Casey Brunke, City Engineer, presented proposed amendments to Articles IX, X, and XI of the
Development Code, Chapter 25 of the Code of Ordinances. She explained that the

information out of the Code into the City's Standard Specifications and Drawings. Staff worked
far about two years revising the Standard Specifications and Drawings, which were submitted to
the Missouri Department of Natural Resources (DNR) for approval. DNR approved them and
requested that they be adopted by City Council Ordinance. A motion was made by Mr. Kluge
and seconded by Mr. Bertrand to recommend approval of the amendments to Articles IX, X and
XI of Chapter 25 of the Code of Ordinances. The motion passed with a vote of 8 in favor, 0 in
opposition, and 0 abstaining. (Aye: Bertrand, Dowdy, Glenn, Hinckley, Kluge, McClanahan,

A motion was made by Mr. Glenn and seconded by Mr. Bertrand to approve the slate of officers
nominated at the December 9, 2015 meeting. The Commission voted unanimously to elect Mr.
Bertrand as Chairman, Mr. McClanahan as Vice-Chairman, and Mr. Spooler as Secretary.
The minutes of the December 9, 2015 meeting were unanimously approved upon motion made

an exception from Development Code Section 25-604, fence location, type and height, at
1931 North Kingshighway, which was tabled at the November 17, 2015 meeting. Mr.
Shrimplin stated he contacted the applicant and reminded him that he or a representative
needed to be at the meeting. A motion was made by Mr. Glenn and seconded by Mr.
Hinckley to remove the item from the table. The motion passed by a unanimous vote. A

2. A public hearing was held on the request of the Humane Society of Southeast Missouri to
rezone property at 2536 Boutin Drive from the R-1 (Single-Family Suburban Residential)
district to the M-1 (Light Manufacturing/Industrial) district. Mr. Kevin Priester, representing
the applicant, was available for questions from the Commission. Mr. Shrimplin explained
that the staff recommended rezoning the property to M-1 because the property is adjacent to
industrial uses and a kennel is a permitted use by right in the M-1 district. Chairman
Bertrand opened the public hearing and seeing no appearances to speak, he closed the
public hearing. The staff report recommended approval of the rezoning request. A motion
was made by Mr. Hinckley and seconded by Mr. Kluge to recommend approval of the
request to rezone property at 2536 Boutin Drive from the R-1 (Single-Family Suburban
Residential) district to the M-1 (Light Manufacturing/Industrial) district. The motion passed
with a vote of 8 in favor, 0 in opposition, and 0 abstaining. (Aye: Bertrand, Dowdy, Glenn,
Hinckley, Kluge, McClanahan, Spooler, Welch)
3. A public hearing was held on the request of the City of Cape Girardeau to rezone property at
the northwest corner of LaSalle Avenue and Business Park Place, and the southwest corner
of LaSalle Avenue and Veterans Memorial Drive, from the M-1 (Light
Manufacturing/Industrial) district to the C-2 (Highway Commercial) district. Mr. Shrimplin
stated the subject properties are located in the Greater Cape Girardeau Business Park. The
City rezoned most of the business park to M-1 because it would be marketed to industrial
businesses. M-1 also permits restaurants and retail uses, which would be appropriate for
the properties fronting LaSalle Avenue. The City has entered into a sale contract for the finro
subject properties. The buyer has indicated it may construct a hotel on one or both of the
properties, which is not permitted in the M-1 district. Subsequently, the City has initiated
rezoning the subject properties to the C-2 district, which permits a hotel by right. The C-2
district also permits restaurants and retait uses, as was originally intended for these
properties. Chairman Bertrand opened the public hearing and seeing no appearances to
speak, he closed the public hearing. The staff report recommended approval of the
rezoning request. A motion was made by Mr. McClanahan and seconded by Mr. Spooler to
recommend approval of the request to rezone property at the northwest corner of LaSalle
Avenue and Business Park Place, and the southwest corner of LaSalle Avenue and
Veterans Memorial Drive, from the M-1 (Light Manufacturing/Industrial) district to the C-2
(Highway Commercial) district. The motion passed with a vote of 8 in favor, 0 in opposition,
and 0 abstaining. (Aye: Bertrand, Dowdy, Glenn, Hinckley, Kluge, McClanahan, Spooler,
Welch)
SUBDIVISION PLATS
4. The record plat of Greater Cape Girardeau Business Park Phase III was reviewed by the
Commission. The plat subdivides a 36.25 acre tract, located at the southwest corner of
LaSalle Avenue and Veterans Memorial Drive, into two lots and dedicates additional right-of-
way for LaSalle Avenue. The staff report recommended approval of the plat subject to the
staff comments being addressed. A motion was made by Mr. Glenn and seconded by Mr.
McClanahan to recommend approval of the Greater Cape Girardeau Business Park Phase
III record plat, subject to the staff comments being addressed. The motion passed with a
vote of 8 in favor, 0 in opposition, and 0 abstaining. (Aye: Bertrand, Dowdy, Glenn, Hinckley,

OTHER ITEMS AND COMMUNICATION
Amendments to Chapter 30. Section 30-333 (C-1 General Commercial District)
5. Mr. Shrimplin stated the City recently received a business license application for a "doggie
day care" (i.e. a kennel) in the C-1 (General Commercial) district on Cape LaCroix Road.
Upon reviewing the C-1 section of the code, the staff determined a kennel is neither a
permitted use nor a special use in the district. The staff questioned why this use is not
permitted at all in the district and is proposing to add it as a special use, along with other
changes that are part of the ongoing review of Chapter 30. Mr. Dowdy asked why the
minimum side yard setback is proposed to be increased from five (5) feet to twenty (20) feet
when adjacent to an agricultural or residential use or district. Mr. Shrimplin stated the
bufferyard regulations in the Development Code, Chapter 25, require a twenty (20) foot wide
bufferyard for any commercial use that is adjacent to a residential use or district. Since no
development is allowed in a bufferyard, the five (5) foot side yard setback requirement is not
appropriate. Staff is proposing to change it to twenty (20) feet to make it consistent with the
required bufferyard width. The minimum rear yard setback is twenty-five (25) feet, which is
not proposed to change because it does not conflict with the bufferyard requirements. At
the request of Mr. Hinckley, Mr. Shrimplin reviewed the proposed changes to the lists of
permitted and special uses. He mentioned that the lists, as proposed, do not include a
category for indoor entertainment facilities such as inflatable bounce houses for children,
video arcades, roller skating rinks, and sporting events. He asked if the Commission would
like to add this category to either list. A motion was made by Mr. Glenn and seconded by
Mr. Spooler to recommend approval of the proposed amendments to the C-1 (General
Commercial) district regulations, including adding indoor entertainment facilities as a
permitted use. The Commission members agreed that certain indoor entertainment uses
are appropriate for the C-1 district but felt that the category "indoor entertainment facilities"
may be too broad. It was suggested the staff look into ways to regulate these uses more
specifically, and assess the impact of parking demand generated by each use prior to
moving forward with the amendments. Mr. Shrimplin stated the staff would like to move
forward with the amendments now because the "doggie day care" business is currently
operating without a business license, and the owner was informed the City would be
amending the regulations to add a kennel as a special use so she could apply for a Special
Use Permit. Upon approval of the Special Use Permit, the City would issue the business
license. He stated the topic of indoor entertainment facilities can be discussed at a later
date. Mr. Glenn withdrew the motion. A motion was made by Mr. Hinckley and seconded
by Mr. Spooler to recommend approval of the proposed amendments to the C-1 (General
Commercial) district regulations, as submitted. The motion passed with a vote of 8 in favor,
0 in opposition, and 0 abstaining. (Aye: Bertrand, Dowdy, Glenn, Hinckley, K/uge,
McClanahan, Spooler, Welch)
