A public hearing was held on the request of Edward Leoni & Abbie Crites-Leoni, Joe and Kelley Pujol and Elizabeth Wilhelm to rezone property at 1733 and 1739 Old Sprigg Street Road and the adjoining lots along Bertling Street and Mahy Drive from the R-1 (Single- Family Suburban Residential) District to the R-4 (Medium Density Multi-Family Residential) District. The public hearing opened with Mr. Edward Leoni, 7775 State Highway 25, conveying to the Commission what he felt would be the benefits for rezoning the property to multi-family residential. He stated, economically the project would create 300-500 jobs for construction workers, masons, electricians, etc and it would be a continual source of tax revenue for the City. Mr. Leoni reminded the Commission that a rezoning request was filed in 2008 for the same properties. The concerns of the neighboring residents at that time have been taken into consideration. In 2008, the residents were concerned with increased traffic on Mahy Drive and noise from the apartments. Mr. Leoni indicated that should the rezoning be approved, the proposed development would not connect to Mahy Drive. The only access to the development would be from two driveways, one on Old Sprigg Street Road and the other on Bertling Street. He also mentioned that according to the Code of Ordinances, a 20' bufferyard is required and the developer has agreed to extend that bufferyard to 30' to aid in the reduction of noise generated by the development. Ms. Elizabeth Wilhelm, 235 Country Club Drive, also spoke in favor of the request. She owns part of property being considered for the rezoning and mentioned they had been approached by several developers wanting to purchase the property. She mentioned they chose Brandon O. Williams to develop the property for his reputation and the design aspects of the proposed project. Mr. Joe Pujol, 111 Kelley Court, spoke in favor of the request as a property owner of the proposed rezoning. Mr. Pujol noted that there were concerns with traffic issues when Cape Place was being developed; however he has never seen traffic backed up at the intersection. Mr. Pujol expressed the need for student housing in close proximity to the University for not only students, but faculty members as well. Mrs. Ritter asked how many dwelling units are proposed. Mr. Shrimplin stated that per the Zoning Ordinance, the maximum density in the R-4 district is 18 dwelling units per acre. The area proposed to be rezoned is approximately 9 acres in size, which equates to a maximum of 162 dwelling units. Mr. Brandon O. Williams, the developer, explained that the conceptual site plan included in the Commissioners' agenda packet represents the "worst case scenario" in terms of showing the maximum number of dwelling units. Most likely the development would contain fewer than 162 units. He also mentioned the units would be constructed in the craftsman style design and would have 24-hour security. Mr. Hinckley questioned how many people would be residing in the units. Mr. Shrimplin stated that, in the case of occupants who are not related, the Zoning Ordinance permits a maximum of 3 per dwelling unit. Eight individuals spoke in opposition to the request. Ms. Judy Grass, 1126 Mahy Drive, has lived on Mahy Drive for 28 years and would not want an apartment complex thirty feet from her property. Mr. Frank Giunta, 1121 Mahy Drive, stated he lived there for 35 years and enjoyed the peaceful setting. He can hear children playing at the school three blocks away Planning & Zoning Commission Meeting Minutes September 12, 2012 Page 3 and doesn't feel a twenty-foot bufferyard will quiet the noise from the residents of an apartment complex. He also wanted the Commission to consider what a clubhouse in the center of the development would do to their peaceful neighborhood. Mr. Keith Lear, 1829 Old Sprigg Street Road, felt the neighboring property owners should not have to suffer with declined property values, increased noise and traffic just so the developer and property owners could reap the economic benefit. Mr. Aaron Kirleis, 1725 Brucher Street, stated Bertling Street is currently in very poor condition with several pot holes. He is concerned with the City's ability to repair the street which will continue to deteriorate even further with increased traffic. Mr. Andrew Helle, 1735 Brucher Street, stated a thirty-foot bufferyard would not contain the noise from the apartment complex and the development would hurt the resale value of his home. Ms. Lynn Ware, 1903 Brucher Street, stated she liked the R-1 area as it is. She mentioned that since college students have started renting houses on Oakley Drive she has seen an increase in people randomly driving by in the alley and more trash which she feels would get worse if the properties are rezoned to the R-4 district. Mr. Steve Hinman, 1901 Brucher Street, stated his mother purchased their property in 1961 and he felt the applicant's request is just a deal for money. Mr. Richard Renfrow, 1817 Oak Hills Drive, owns a 125 acre farm to the north of the subject properties. He stated there are plenty of areas for R-4 in other parts of the city. The only benefit of rezoning the property would be to the construction workers and the developer. No one would want an apartment building built next to their house. He felt the project would only benefit a few people while the neighbors would pay the price. He stated if the property was going to be developed with /"" single-family homes there wouldn't be a problem. 4 J A motion was made by Mr. Hinckley and seconded by Mr. Buhs, to recommend approval of the rezoning request for 1733 and 1739 Old Sprigg Street Road and the adjoining lots along Bertling Street and Mahy Drive from the R-1 (Single-Family Suburban Residential) District to the R-4 (Medium Density Multi-Family Residential) District. The motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining. 5. A public hearing was held on the request of Saint Francis Medical Center for a Special Use Permit to allow additional building height up to 100 feet. Mr. Rick Essner, representing Saint Francis Medical Center, explained the hospital is planning an expansion to include a 5-6 story, 210,000 square foot addition to the current facility. The maximum height permitted in the current zoning district (C-2) is five stories not to exceed 60 feet. The proposed addition is approximately 87'-4" in height, but may change as the design is not finalized. A motion was made by Mr. Buhs and seconded by Mr. Maxton to recommend approval of the Special Use Permit for Saint Francis Medical Center with the following staff recommended conditions: 1) This approval is limited to the height of the proposed building addition on the south side of the facility facing William Street. The site plan and renderings provided by the applicant are for informational purposes only, and are not a part of this approval. 2) The height of the building addition shall not exceed one hundred (100) feet. 3) The building addition shall comply with all applicable building and zoning regulations, except as noted above. 4) This permit is not transferable without the consent of the City Council. The motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining. SUBDIVISION PLATS 6. A record plat for Lorimier Apartments Subdivision was presented to the Commission for their consideration. Mrs. Dana Cotner, 143 South Lorimier Street, explained that the current parcel contains an apartment building and a single-family home. She has a potential buyer who is only interested in the apartment building, therefore she wishes to split the parcel into Planning 8 Zoning Commission Meeting Minutes September 12, 2012 Page 4 two lots. Both the parcel and the buildings pre-date the current zoning regulations resulting in a request for variances for lot area and setbacks, which can be approved as a part of the subdivision plat. Mr. Shrimplin informed the Commission that a revised plat had been received; therefore the staff recommendation is revised to recommend approval as submitted. A motion was made by Mr. Hinckley and seconded by Mr. McClanahan to recommend approval of the Lorimier Apartments Subdivision Record Plat as submitted. The motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining. 7. A record plat for Giboney Woods Fifth Subdivision was presented to the Commission for their consideration. Mr. Ty Gramling with Koehler Engineering & Surveying was present to represent the applicant, TNT Real Estate Development, LLC. The plat consists of one lot that is being subdivided into two lots on Copperfield Court. A motion was made by Mr. Maxton and seconded by Mr. Kluge to recommend approval of the Giboney Woods Fifth Subdivision Record Plat with the condition that the rear yard setback of Lot 1 shall be corrected to be parallel to each property line. The motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining.
