Street. The fence would actually extend
into the right-of-way in order to enclose an existing tree. The fence is needed for events
that will be held on the patio used by The Venue. This request was originally denied by
the Planning and Zoning Commission on November 9, 2011. Dr. Jessup submitted a
new application requesting approval of the same fence, but on a temporary basis. The
fence would only be in the front yard and right-of-way during outdoor events, after which
it would be taken down or moved back behind the front yard setback. At all other times,
a four (4) foot tall fence would be located on the right-of-way line. The second part is to
allow an eight (8) foot tall fence in the front yard and in the right-of-way on the east side
of the property adjacent to 2130 Merriwether Street. The neighbor, Carl Eyre installed a
fence in this location on Dr. Jessup's property. Dr. Jessup is requesting to allow this
fence on a permanent basis because it helps screen Mr. Eyre's property from the patio
activities. Dr. Jessup stated he realizes the fences would be over an easement and that
he would be responsible for any fence repairs if the fences were to be damaged due to
utility work. Mr. Hinckley noted that the staff report recommends approval of the
temporary fence on Saturdays and Sundays only. He asked if The Venue holds outdoor
events on Friday evenings. Dr. Jessup responded that The Venue would like to use the
patio on Friday's as well. Mr. Hinckley asked why he is requesting a four (4) foot fence
at all other times, which exceeds the height requirements, instead of three feet which j
would not require an additional variance. Dr. Jessup indicated the topography steps
down in the area where the fence would be. Therefore, the fence will vary in height, with
the tallest portion being four feet. No one spoke in favor of or opposition to the requests.
A motion was made by Mr. Hinckley and seconded by Mr. Bowen to approve the
variance request of Michael Jessup for a temporary fence up to seven and one-half feet
(7.5') in height in the front yard of 80 South Plaza Way, subject to the following
conditions: 1) This approval is limited to weekends (starting at 3:00 p.m. on Friday and
running through Sunday) only. The City manager or his or her designee may, upon
written request by the applicant, approve the fence in the front yard for an outside event
held at other times. The fence shall be moved back behind the front yard setback
immediately following each event. At all other times, a fence not to exceed four feet (4')
in height may be located in the front yard. 2) The applicant shall obtain a fence permit
and execute a License and Indemnity Agreement with the City. The motion passed with
a vote of 8 in favor, 0 in opposition, and 0 abstaining. A motion was made by Mr.
Hinckley and seconded by Mr. Bowen to approve the variance request of Michael
Jessup for a permanent fence up to eight feet (8') in height along the east property line
in the front yard, subject to the condition that the applicant obtain a fence permit and
execute a License and Indemnity Agreement with the City. The motion passed with a
vote of 8 in favor, 0 in opposition, and 0 abstaining.
Subdivision Plats
1. A record plat for Villas at Cape Rock 4 was presented to the Commission for their
consideration. Mr. Shrimplin explained to the Commission that in December, 2011 the
Board of Adjustment approved a variance to allow an encroachment in the rear yard set-
back by four feet (4') for Units 4 and 5 of the development. The units are almost
completed and are actually located five feet (5') into the setback area. Therefore, a
variance for the additional foot is included in the record plat. A motion was made by Mr.

Other Items and Communication
Staff Communication
1. Mr. Shrimplin updated the Commission on the status of the proposed annexations. A
public hearing was held at the City Council meeting on April 16, 2012 for the group of
properties reviewed by the Planning and Zoning Commission on April 11, 2012. The
Council decided to remove the Wild Horse Creek Ranch subdivision from the annexation
process at this time to allow for a meeting to be held with the property owners to address
their concerns. Mr. Shrimplin also mentioned another group of properties to be annexed
will be forthcoming including properties along County Road 618.
