A public hearing was held on the request of the Cape Girardeau Area Housing Committee of the Community Caring Council to rezone property at 835 Beaudean Lane from R-2 (Single- Family Urban Residential District) to R-4 (Medium Density Multifamily Residential District). Chairman Glenn recused himself from the discussion and vote for business reasons, but stated he would handle opening and closing the public hearing. Mr. Chad Hartle, RCH Development, Inc., represented the applicant. He explained that the Housing Committee is considering the property as an alternate location for its affordable housing development due to the presence of a large ditch running through the other site, which would require constructing a bridge. He distributed copies of a preliminary site layout for the property. Mr. McClanahan noted the single access point for the development and asked if this was sufficient. Mr. Hartle replied by stating it may be possible to provide a second access point through the adjacent property to the south, and that the site layout may be revised if the project moves forward. Chairman Glenn opened the public hearing and seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Koetting and seconded by Mr. Spooler to recommend approval of the request of the Cape Girardeau Area Housing Committee of the Community Caring Council to rezone property at 835 Beaudean Lane from R-2 (Single- Family Urban Residential District) to R-4 (Medium Density Multifamily Residential District). He stated the final City of Cape Girardeau Planning &Zoning Commission Meeting Minutes March 14, 2018 Page 2 of 4 ) rr/ development plan for Phase 1 of Deerfield Estates is in substantial conformity with the approved preliminary development plan. Mr. Patrick Drury, Drury Properties, Inc., applicant, and Ms. Nancy Browne, The Limbaugh Firm, attorney for the applicant, were also available for questions from the Commission. A staff report was submitted to the Commission, which recommended approval, subject to staff's comments being successfully addressed. A public hearing was held on the request of Phillip B. Smith Architect, LLC for an exception from Development Code Section 25-805, bufferyards, at 23 South Ellis Street. Mr. Phillip B. Smith, applicant, explained that a building is to be constructed on the property and due to lot constraints, the property owner would like to install a six (6) foot high privacy fence in exchange for a reduced bufferyard width and no plantings. A staff report was submitted to the Commission, containing the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Findinq: The applicant is proposing a 6 foot high privacy fence in the bufferyard c along the north property line, which is adjacent to a single-family residential property. ` This qualifies as a substantial equivalent because the code does not require a fence for Type A bufferyards. The fence will serve as a visual and noise barrier to screen the proposed multifamily development from the adjacent property. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. Findinq: The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request, subject to the following condition: 1. The final design of the fence shall be subject to approval by the City staff. Chairman Glenn opened the public hearing. Mr. Bob Griffith, 17 South Ellis Street, spoke in support of the request. He stated as far as he is concerned, the fence could even be higher and wider if the applicant wanted. Seeing no other appearances to speak, Chairman Glenn closed the public hearing. A motion was made by Mr. Koetting and seconded by Mr. Dowdy to approve the request of Phillip B. Smith Architect, LLC for an exception from Development Code Section 25-805, bufferyards, at 23 South Ellis Street, subject to the condition listed in the staff report. The motion passed with a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining. Mr. Shrimplin and Ms. Peters explained that City staff already informs each applicant that they or their representative must attend the meeting or the Commission may table the request. Mr. Shrimplin stated there may City of Cape Girardeau Planning &Zoning Commission Meeting Minutes March 14, 2018 Page 4 of 4 { be times when an applicant or their representative is unable to attend the meeting due to an emergency or other unplanned event, and having a policy that automatically tables the request would penalize the applicant due to a circumstance beyond their control. Mr. McClanahan stated he feels it is not always necessary to have someone attend the meeting, especially if the request is straight-forward and the person would have to travel a long distance to get here. Mr. Greaser agreed, noting that the Commission currently has the option to table the request if the applicant or their representative is not there to answer questions. Chairman Glenn stated he feels the current flexibility the Commission has in tabling requests is working fine, and he would hate to see a project delayed on the sole basis that no one was in attendance at the meeting to present the request. The Commission decided to not make any changes at this time. Staff Communication Mr. Shrimplin announced that the next Comprehensive Plan Oversight Committee meeting will be held on March 30, 2018 at 7:30 a.m. in the City Council Chambers. Adiournment Upon motion made by Mr. Koetting and seconded by Mr. Spooler, the Commission voted unanimously to adjourn the meeting at 7:25 p.m. Respectfully submitted, . / Kevin Greaser Secretary
