Welch Staff Present: Alex McElroy, Carol Peters, Ryan Shrimplin Call to Order: Chairman Bertrand called the meeting to order at 7:00 p.m. Alex McElroy, Development Services Director, gave a presentation on the Vehicle Sales Tax Renewal and Use Tax issues that will be placed on the April 5, 2016 ballot for voter approval. He explained that approval of the Vehicle Sales Tax issue would extend an existing sales tax, set to expire in November 2016, which applies to out-of-state vehicles titled in the city. The Use Tax would apply to out-of-state purchases that would be subject to city, county and state sales taxes if purchased in the city. The minutes of the January 13, 2016 meeting were unanimously approved upon motion made by Mr. McClanahan and seconded by Mr. Dowdy. REZONINGS. SPECIAL USE PERMITS, AND EXCEPTIONS 1. A public hearing was held on the request of Ainsworth Homes, LLC for an exception from Development Code Section 25-506(a), wall signs, at 1001 North Kingshighway, Building A. Mr. Rick Sample, applicant, explained that the new tenant, Dunkin' Donuts, would like to install a wall sign on the north elevation of the building which does not have street frontage. He worked with the staff to find an acceptable trade-off in order to justify the exception. A staff report was submitted to the Commission containing the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Findinq: Per the above code section, the subject building is permitted wall signage on two elevations which have street frontage (east and south). In order to display wall signage on the north elevation, the applicant is proposing to transfer a portion of the permitted wall sign area from the east and south elevations. This qualifies as a "substantial equivalenY' because the applicant receives the same amount of wall sign area, but gets to distribute it differently. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. City of Cape Girardeau Planning &Zoning Commission Meeting Minutes February 10, 2016 Page 2 of 2 Findin : The "substantial equivalenY' proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, the staff recommended approval of the exception request, with the following condition: 1. The aggregate sign area of all wall signs for the building shall not exceed the maximum permitted wall sign area per the Development Code. Chairman Bertrand opened the public hearing and seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Koetting and seconded by Mr. Spooler to approve the exception for signage on the north building elevation at 1001 North Kingshighway, Building A, with the staff recommended condition. The motion passed with a vote of 6 in favor, 0 in opposition, and 0 abstaining. (Aye: Bertrand, Dowdy, K/uge, Koetting, McClanahan, Spooler) OTHER ITEMS AND COMMUNICATION Amendment to Chapter 30, Section 30-333 (C-1. General Commercial District) Mr. Shrimplin explained that at the January 13, 2016 meeting, the Commission recommended approval of a proposed amendment to Section 30-333 of the Zoning Code (Chapter 30 of the City Code).
