PLANNING AND ZONING COMMISSION
MEETING MINUTES
May 14, 2014
City Hall — Council Chambers
Present: Trae Bertrand, Larry Dowdy, William Hinckley, Randy Kluge, Ralph Maxton,
Scott McClanahan, Doug Spooler, Thomas J. Welch
Absent: Jeff Glenn
Staff Present: Carol Peters, Ryan Shrimplin
Call to Order: Chairman McClanahan called the meeting to order at 7:00 p.m.
The minutes of the April 9, 2014 meeting were unanimously approved upon motion made by Mr.
Bertrand and seconded by Mr. Dowdy.
REZONINGS SPECIAL USE PERMITS. AND VARIANCES
 1. A public hearing was held on the request of the Dalhousie Home Owners Association, Inc.
to rezone property at 1668 Helmsdale Drive from the R-1 (Single-Family Suburban
Residential) district to the R-2 (Single-Family Urban Residential) district. Mr. Ty Gramling,
Koehler Engineering 8 Land Surveying, Inc., appeared on behalf of the applicant to answer
any questions from the Commission. The property owners recently received approval of a
subdivision plat combining their lot, zoned R-2, with a small tract conveyed to them from the
Dalhousie Home Owners Association, which is zoned R-1. The proposed rezoning will
eliminate the split zoning condition on the newly created lot. No one spoke in favor of, or in
opposition to, the request. The staff report recommended approval. A motion was made by
Mr. Hinckley and seconded by Mr. Dowdy to recommend approval of the request to rezone
property at 1668 Helmsdale Drive from the R-1 (Single-Family Suburban Residential) district
to the R-2 (Single-Family Urban Residential) district. The motion passed with a vote of 8 in
favor, 0 in opposition, and 0 abstaining.
2. A public hearing was held on the request of William Beggs to rezone two properties near the
intersection of Silver Springs Road and Pioneer Drive from the R-1 (Single-Family Suburban
Residential) district and the RMH (Residential Manufactured Home) district to the C-2
(Highway Commercial) district. Mr. William Beggs, owner of both properties, explained that
in December of 2013, the City rezoned a portion of his property to the C-2 (Highway
Commercial) district at his request in order to conduct a mobile home sales business. He
would like to rezone additional property at this time to accommodate space needed to
display the mobile homes. Although no one appeared at the public hearing, staff did receive
a phone call from a resident of the adjacent mobile home park, who claimed that several of
the residents are opposed to the proposed rezoning, primarily due to traffic concerns. The
staff report recommended rezoning both properties to the C-1 (General Commercial) district
because it would be possible to obtain approval to construct a billboard if they were rezoned
to C-2. Mr. Beggs indicated that he has no plans to install a billboard, he just wants the
property to be zoned consistent with the adjacent C-2 property that was recently rezoned by

the City. A motion was made by Mr. Maxton and seconded by Mr. Kluge to recommend
approval of the request to rezone two properties near the intersection of Silver Springs Road
and Pioneer Drive from the R-1 (Single-Family Suburban Residential) district and the RMH
(Residential Manufactured Home) district to the C-2 (Highway Commercial) district. The
motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining.
3. A public hearing was held on the request of Shiloh, LLC for a Special Use Permit to allow a
residential use in the front, street level of the building at 915 Broadway, which is zoned CBD
(Central Business District) with the DCC (Downtown Commercial Corridor) overlay. Mr. Jay
Meystedt, owner of Shiloh, LLC, explained his request to the Commission. Mr. Meystedt
stated the proposal is to renovate an existing building and convert it into an office and
apartment. The DCC regulations require a Special Use Permit for a residential use in the
front, street level of the building. Mr. Meystedt stated that he would like to revise the
proposed site plan in order to increase parking in the front yard. Mr. Shrimplin explained
that such revisions would need to be reviewed by staff to determine if any variances would
be necessary, and if so, whether or not staff would support them. No one spoke in favor of,
or in opposition to, the request. A motion was made by Mr. Bertrand and seconded by Mr.
Spooler to table the Special Use Permit request pending further staff review and discussions
with the applicant. The motion passed with a vote of 8 in favor, 0 in opposition, and 0
abstaining.
SUBDIVISION PLATS
4. A record plat for Williamsburg Phase 1 was reviewed by the Commission. No one was in "'
attendance to present the plat. Mr. Shrimplin explained that the plat, which consists of eight
single-family lots and dedicated right-of-way for two public streets, is the first phase of the
Williamsburg subdivision. The preliminary plat of Williamsburg was approved by the City
Council in 2012. The record plat for Phase 1 conforms to the preliminary plat. The staff
report recommended approval as submitted. A motion was made by Mr. Hinckley and
seconded by Mr. Spooler to recommend approval of the Williamsburg Phase I record plat as
submitted. The motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining.
5. A record plat for Humphrey Subdivision was reviewed by the Commission. Mr. Stewart
Humphrey, 1938 Silverthorne Trail, appeared before the Commission to answer questions.

approval of the Humphrey Subdivision record plat as submitted. The motion passed with a
vote of 8 in favor, 0 in opposition, and 0 abstaining.
6. A record plat for Resubdivision of Lot 7 of Cape West Seventh Subdivision was reviewed by
the Commission. Mr. Shrimplin explained that staff had issued comments on the original
plat submission. When the corrected plat was submitted, the required 10' utility easement
that had been previously shown adjacent to the front and rear lot lines had been removed at
the request of the applicant. This was not disclosed to staff. The omission was identified
shortly before the meeting and as such, staff had not had time to discuss whether or not
they could support a variance for the easement. A motion was made by Mr. Bertrand and
seconded by Mr. Spooler to table the Resubdivision of Lot 7 of Cape West Seventh
Subdivision record plat pending further staff review and discussions with the applicant. The
motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining.
