REZONINGS, SPECIAL USE PERMITS. AND EXCEPTIONS
1. A public hearing was held on the request of the James Reynolds House Foundation to
rezone property at 623 North Main Street from M-1 (Light Manufacturing/Industrial District),
PD (Planned Development District), and R-4 (Medium Density Multifamily Residential
District) to CBD (Central Business District). A staff report was submitted to the Commission,
which recommended approval of the rezoning request. Ms. Alyssa Phares, President of the
James Reynolds House Foundation, stated that the historic James Reynolds House, located
on the property, is being renovated for use as a neighborhood facility for small gatherings.
The Foundation will coordinate with Southeast Missouri State University to host historical
exhibits at the facility.
Vice-Chairman Skinner opened the public hearing. Mr. Dan Presson, 27 Rivercrest Drive,
stated that over the past year, he has received several complaints about the deteriorated
condition of the property. He commented that this renovation project is a great opportunity
to show how historic properties can be repurposed. He added that he is looking forward to
the facility being a gathering and meeting space for the downtown/Red Star community.
Seeing no other appearances to speak, Vice-Chairman Skinner closed the public hearing. A
motion was made by Mr. Dowdy and seconded by Mr. Thompson to recommend approval of

Smith and Mr. Stanfield indicated that they are aware of and agree to the conditions of
approval. Mr. Smith added that a revised landscaping plan has been submitted.
A staff report was submitted to the Commission, which contained the following findings of
fact:
Criterion #1: As part of the exception request, a "substantial equivalent" is proposed.
"Substantial equivalent" means an alternate design, method or feature that accomplishes
the same purpose as the applicable Development Code requirement.
Findinq: The subject property is being developed for a convenience store with
motor fuel sales. In order to accommodate the necessary vehicle circulation
paths (including tractor-trailers), the site plan shows reduced interior parking lot
landscaping area compared to what is required by the code. To offset this
reduction, the developer has agreed to provide additional plantings in the
landscaping areas around the building and along the perimeter of the site. This
counts as a substantial equivalent because the additional plantings are not
required by the code. Aside from the street landscaping strip along Veterans
Memorial Drive, the code only requires the developer to install ground cover
(such as grass or decorative rock) in the landscaping areas. The developer is
willing to install plantings in addition to ground cover in these areas. While the
square footage of the landscaping will be reduced, the quality of the landscaping
will be increased, resulting in a trade-off. The additional plantings will help
beautify the site and provide a balance to the pavement, thus accomplishing the
same purpose as the parking lot interior landscaping area requirement.
Criterion #2: Approval of the exception request is consistent with the general spirit and
intent of the Development Code.
Findinq: The substantial equivalent proposed by the applicant ensures fairness
among property owners and tenants, which makes approval of the exception
request consistent with the general spirit and intent of the Development Code.
Based on the above findings, staff recommended approval of the exception request,
subject to the following condition:
1. The developer shall submit a revised landscaping plan showing the additional
plantings including, but not limited to: trees, shrubs, and flowering plants.
The types, quantities, and locations of the plantings shall be subject to
approval by the City staff. The landscaping shall be installed in accordance
with the approved landscaping plan prior to issuance of the certificate of
occupancy and shall be permanently maintained.
Vice-Chairman Skinner opened the public hearing. Seeing no appearances to speak, he
closed the public hearing. A motion was made by Mr. Greaser and seconded by Mr. Welch
to approve the exception request, subject to the condition in the staff report. The motion
passed with a roll call vote of 7 in favor, 0 in opposition, and 0 abstaining. (Aye: Dowdy,

Mr. Shrimplin informed the Commission that Harry Rediger, TTF6 Committee Chairman,
will give a presentation on the Committee's list of proposed projects at the October 16,
2019 City Council meeting.
Mr. Greaser asked why the amount of unspent TTF5 funds is so high. Mr. Shrimplin
explained that, for various reasons, several of the TTF5 projects are being constructed in
the later years. For example, the Independence Street from Gordonville Road/East
Rodney Drive to Caruthers Avenue project involved a traffic study to define the issues and
determine the scope of work. After the traffic study was completed, the consultant had to
work with the City staff on the design. A significant amount of the project budget is
allocated for construction, which is the last phase of the project. Other projects, such as
West End Boulevard from Rose Street to Bertling Street, require extensive coordination
with property owners and utility providers to refine the design and acquire the necessary
easements. Additionally, the City Engineer position was vacant for a period of time, which
left the Engineering Services Division understaffed.
Adjournment
There being no further business, the Commission voted unanimously to adjourn the meeting at
7:20 p.m. upon a motion made by Mr. Jackson and seconded by Mr. Greaser.
Respectfully submitted,
