Approval of Minutes
The minutes of the April 13, 2022 meeting were unanimously approved upon a motion made by
Mr. Thompson and seconded by Mr. Blank.
REZONINGS, SPECIAL USE PERMITS, AND EXCEPTIONS
A public hearing was held on the request of Gibson Recovery Center to rezone property
located at 1112 Linden Street from R-4 (Medium Density Multifamily Residential District) to
C-1 (General Commercial District). Ryan Essex, Gibson Recovery Center Chief Operating
Officer, presented the request. He explained that Gibson Recovery Center has several
offices and would like to consolidate them into a single office on the site of the existing
residential treatment facility at 1112 Linden Street. The present R-4 zoning does not allow
office buildings. Mr. Martin asked if the existing building would be demolished. Mr. Essex
replied that the existing building would remain and the new building would be constructed
behind it.
Chairman Greaser opened the public hearing and, seeing no appearances to speak, he
closed the public hearing. A staff report was submitted to the Commission, which
recommended approval of the rezoning request. Ms. Stickel abstained from the discussion
and vote for business reasons. A motion was made by Ms. Young and seconded by Mr.
Blank to recommend approval of the rezoning request. The motion passed with a roll call
vote of 7 in favor, 0 in opposition, and 1 abstaining (Aye: Blank, Greaser, Koetting, Martin,
Thompson, Whittington, Young; Abstain: Stickel).
2. A public hearing was held on the request of Meyr Properties, L.P. to rezone property located
on the south side of LaSalle Avenue, west of Baldwin Drive, from C-2 (Highway Commercial
District) to R-1 (Single -Family Suburban Residential District). Chris Koehler, Koehler

Engineering and Land Surveying, presented the request. He explained that when the
property was annexed to the city several years ago, Mr. Meyr anticipated developing it for
commercial uses. Since that time, Mr. Meyr has changed his mind due to the demand for
residential development. He now plans to develop the property for a single-family
residential subdivision.
Chairman Greaser opened the public hearing and, seeing no appearances to speak, he
closed the public hearing. A staff report was submitted to the Commission, which
recommended approval of the rezoning request. A motion was made by Mr. Koetting and
seconded by Ms. Stickel to recommend approval of the rezoning request. The motion
passed with a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining (Aye: Blank,
Greaser, Koetting, Martin, Stickel, Thompson, Whittington, Young).
3. A public hearing was held on the request of the City of Cape Girardeau to rezone property
located at 1520 North Mount Auburn Road from R-1 (Single -Family Suburban Residential
District) to C-2 (Highway Commercial District). Mr. Shrimplin explained that the property
contains a billboard, which was constructed several years ago. At the time the billboard was
constructed, the property was zoned commercial. It was rezoned to R-1 in 2010 when the
City adopted a new zoning ordinance and zoning map. It is not clear why the property was
rezoned to R-1 given the existing billboard. Staff researched City records and did not find
any documentation explaining the reason for rezoning the property to R-1. The billboard
owner has requested that the City rezone the property back to commercial.
Chairman Greaser opened the public hearing and, seeing no appearances to speak, he
closed the public hearing. A staff report was submitted to the Commission, which
recommended approval of the rezoning request. A motion was made by Mr. Thompson and
seconded by Mr. Koetting to recommend approval of the rezoning request. The motion
passed with a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining (Aye: Blank,
Greaser, Koetting, Martin, Stickel, Thompson, Whittington, Young).
4. A public hearing was held on the request of the City of Cape Girardeau for a special use
permit to maintain and operate an existing billboard in the C-2 (Highway Commercial) district
at 1520 North Mount Auburn Road. Mr. Shrimplin explained that a special use permit is
required for a billboard in the C-2 district. The City agreed to apply for the special use
permit along with the rezoning on behalf of the billboard owner. Approval of the special use
permit request is contingent upon approval of the rezoning request.
Chairman Greaser opened the public hearing and, seeing no appearances to speak, he
closed the public hearing. A staff report was submitted to the Commission, which
recommended approval of the special use permit request, subject to the following
conditions:
1. The special use authorized by this permit shall meet all applicable requirements of
the Zoning and Development Codes except as noted below.
2. The following exceptions are hereby granted as a part of this permit:
a. An exception to allow the existing billboard to be within 1,400 feet of another
billboard;

face area of 600 square feet.
3. Major modifications to said special use (including, but not limited to, the site plan)
shall require the approval of the City Council.
4. This permit is not transferrable without the approval of the City Council.
A motion was made by Mr. Koetting and seconded by Ms. Stickel to recommend approval of
the special use permit request, subject to the conditions in the staff report. The motion
passed with a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining (Aye: Blank,

OTHER ITEMS AND COMMUNICATION
8. Chapter 30 Amendment Regarding C-2, Highway Commercial District
City of Cape Girardeau
Planning & Zoning Commission
Meeting Minutes
May 11, 2022
Mr. Shrimplin presented a proposed amendment to the C-2, Highway Commercial District
regulations in the Zoning Code (Chapter 30 of the City's Code of Ordinances). He explained
that the amendment changes "vehicle washing facilities, automatic or hand wash" from a
special use to a permitted principal use. He noted that, in recent years, there has been an
increase in development activity related to car washes. Several new car wash facilities have
been constructed, with additional facilities under construction or proposed. Staff believes
the requirement to obtain a special use permit for this type of use in the C-2 district is
unnecessary, especially considering the fact that more intensive uses, such as hospitals,
are permitted principal uses.
A motion was made by Mr. Whittington and seconded by Ms. Stickel to recommend approval
of the amendment as proposed by staff. The motion passed via a unanimous vote.
9. Chapter 30 Amendment Regarding R-4, Medium Density Multifamily Residential District
Mr. Shrimplin presented a proposed amendment to the R-4, Medium Density Multifamily
Residential District regulations in the Zoning Code (Chapter 30 of the City's Code of
Ordinances). He explained that the amendment adds a paragraph entitled "Parking
regulations" at the end of the section. He noted that all of the other residential zoning
districts contain this paragraph. It is believed that the paragraph was inadvertently omitted
when the R-4 regulations were last amended.
A motion was made by Mr. Thompson and seconded by Mr. Blank to recommend approval
of the amendment as proposed by staff. The motion passed via a unanimous vote.

STAFF REPORT
TO: Planning and Zoning Commission
FROM: Ryan Shrimplin, City Planner AS
MEETING DATE: June 8, 2022
SUBJECT: Rezoning Request for Property at 2617 Maria Louise Lane
A rezoning application has been submitted for the property at 2617 Maria Louise Lane.
The applicant is requesting that the property be rezoned from R-1 (Single -Family
Suburban Residential District) to R-4 (Medium Density Multifamily Residential District).
The immediately surrounding properties are zoned R-1 (Single -Family Suburban
Residential District) on all sides. This area is characterized by single-family residential
and recreational uses. The Cape Vision 2040 Future Land Use Map shows the subject
property as Low Density Residential.
In considering a rezoning request, the Planning and Zoning Commission and the City
Council must determine if the proposed zoning district is reasonable and in reasonable
conformity with the existing uses and value of the immediately surrounding properties.
The subject property is located in an area exclusively zoned single-family residential.
Uses permitted by right in the R-4 district include: single-family detached dwellings; two-
family (duplex) dwellings; multifamily dwellings; townhouses; nursing homes, senior
citizen housing and retirement homes; noncommercial, not-for-profit residential
neighborhood facilities; public parks, playgrounds, and recreational facilities; police and
fire stations; elementary, middle and secondary schools, and development centers; and
commercial day cares. Staff has concerns about the potential for adverse traffic
impacts on Maria Louise Lane and the surrounding residential streets if the property
were to be rezoned to R-4 and developed for a non-residential permitted use, such as a
commercial day care. In addition, rezoning to R-4 would not be consistent with the
Cape Vision 2040 comprehensive plan. For these reasons, staff does not believe the
proposed zoning district is reasonable and in reasonable conformity with the existing
uses and value of the immediately surrounding properties.
Based on the above findings, staff recommends denial of the rezoning request.

MEETING DATE: June 8, 2022
SUBJECT: Exception Request for Property at 1542 North Water Street
An exception application has been submitted for the property at 1542 North Water
Street, which is zoned NC (Neighborhood Commercial). The applicant is requesting an
exception from the following section of the Development Code (Chapter 25 of the City's
Code of Ordinances):
Section 25-161(a
Fence height and
surface requirements
commercial use
Requirement
Maximum height of 4
feet in front yard; fence
surface must be at least
50% open; chain link
prohibited
Request
Approval of a 4 foot high
chain link fence in the
front yard as described
and depicted in the
application
The Development Code authorizes the Planning and Zoning Commission to grant
exceptions in accordance with Section 25-12(b). In order for an exception request to be
approved, the Planning and Zoning Commission must consider and make findings of
fact with regard to certain criteria. Staff has reviewed the criteria and made the
following determinations:
Criterion #1: As part of the exception request, a "substantial equivalent" is proposed.
"Substantial equivalent" means an alternate design, method or feature that
accomplishes the same purpose as the applicable Development Code requirement.
Finding: The purpose of the requirement is to ensure high-quality commercial
development through the use of fence styles, materials, and finishes that are
decorative when located in the front yard. The fence was recently installed
without any permits or approvals. It has a standard galvanized finish, which is
not considered decorative. Painting or coating the fence to give it a decorative
look would serve as a substantial equivalent.

Criterion #2: Approval of the exception request is consistent with the general spirit and
intent of the Development Code.
Finding: If the aforementioned substantial equivalent were to be imposed as a
condition of approval, it would ensure fairness among property owners and
tenants, thus making approval of the, exception request consistent with the
general spirit and intent of the Development Code.
Based on the above findings, staff recommends approval of the exception request,
subject to the following condition:
1. The fence shall be painted or coated to give it a decorative look. The type and
color of paint or coating shall be subject to approval by the City staff.

STAFF REPORT
TO: Planning and Zoning Commission
FROM: Ryan Shrimplin, City Planner CIAS
MEETING DATE: June 8, 2022
SUBJECT: Capaha Place Record Plat (Revised)
A revised record plat has been submitted for Capaha Place, located at 1731 Pemiscot
Street, 779 Perry Avenue, and 789 Perry Avenue. The area to be resubdivided is
zoned R-3 (High Density Single -Family Residential). The previous version of the plat
showed 16 lots (nine townhouse lots, three single-family detached lots, and four
common ground lots) and a private street. The revised plat shows 13 lots (six
townhouse lots, two single-family detached lots, one duplex lot, and four common
ground lots) and a private street. Two variances are shown. The first variance is for the
omission of the required front yard setback along the new private cross access and
public utility and sewer easement on Lots 1 through 7. The second variance is for a
reduced rear yard setback on Lot 7 and along a portion of the rear lot line on Lot 6.
Staff supports both variances because they are necessary to accommodate the access
easements for the development.
Staff has reviewed the plat, and all staff review comments have been successfully
addressed.
Based on the above findings, staff recommends approval of the record plat as
submitted.
