The applicant is requesting that the property be rezoned from PD (Planned Development District) to R-3 (High Density Single -Family Residential District). The immediately surrounding properties are zoned R-1 (Single -Family Suburban Residential District) to the north, east, and southeast; AG (Agricultural District) to the southwest; and R-3 (High Density Single -Family Residential District) to the northwest. This area is characterized by residential, educational, and recreational uses. The Cape Vision 2040 Future Land Use Map shows the subdivision as Medium Density Residential. In considering a rezoning request, both the Planning and Zoning Commission and the City Council must determine if the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. The property was rezoned to PD in 2016. The developer requested the PD district because he anticipated that the lots would not meet the requirements of the R-3 district. After recently meeting with the applicant for the current rezoning request, staff reviewed the record plats for the subdivision and determined that the only characteristic not meeting the R-3 standards is the front setback on each lot (20 feet required; 16 feet approved as part of the PD). The applicant plans to resubdivide the lots in the near future and will include a variance request for the reduced setbacks as part of the plat. The subdivision consists of residential and common ground lots arranged around two private cul-de-sac streets. The north street (Shadow Wood Lane) has been constructed. Eight of the lots on this street contain dwelling units (single-family or two- family/duplex). The south street (Shadow Circle) has not been constructed, and all of the lots around it are undeveloped. The R-3 district permits single-family and two-family dwellings by right and, as stated previously, the subdivision meets the R-3 standards except for the front setbacks (for which a variance will be requested as part of the upcoming resubdivision). Additionally, the R-3 district is the zoning equivalent of the Medium Density Residential future land use category in the Cape Vision 2040 BtBAi0e9 O o erre eGL 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDE-AU COMMUNITY DEVELOPMENT comprehensive plan. For these reasons, the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. Lyle Randolph PD (Planned Development) REQUESTED ZONING: PD (Planned Development) CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT STAFF REPORT TO: Planning and Zoning Commission FROM: Ryan Shrimplin, City Planner e5Fs MEETING DATE: January 12, 2022 SUBJECT: Request for Approval of Amended Final Development Plan for Century Casino (formerly Isle Casino) Planned Development District An application has been submitted for an amendment to the approved final development plan for the Century Casino (formerly Isle Casino) Planned Development District, located at 777 North Main Street. The final development plan was approved by the City on February 7, 2011. The -plan is being amended to accommodate changes related to a proposed hotel. The plan was approved for a hotel at the south end of the casino facility (up to 200 rooms, 11 stories, and 150,000 square feet). The amendment lowers the minimum number of off-street parking spaces for the entire development from 1,036 to 1,015. The proposed hotel will be much smaller than originally anticipated and will contain between 75 and 80 rooms. As a result, fewer parking spaces will be needed. The amendment also makes several changes to the sign package. The plan was approved for a wall -mounted video display board (225 square feet) on the west building elevation. The amendment moves the video display board to the south building elevation and increases the area to 672 square feet. It also replaces two restaurant wall signs approved for the south elevation (90 square feet and 415 square feet) with a casino wall sign (254 square feet - existing), a hotel canopy sign (24 square feet), a hotel tower logo sign (490 square feet), and a restaurant logo sign (62 square feet). The hotel tower logo sign will be mounted on the roof of the tower. Section 25-506(i) of the Development Code (Chapter 25 of the City's Code of Ordinances) requires a master sign plan for all landlord or single -owner controlled multiple -occupancy developments on parcels exceeding three (3) acres in size. The final development plan serves as the master sign plan for this development. Section 25-506(i) authorizes the code official to approve master sign plan amendments. In this case, approval of the amendment would be by the City Council. In reviewing the application, staff noted that the proposed video display board is much larger than the one originally approved (nearly three times the size). In addition, it will be displayed at a much greater height (at the top of the hotel rather than on a casino TER UNIO RAIS 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU_ COMMUNITY DEVELOPMENT wall). It will be highly visible from the south, especially the North Main Street corridor. The hotel tower logo sign will be highly visible from all directions. These types of signs are not unusual for a casino hotel development, which has unique needs in terms of branding identity, messaging, and promotions. Given the unique character of the development and the fact that the area to the south contains several nonresidential and mixed-use properties, staff is not opposed to the signs. Based on the above findings, staff recommends approval of the amended final development plan. o m + o THE oxen &F_" 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org Rezoning Request 777 North Main Street Requested amendment to the PD (Planned Development) final development plan SeconQ Future Land Use Recommendation: Regional Commercial 322 LO e 4 0 g ° • 0 n32 306 l c Olive St ° 9! The applicant is proposing to use five (5) shipping containers on the property for an indefinite period of time. The long-term use of shipping containers in the M-1 district requires a special use permit. The shipping containers (8 feet x 40 feet each) are proposed to be stacked side-by-side on a gravel pad (40 feet x 40 feet). A concrete pad (20 feet x 40 feet) in front of the gravel pad is also proposed. The Zoning Code (Chapter 30 of the City's Code of Ordinances) authorizes the City Council to grant special use permits in accordance with Section 30-401. In order for a special use permit to be granted, both the Planning and Zoning Commission and the City Council must consider and make findings of fact with regard to certain criteria. Staff has reviewed the application according to the criteria and made the following findings: Criterion #1: The proposed special use will not substantially increase traffic hazards or congestion. Finding: The shipping containers will be used to store food and other supplies as an accessory use to the principal use (a kennel). They will not generate any traffic except for deliveries. Criterion #2: The proposed special use will not substantially increase fire hazards. Finding: Shipping containers are inherently fire resistant. Research has found that when a fire occurs inside a closed container, it uses up all the oxygen and extinguishes itself. Criterion #3: The proposed special use will not adversely affect the character of the neighborhood. GL i m °p•` f y0 a YT 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT Finding: The shipping containers will be set back over 300 feet from the street and 20 feet from the nearest side lot line. The adjacent property contains a field. The containers are not new, and all of them have surface damage. The applicant has agreed to repaint the containers, if necessary. Staff recommends requiring the containers to be repainted because the adjacent property could be developed in the future. Criterion #4: The proposed special use will not adversely affect the general welfare of the community. Finding: If they are repainted, the shipping containers will have a clean and neat appearance, which will not adversely affect the community. Criterion #5: The proposed special use will not overtax public utilities. Finding: The shipping containers will not use any utilities except for electric (for the temperature controls). Based on the above findings, staff recommends approval of the special use permit request, subject to the following conditions: 1. The special use shall meet all applicable requirements of the Zoning and Development Codes. 2. The shipping containers shall be repainted, with the final color(s) subject to approval by the City staff. 3. Major modifications to the special use (including, but not limited to, the site plan) shall require the approval of the City Council. 4. This permit shall automatically expire 12 months from the date of issuance if the building permit has not been issued. If the building permit is issued within this time frame and later expires due to lack of progress, then this permit shall automatically expire upon the expiration of the building permit. 5. This permit is not transferable without the approval of the City Council. During the review, the following items were found which need correction or attention (text in red is to be added or changed verbatim): 1. In the description beneath the plat title, change "RE-SIBDIVISION" to "RESUBDIVISION". 2. In the description beneath the plat title, change "PLAT BOOK 4 AT PAGE 20" to "PLAT BOOK 4 AT PAGE 30". 3. In the vicinity map, remove the shading around the dot. 4. Revise the Point of Beginning label to read as follows: POINT OF BEGINNING NORTHWEST CORNER OF LOT 1, BLOCK 3 A RESUBDIVISION OF SCHLUETER'S SUBDIVISION PLAT BOOK 4, PAGE 30 5. The City's GIS Coordinator recently discovered an error in the County parcel map regarding the alley west of Franklin Avenue (located directly below the Point of Beginning label on the plat). The map previously showed this alley as vacated. It was corrected to show the alley as still existing. Revise the plat to reflect his correction by extending the northernmost right-of- way line west and removing the short line between the alley right-of-way lines. In addition, label both sides of the alley, including the width. Refer to the attachment. 6. In the labels for existing Lots 1, 2, 3, 4, and 5, change "RE -SUBDIVISION" to "RESUBDIVISION". 7. In both side setback labels, "SIDE" is misspelled. 8. In the Subdivision Notes section, under Minimum Lot Area, make "TOWNHOUSE" plural. 9. In the Subdivision Notes section, under Minimum Lot Area, "UNIT" is misspelled. a 0 r 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT 10. In the Subdivision Notes section, under Front Setback, make "TOWNHOUSE" plural. 11. In the Subdivision Notes section, under Rear Setback, add "(ALL USES)" after "20 FEET". 12. In the Subdivision Dedication section, revise the first paragraph to read as follows: THE UNDERSIGNED, WANDA A PIPKIN, A SINGLE PERSON, OWNER IN FEE OF ALL OF LOTS 1, 2, 3, 4, AND 5 OF BLOCK 3 OF A RESUBDIVISION OF SCHLUETER'S SUBDIVISION AS RECORDED IN PLAT BOOK 4 AT PAGE 30 IN THE LAND RECORDS OF CAPE GIRARDEAU COUNTY, MISSOURI, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI, CONTAINING 15,803 SQUARE FEET (0.36 ACRES), MORE OR LESS, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: 13. Boundary adjustment plats do not go through the subdivision plat process. Instead, they are reviewed by staff only and if approved, staff submits the plat prints to the Cape Girardeau County Recorder of Deeds Office for recording. A boundary adjustment plat cannot change the number of lots, reduce existing lots below the required minimum size, or change easement or utility lines. Applicants who are unsure of which type of plat they need to submit or have other questions should contact: City of Cape Girardeau Planning Services Division 401 Independence Street Cape Girardeau, MO 63703 (573) 339-6327 cityplanning@cityofcape.org For preliminary plats and record plats, the application deadline is four (4) weeks prior to the Planning and Zoning Commission meeting date. The Commission meets monthly on the second Wednesday. Applications must be delivered to the Planning Services Division using the above contact information. City staff will review each application for completeness. If required information and/or items are missing, the applicant will be contacted. Incomplete applications will not be reviewed until the requested information and/or items are provided. Once an application has been deemed complete, it will be placed on the next Planning and Zoning Commission agenda. Staff will review the plat for compliance with the subdivision plat requirements (see attached) as well as the City's zoning and subdivision regulations. If a resubmission is necessary, a staff review letter will be prepared and sent to the applicant. The resubmission and review process continues until all staff comments have been successfully addressed and the plat is in its final form. A staff report will be prepared and delivered to the Planning and Zoning Commission one (1) week prior to the meeting. The staff report, along with the meeting agenda, will also be delivered to the applicant. The staff report will contain one of the following recommendations: a) approval of the plat; b) approval of the plat, subject to staff's comments being successfully addressed; c) denial of the plat; or d) action on the plat be tabled (postponed). If the plat is not in its final form by this time, the staff report will recommend b, c, or d. At the meeting, the Planning and Zoning Commission will review the plat and make a recommendation to the City Council. The applicant or their representative must attend the meeting to answer any questions regarding the plat. A plat must be in its final form in order to be reviewed by the City Council. It is the applicant's responsibility to be informed as to the status of the plat and to address any issues affecting the review schedule. Once staff has determined that a plat is in its final form, the applicant will be notified to submit a digital file of the plat in .dxf format and the requisite number of prints. Each print must be signed and sealed by the professional surveyor and, in the case of a record plat, contain the notarized signature of each Property Owner of Record. The deadline for submitting prints is one (1) week prior to the Council meeting. If the subdivision created by the plat involves new public improvements (such as water or sanitary sewer mains, streets, street lights, or sidewalks), then those improvements must be completely installed and ready for acceptance by the City and/or covered under a performance guarantee agreement in accordance with the City's Code of Ordinances before the City Council reviews the plat. The City Council will vote on a motion to approve the plat. Preliminary plats are approved by motion and do not go on to the next Council meeting. Record plats are approved by ordinance and must receive approval of the first reading at one meeting and approval of the second and third readings at the next meeting. If approved, the plat prints will be signed by the City Clerk, who will also affix the City seal to them. For a preliminary plat, the developer may then proceed with the submission of the record plat for the first phase of the subdivision. For a record plat, the City Clerk will wait until the mandatory ten (10) day waiting period for ordinances has passed before signing and sealing the prints. Staff will then submit the plat prints to the Cape Girardeau County Recorder of Deeds Office for recording. Staff will notify the applicant when their copy of the recorded plat is ready for pick-up. Planning & Zoning Commission TYPE OF PLAT SUBMITTED: NAME OF SUBDIVISION: LOCATION OF TRACT: APPLICANT: PROPERTY OWNER: PROFESSIONAL SURVEYOR/ ENGINEER: DEVELOPER: Record Plat Glyn Ferrell Properties LLC Subdivision 602 South Kingshighway Glyn Ferrell Glyn Ferrell Bowen Engineering & Surveying CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT STAFF REPORT TO: Planning and Zoning Commission FROM: Ryan Shrimplin, City Planner s MEETING DATE: January 12, 2022 SUBJECT: Glyn Ferrell Properties LLC Subdivision Record Plat A record plat has been submitted for Glyn Ferrell Properties LLC Subdivision, located at 602 South Kingshighway. The property is zoned M-1 (Light Manufacturing/industrial). The plat resubdivides two tracts to form two new lots. An exception is shown for the omission of the required 10 foot utility easement along both right-of-way lines. Staff supports the exception because there are no existing or proposed utilities in the areas where the easement is required. An exception is also shown for the omission of the required cross -access easement along South Kingshighway. Staff supports the exception because each proposed lot has existing access directly to South Kingshighway. The attached staff review letter was sent to the applicant. At the time of this report, a corrected plat has not been received. Based on the above findings, staff recommends approval of the record plat, subject to staff's comments being successfully addressed. *THE IINIO BEAL 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT December 30, 2021 VIA EMAIL ONLY: chriskelley(bowenengsurv.com Mr. Glyn Ferrell P.O. Box 72 Benton, Missouri 63736 RE: Glyn Ferrell Properties LLC Subdivision Record Plat Dear Mr. Ferrell: City staff has completed its review of the above plat. During the review, the following items were found which need correction or attention (text in red is to be added or changed verbatim): 1. The plat shows a tract being conveyed from the Special Need(s) Trust to the LLC. The deed for this conveyance will need to be recorded and the new Document Number included in a separate owner label in the exhibit and added to the References section prior to review of the plat by the City Council. 2. On the tract being conveyed, add the following label: NOW OR FORMERLY GLYN FERRELL PROPERTIES, LLC DOCUMENT NO. 20 - 3. In the Survey Notes section, first paragraph, correct the last Document Number. It should be 2021-01705. 4. In the References section, add the following (this assumes that the conveyance is via a general warranty deed; if a different type of deed is used, then substitute accordingly): GENERAL WARRANTY DEED, DOCUMENT NO. 20--. 5. Revise the vicinity map as follows: • Add a North arrow and "NOT TO SCALE" or "NTS". • Label Interstate 55. • Add "SOUTH" or "S." in front of "MT. AUBURN RD.", "SILVER SPRINGS RD.", "BROADVIEW ST.", and "KINGSHIGHWAY". 6. Remove the EXISTING EASEMENT LINE symbol from the legend since it is not used in the exhibit. s t M E11L 44 North Lorimier St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT 7. In the curve dimension table, change the bearing for C1 to follow the direction of the legal description (S 00°25'01" E). 8. Check each owner label against its respective deed to make sure the name in the label matches the name as it appears in the deed. For example, is "NEED" plural in the deed for the Special Need Trust? Does the Trust name include a date? 9. In the label "SOUTH KINGSHIGHWAY (A.KA. U.S. ROUTE 61 (R/W VARIES)", remove the parenthesis in front of "A.KA." and add a period after the second "K". 10. Add "LOT NO. 2" to the label for Bean's 10th Subdivision. 11. Add the following notes to the plat: AN EXCEPTION IS SHOWN FOR THE OMISSION OF THE REQUIRED 10 FOOT UTILITY EASEMENT ALONG THE SOUTH KINGSHIGHWAY AND COMMERCIAL STREET RIGHT- OF-WAY LINES. AN EXCEPTION IS SHOWN FOR THE OMISSION OF THE REQUIRED CROSS ACCESS EASEMENT ON LOTS 1 AND 2. 12. Add the names of the LLC and the Special Need(s) Trust to the first line of the Subdivision Dedication section. Be sure to state the names as they appear in the respective deeds. After the LLC, include "A MISSOURI LIMITED LIABILITY COMPANY,". 13. In Mr. Ferrell's signature line, change his title to "MANAGER" or, if he is not a Manager of the LLC, then change his title to "MEMBER". 14. In Ms. Simpson's signature line, make "NEED" plural if that is how the name appears on the document establishing the Trust. 15. The notary certificate is incorrect. Replace it with two separate notary certificates (one for the LLC and another for the Trust). Please make the above corrections to the plat and email a .pdf file of the corrected plat to me at rshrimplin(cDcityofcape.org by January 10, 2022. Once the .pdf file is received, City staff will review it to make sure all of the corrections have been made. If there are no further corrections, then you will be notified to submit six (6) signed and sealed prints of the corrected plat. If the .pdf file is not received by January 10, 2022, then the Planning and Zoning Commission may postpone taking action on the plat or recommend approval, subject to staff's comments being successfully addressed. All staff comments must be successfully addressed prior to review of the plat by the City Council. Please contact me if you have questions or comments.
