ARTICLE 5 . This Ordinance shall be in full force and effect ten days after its passage and approval . PASSED AND APPROVED THIS DAY OF , 2009 . Jay B. Knudtson, Mayor ATTEST: Gayle L. Conrad, City Clerk 9 The Boulevard Local Historic District Design Guidelines This document is designed to locate a local historic district, known as the Boulevard Local Historic District, within the City of Cape Girardeau, MO and in accordance with Chapter 30, Article V, Sec. 30-116 through Sec. 30-139 entitled Historic Preservation of the established municipal code of ordinances. The categories listed below are design guidelines developed with the assistance of a committee comprised of district property owners. The scope of these guidelines apply to existing properties, new construction (including demolition), additions, and changes in occupancy or use within the district boundaries. However, all existing properties within the district boundaries will be considered "grandfathered in" as is, and will not be required to be retrofitted to conform to the new guidelines until their future actions fall under these guidelines. The objective for the proposed district and the coordinating design guidelines is to maintain the distinctive character found throughout much of the neighborhood. The S following are specific standards to establish criteria by which alterations to existing structures as well as to new construction can be reviewed. Some of the guidelines are precise whereas others are, by necessity, more general, allowing a range of alternative solutions all of which are compatible with the existing neighborhood. In order for these criteria to best become working tools for the property owner, contractor, developer and/or architect, they should be studied thoroughly before design work begins. Property owners within the boundaries of the Boulevard Historic District are required to seek a Certificate of Appropriateness (CoA) from the Historic Preservation Commission (hereafter known as the HPC, a certified board of the City of Cape Girardeau), prior to any construction, alteration, removal or demolition, in whole or in part, to their property. Any new construction on a vacant lot within the district boundaries (infill) must also seek a CoA from the HPC as per Section 30-128 of the City Zoning Ordinance. The categories listed below are design . guidelines developed with the assistance of a committee comprised of district property owners. The following are specific standards to establish criteria by which alterations to existing structures as well as to new construction can be reviewed. +t'emiscot ' woodland BOULEVARD LOCAL ' " HISTORIC DISTRICT I. - Rose a Hrjlc_rest Y 1( r AakVw ._ : ` ch a N 1 . ney _1 ftockwood m w c'o z r " Y t L.epend o Normal LNorrnal ; , Boulevard Local Historic District '' ° ° o Streets \ Y ' C6 , ;,- a' = . a; i o r '' , Brpaa . waY J 0 290 580 1.t6o Feet %; i i i THE BOULEVARD LOCAL HISTORIC DISTRICT - DESIGN GUIDLINES _ ; SECTION i , General 1. The Boulevard Historic District guidelines must first adhere to the general standards for review set out in Chapter 30 Article V, Section 30-133, Standards for Review and to the design guidelines set out in Chapter 30 Article V, Section 30-134, Desiqn Guidelines, of the City of Cape Girardeau Municipal Code. These standards and guidelines are to be affixed to the city's guidelines. 2. Property owners are further encouraged to select licensed contractors with expertise in the use of appropriate materials experienced in working on historical buildings. If property owners choose to make repairs on their own, the district encourages them to seek advice from the HPC. 3. Local Historic District status is considered an overlay zone (H) and will not change the current zoning use within the district. The map below reflects the current zones found in the district, the majority of which are R-2 Single Family Dwellings. Properties facing Broadway are zoned C-1 Commercial, while many properties facing N. Listing does not restrict what the property owner may do with the property unless the owner is using federal assistance, like federal rehabilitation tax credits. A Local Historic District is an area in which the majority of the property owners have decided that they want to keep the historic integrity, appearance, and quality of the neighborhood that they ca11 "home". Local Historic Districts begin as a neighborhood driven effort, once support is established, an application is filed with the City. Local Historic Districts are adopted by City Ordinance and have a set of design guidelines that are written so as to preserve the historic integrity of the neighborhood. What constitutes a Local Historic District? A Local Historic District has historically or culturally aesthetic value or interest. Typically Local Historic Districts represent one or more period, style, or type of historic architecture and is a visually unique section of the City. How is a Local Historic District designated? A Local Historic District begins at the local neighborhood level. Property owners of the proposed district, hold meetings to determine district boundaries and to prepare design guidelines. 51% of property owners within a given district must sign a petition stating that they are in favor of the creation of a Local Historic District. The neighborhood submits this information onto City Staff. City Staff may either forward this onto the Historic Commission or send it back to the neighborhood. The Historic Preservation Commission will review the nomination and either schedules a Public Hearing or sends it back to City Staff or the neighborhood. If the Historic Preservation Commission holds a Public Hearing, they will vote to recommend approval and adopt by resolution and to forward onto the Planning and Zoning Commission or to send the nomination back to City Staff or to the neighborhood. The Planning and Zoning Commission holds a Public Meeting and makes a recommendation to City Council. The Planning and Zoning Commission can either send the district nomination back to City Staff, the neighborhood, or back to the Historic Preservation Commission. If the Planning and Zoning Commission recommends approval, the district nomination is forwarded onto City Council for a Public Hearing. City Council holds a Public Hearing and a first reading. Upon the second meeting of the City Council,a second and third reading will be conducted and the Council will vote to approve or disapprove. If the Council approves, the district is adopted by ordinance. Once the Local Historic District is adopted by Ordinance, appropriate signage may be provided to the newly created Local Historic District. Will inclusion in a Local Historic District restrict how I may use my property? A local Historic District is an"overlay" on the existing zoning classification. A Local Historic District only deals with the appearance of the district and not with the specific uses of those properties. U:I-IISTORIC PRESERVATION COMMISSIONUocal historic districtsLocal Historic District FAQ-8.24.09.doc 1 Frequently Asked Questions about Local Historic Districts Will inclusion prevent me from making changes to my property? Designation does not prevent owners from making changes to their properties, nor does it require them to restore or even fix-up their property (unless they are allowing it to deteriorate and collapse). t Designation ensures that alterations, additions, or demolitions are in keeping with special character .,/ of the area. This happens through a process called design review, whereby the Historic Preservation Commission approves major changes that are planned for the district and issues Certificates of Appropriateness (CoA's). Local designation encourages sensitive development in the district and discourages unsympathetic changes from occurring. What sorts of changes require a CoA? A CoA would be required for work that physically alters the appearance of the property, such as replacing windows and doors, installing artificial siding, enclosing a porch, adding a fence or demolishing all or part of a structure. Interior changes that do not affect the outside appearance are not reviewed and do not require a CoA. Major landscaping changes rnay be reviewed depending on your local design guidelines. If l am unhappy with a decision made by the Commission concerning my Certificate of Appropriateness application, may I appeal? Yes. The ordinance has a provision where an appeal on a CoA can be made to the City Council. What are the advantages to owning property in a Local Historic District? Historic Districts encourage reinvestment. When you are part of a Local Historic District, you have some certainty that any new construction or renovation activity will be respectful of the existing character of the community and its architecture. When a Local Historic District is designated, a set of neighborhood written Design Guidelines (that the City has also reviewed) are established. This serves as an assurance to property owners in the district that the neighbors next door, or anywhere else in the district will not make thoughtless renovations. Real estate agents in many communities use historic district status as a marketing tool to sell properties, because buyers are assured that the aspects that make a particular area attractive will be protected over a period of time. Local Historic Districts encourage better design. There is generally a greater sense of cohesion, more innovative use of materials, and greater public appeal within historic districts than in areas without historic designations. Finally, and less quantifiable, older buildings give us tangible links with our past. They tell stories of earlier times and become part of our lives. They are a record of ourselves and our communities. They provide a richness and depth to everyday life that cannot be replicated by new construction and is lost when renovated beyond recognition. What are the disadvantages? For any district to be effective, it needs to be properly administered. Problems can arise if property owners are not made aware of which activities are subject to the Commission's regulations, so the Commission must make a good and consistent effort at educating the residents within the district. Commission members should also receive regular training and guidelines should be developed, so decisions can be made objectively and based on good background information. Will my taxes go up? Property taxes are tied to real estate values. Property taxes for buildings in historic districts are taxed no differently than those outside the district. U:I-IISTORIC PRESERVATION COMMISSIONUocal historic districtsU.ocal Historic District FAQ-8.24.09.doc 2 Frequently Asked Questions about Local Historic Districts My town looks just fine the way it is—what is the value in having a historic district? As population grows and development pressure increases, local citizens actually have less influence on how their communities evolve—unless there is sorne sort of local design review in place that oversees development. Historic districts have been used successfully throughout the country as a means to protect community character, and most vibrant towns have some form of historic design review in place. Developers known for quality work frequently seek out properties in historic districts. They know up front what the ground rules are;their investment is protected; and there is an open public process already in place for reviewing site and building plans. They also recognize that history is an effective marketing tool. Creating an historic district is a way of singling out the special places within a town or City. It ensures that those unique attxibutes will remain for future generations. It prevents the gradual erosion of those places that help define those special places. Do we really need more regulations?Isn't this just zoning in disguise? Zoning regulates use;historic districts do not. Local Historic Districts also do not restrict the sale of the property, require improvements or restoration of the property, require approval for interior changes or alterations, prevent new construction within historic areas, or require approval for ordinary repair or maintenance. However, although Local Historic Distriets do not regulate how you make alterations to the interior of your property, appropriate building permits axe still necessary. Who will be making decisions once the district is in place? Ultimately, property owners will still make decisions for their property. However, if an exterior alteration is to be made, a Certificate of Appropriateness is needed depending on what the guidelines specifically say. This does not include repairs using the same materials. Am I going to be told what color I can paint my house? This depends on the design guidelines that were drafted by the property owners of a specific district. Some Local Historic Districts regulate paint color in the design guidelines and some do not. Historic Districts that regulate paint color normally only do so upon the overwhelming desire of the residents within the district. Who can I contact for more information? COUNCIL COMMUNICATIONS Mrs. Tracy announced that she would abstain from voting on BILL NO. 09-147, an Ordinance amending the Code of Ordinances by establishing the Boulevard Local Historic District, because she has a financial interest in the proposed District. Mayor Knudtson remarked that he had met with representatives from the Corps of Engineers and U.S. Representative Jo Ann Emerson to review repairsto be made to the floodwall. Mrs. Tracy noted that volunteers are still needed for the Tour of Missouri Pro Cycle Race on September 8,2009. CITY MANAGER COMMi7NICATIONS City Engineer Kelly Green presented an update on various street projects throughout Cape Girardeaq including the Mt. Auburn Road project, the La Salle Boulevard project, the waterline project, and the Fountain Streetproject. Mrs. Schneider sta.ted that the intersection of Lexington Avenue and Route W appeazs to need repair. Mrs. Green replied that she had spoken with representatives from the Missouri Department of Transportation about the possibility of that project being included in the Transportation Trust Fund 4 (TTF4) partnership. In addition, they may include the possibility of plans for a 2-lane roundabout Mrs. Green noted that the Mt. Auburn project is ahead of schedule for completion. Concerning the North Park Trail, the City is still needing an easement from one property owner, and all the - - ----- - ---- ---- --- - --- Proceedings of the City Council, City of Cape Girardeau, Mo. Reular Session Auust 31,2009 7 E00720041JB paperwork is to be sent to the Missouri Department of Transportation for their approval to bid the job. Finally, the River Trail is scheduled to be completed in four to six weeks. City Manager Mr. Scott Meyer noted that a demonstration of the new recycling containers and equipment is tentatively scheduled for Thursday, September 10, 2009, at the Osage Community Centre. In addition, there is a possibility that the vendor will conduct trial runs of solid waste : collection in different areas of Cape Girardeau. Containers may be placed at the Cape Girardeau Senior Center, and containers will be shown at a booth set up at the SEMO District Fair. He said that these would be opportunities for the public to comment on the program and to promote recycling. PLTBLIC HEARTN(;S This being the date set for a public hearing regarding the request of a majority of the property owners within the proposed Boulevard Local Historic District to be designated as a Local Historic District and have the"H"historic zoning overlaythe hearing was opened. Mr. Mike Sheehan, 510 North West End Boulevard, appeared before the Council in support of the proposed Local Historic District. He discussed the intent of the designation to preserve the appearance of the neighborhood. Mr. Chuck DiStefano, 316 North Park Avenue, appeared in support of the Historic District. He said that petitions had been submitted to the City on two occasions to support the request. Mr. DiStefano said that he would be requesting a Certificate of Appropriateness to reconstruct the front steps to his home. He stated that he feels the designation would benefit the entire neighborhood. Mayor Knudtson replied that applications for modifications would be made to the City and approved by the Historic Preservation Commission. Mrs. Suzanne Price,374 North Park Avenue, appeared before the Council in support of the Local Historic District designation. She said that residents in the neighborhood take care of their homes, and they have seen an encroachment of rental homes. They want the community to stay as it is now. Mr. John Tansil, 1225 Hillcrest Drive, addressed the Council and stated that the guidelines read that the Planning and Zoning Commission is not involved in this process and has no say in the matter. Mr. Meyer replied that the proposed Boulevard Local Historic District would be an overlay district to the existing zoning. Mr. Ken Eftink, Development Services Director, remarked that any questions relating to design guidelines are referred to the Historic Preservation Commission, and any zoning changes are referred to the Planning and Zoning Commission. Mr. Tansil said that if the Historic Preservation Commission rejects the Certificate of Appropriateness, j ; the properly owner must appeal to the Council. He felt the matter should first be refened to the ' ; Planning and Zoning Commission before referral to the City Council. Mr. Eftink answered that ' ; the Certificate of Appropriateness is reviewed by the Historic Preservation Commission because ` they are morc knowledgeable on historic issues. Mr. Tansil stated that if the neighborhood is designated as a Historic District, properly owners cannot request a variance from the District Guidelines the way residents can in other areas of Cape Girardeau. Mr. Eftink stated that the Planning and Zoning Commission is an advisory board, as is the Historic Preservation Commission, with the City Council making the final decisions. David and Linda McLain, 1208 Hillcrest Drive, appeared before the Council and stated that they had renovated their home. However, if the neighborhood were designated a Local Historic Proceedings of the City Council, City of Cape Girardeau, Mo. Regular $eSSlOt1 August 31,2009 `' 00720041J8 District, and the home needed extensive repairs or had structural damage, the cost for those repairs would far exceed the value of the home due to its age. Although they feel the neighborhood ; should have some recourse against encroaching rental properties, they stated that they do not support a Historic District designation that would give the Historic Preservation Commission control over property renovations in the neighborhood, because design guidelines could be too restrictive for older homes. Mr. and Mrs. Lynn McClain noted that only 69 of 124 property owners in the proposed Boulevard Local Historic District signed the petition submitted to the Council. Forty-five percent did not sign the petition and there was a decrease in the number of property owners signing the second petition. They asked the Council not to approve the Local Historic District request. Mayor Knudtson responded that only a 51% majority of property owners is required to sign the petition, and that number was met with the second petition submitted. Mr. Lester Goodwin, 380 North Park Avenue, addressed the Council and stated that he felt that Mr. and Mrs. McLain see the proposed Local Historic District as a threat and not as an opportunity. He said that the Historie District designation would help preserve the character of the neighborhood, and he fully supported its approval. Mr. Goodwin stated that he felt the guidelines would improve the quality of the District. Mrs. Linda Ruddy, 1222 Normal Avenue, appeared before the Council and stated that the house next to hers had been owned by rnultiple owners and was very run down but has now been purchased by a family and renovated. She said that she supported the Historic District designation to help retain the integrity of the neighborhood. Mrs. Kathryn Coffman, 656 Highland Drive, stated that she was concerned with the state of the neighborhood and wanted to preserve it. She said that she felt its designation as a Local Historic District would preserve and enhance the area. Mr. Christopher Goeke, 377 North Park Avenue, appeared before the Council in support of the proposed Local Historic District, and he stated that he felt its designation would help control what happens in the District and the neighborhood. Mr. Frank Jones, 353 North Park Avenue, appeared in support of the designation, saying that he wanted to preserve the neiglfiorhood and felt that the Local Historic District would help. There being no further appearances, the hearing was closed. BILL NO. 09-147 was given first reading as follows: AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, BY ESTABLISHING THE BOULEVARD LOCAL HISTORIC DISTRICT, IN TI-CIT'Y OF CAPE GIRARDEAU, MISSOURI Mr. Voss made a motion, seconded by Mrs. Schneider,to approve the first reading of BILL NO. 09-147. Mr. Meyer explained the historic overlay district and how its designation affects properly. Mr. Eftink stated that this is an attempt to preserve the character of the neighborhood and maintain property to blend in with the area. Homes within the proposed District do not necessarily have to be of any particular age. Mayor Knudtson remarked that the proposed Boulevard Local Historic District was initiated by a petition of property owners, and it was approved by the Historic Preservation Commission and the Planning and Zoning Commission. . Proceedings of the City Council, City of Cape Girardeau, Mo. Regular $@SSIOn August 31,2009 GG-376 Mr. Lanzotti encouraged the Historic Preservation Commission to review Mr. Tansil's comments z,. regarding additional renovation restrictions, and he stated that the Planning and Zoning Commission would retain some control over zoning issues. He also suggested that the property owners be instructed where to go when they are considering making changes to their property within the Historic District. ' City Attorney Eric Cunningham noted that as part of the Ordinance, there are design guidelines being adopted that must be followed when there is construction on the property. The Historic Preservation Commission ensures that the guidelines are being €ollowed during construction or renovation within the District Any change of use of the property is referred to the Planning and Zoning Commission. Mr.Voss asked if the historic overlay would not directly restrict use of the properly. He stated that homes within the District could still be purchased for use as rental property, and that the Ordinance affects exterior changes to the property, not interior renovations. He then asked if property owners could opt out, once the boundaries of the Boulevard Local Historic District were set. Mr. Eftink responded that the overlay could restrict use of the property, and the boundaries of the District are set by the neighborhood. There cannot be an island in the middle of the district that is excluded, but it is possible to omit a property on the edge of the boundary. Mr. Voss noted that 55% of the affected property owners signed the petition in support of the proposal, and he asked how many of the 45% who did not sign were opposed to its adoption. Mr. Sheehan responded that he had contacted all of the property owners within the proposed Historic District, and only five owners lrad objected to its designation. Mr. Cunningham said that the City Code of Ordinances Section 30-127 states how the District could be dissolved, and he noted that the Council could dissoive the Historic District with or without a petition by the property owners. He stated that an individual could request the boundaries be changecbut the Council would not be obligated to act on their request Mayor Knudtson stated that he felt the process for the Historic District designation had been followed and that the petitiones had been very thorough in establishing the Boulevard Local Historic District. He said that he would support the reyuest. Ms. Ritter and Mrs. Schneider said that they too support the District's designation. Following discussion, the first reading of BILL NO. 09-147 was approved upon the following vote: Ayes, Herbst, Knudtson, Lanzotti, Ritter, Schneider and Voss. Nays, none. He said that he had submitted a letter to Inspection Services on July 8, 2009, but that he had not yet heard anything from that department, so he did not know if the matter had been investigated. Scott Rhodes asked if the district extends south to the commercial properties along Broadway. Staff informed the Planning and Zoning Commission that the proposed district does include the commercial properties. Scott House informed the Commission that if any of the buildings should ever be demolished or have an exterior change, that they would need a Certificate of Appropriateness. It was also added that none of those property owners have asked to be removed from the district. Ralph Maxton inquired if this woutd be the first historic district. Scott House mentioned that this would be the first Local Historic District and added that we have several National Register Historic Districts, which are different from Local Historic Districts. Richard Reinhardt informed the Commission that the signatures were , . recounted and signatures where the address was left off or did not correspond with the property ownership were not counted. After the recount of signatures there were 69 out of a possible 124. The percentage of signatures was 55%. Charles DiStefano of 360 North Park Street spoke on behalf of the district designation stating that it is a way to keep the neighborhood preserved. Richard also informed the Commission that Koehler Engineering has submitted a letter requesting a variance for the minimum lot size since Lot 1 is less than 10,000 acres and also for the street frontage since it is less than 80 feet along West Rodney. Richard also informed the Commission that there has been confusion as to whether or not Bevin Drive was public or private. This plat is designating 12 feet of Bevin Drive public right of way since it has been maintained by the City. A request of Mark Rademaker for a Special Use Permit to allow travel trailers in Five Pines Mobile Home Park, located at 3020 Boutin Drive. Rademaker spoke on his request stating that his original plan was to have travel trailers in the empty lots in his mobile home park. Rademaker said that he has been moving out old dilapidated mobile homes out of the park and plans to move the remaining mobile homes in the north of the park to the south and have the travel trailers and mobile homes separated as requested by City Staff. He mentioned that the 11 acres on the north would have about 50 pads for travel trailers and the 5 acres on the south would have about 35 mobile homes. Rademaker stated that he is converting the utility and electric hookups to be suitable for travel trailers on the north side of the park. He also mentioned plans of constructing a four to seven unit bathhouse and also mentioned that there is already a Laundromat in the mobile home park. He also stated plans of planting pine trees or other landscaping to provide a separation befinreen the mobile homes and the travel trailers. Rademaker mentioned plans of a fenced in area for dogs and a pavilion sometime in the future. He added that every travel trailer pad would have a picnic table and a fire ring. Rademaker stated that he has been cleaning up the park and feels that allowing travel trailers would continue to clean up the park and increase property values in the area. Harry Rediger inquired to the number of pads in the park and if Mr. Rademaker's strategy was to fill the park. Rademaker responded by stating that the total number of pads currently is 96, however if he is granted the Special Use Permit, his total number of pads would be about 85 and that it is his goal to have the park filled and to improve the area. Rediger also asked if the people that live there are endorsing it. Rademaker answered by saying that some were present at the meeting, however others were unable to attend. Rademaker added that the people living in the park understand that it will help to clean up the area. Rademaker responded by saying that he does not see that happening because he wants the people that live there to know that they wiil have a pobablle'aveRhose lots vacanttated that if mobile home lots become vacant he wdl pr y Those in Support Matt Ulrick, who lives in the park, spoke in support of the request stating that before Rademaker purchased the park, there were police there on a regular basis. However, since Rademaker has owned the park, he has done a great job cleaning it up. Ulrick also stated that he feels that those who live there can only reap the benefits of what Rademaker is proposing to do. Earl Bell, who lives in the park, spoke in support of the request stating that he has tived there for nine years. Blankenship noted all of the improvements and money that Rademaker has put into the park and that says something about his commitment. Blankenship stated that he feels it is time for Rademaker to start 9that a S oo e ual ty of p ople isfa probl m blecausehMark does not that he does not feel p q get people that cause problems into his park. There were four others in attendance in support of the Special Use Permit. Those in Opposition Joe Moore stated that he had concerns and was not necessarily in opposition. Moore inquired if there would be a specific number of pads allowed in the Special Use Permit and added that he would not be happy if more were allowed. Moore stated that this needs to be regulated. He also inquired how long a travel trailer could remain in the park. Rademaker answered a week to several months. He stated that he wanted to provide a place for people who come to town to work on various projects to live, however it would not be a permanent residence. Chairman Hinckley stated that it could be a concern in the future and wanted to know what Rademaker s plans were with this concern. Chairman Hinckley also stated that he wants to know what Rademaker's plans were to regulate this. Larry Berkbuegler of 3647 Highway W stated that his concern was if a person moved in a trailer and just left it there. He also asked if Rademaker would be providing a buffer of landscaping along the highway. Elaine Ramsey, of 3085 Boutin spoke in opposition to this request stating that she feels that safety is an issue. Ramsey stated that she is concerned people will park there and , live there and have kids running all around the park and feels that trespassing could be a problem in the future. Ramsey stated that she has no problem with anyone in the park but feels travel trailers could get out of hand, especially with the economy the way it is. Ramsey feels that there will be problems with congestion and slower traffic and more accidents in the area. Ramsey feels that travel trailers will take the neighborhood backwards. Ramsey also asked if security would be provided. Ramsey also presented a letter from a neighbor that was unable to come to the meeting. Richard Loos, who owns property to the north of the park, spoke in opposition stating that he does not want travel trailers in his front yard. Loos stated that the area is supposed to be a residential area and not a campground. There were two others in attendance in opposition of the Special Use Permit. Discussion and Votinq on Applications 2. A request of Mark Rademaker for a Special Use Permit to allow travel trailers in Five Pines Mobile Home Park, located at 3020 Boutin Drive. Charles Haubold made the motion to recommend approval, seconded by Ray Buhs. Trae Bertrand noted that he has seen the area improved since Rademaker has owned it. Bertrand added that someone moving into the park just to live in a travel trailer is not consistent with what Rademaker is doing. Bertrand stated that Rademaker will probably boot anyone out that intends to live in a travel trailer in the park. Patricia Mothershead asked what Rademaker could do to relieve the concerns of the opposition. Mothershead also asked if Rademaker could have tighter regulations. Chairman Hinckley asked Rademaker how long he was willing to commit to having people stay in the park. Rademaker stated that he was willing to allow people to live in j the park for nine months. Charles Haubold modified his motion to recommend approval, stating that he wanted to add two more conditions to the Special Use Permit in addition to the other five as stated j in the staff memo. Mr. Haubold stated that one condition is that anyone coming into the i park to stay in a travel trailer can only be there for nine months, and the other condition I called for green area and landscaping. Ray Buhs seconded these conditions. Harry Rediger inquired about crime issues with the travel trailer camp on Kingshighway. he is not aware of an but will check with the I Ken Eftmk informed the Commission that y Police Department. i Scott Rhodes asked if new homes could be placed on existing pads. Eftink informed him j that the current pads probably won't work. Rhodes observed that Rademaker is cleaning i up the park so he can do a better job. Sarah Wallace pointed out the third condition which stated that the mobile homes and travel trailers need to be separated in the park. Ralph Maxton stated that you can't argue with someone who is improving their property but does not feel it is a good idea to have travel trailers next to mobile homes. Maxton i added that a travel trailer park stand alone would be objectionable in a residential area. , Chairman Hinckley inquired about the sewage system. Rademaker said that he thinks it is a six inch pipe. Charles Haubold noted that Rademaker would have to meet City i regulations or not have City sewer. Eftink added that the park was designed for permanent mobile homes so it should meet travel trailer needs that are temporary. Eftink also added that the travel trailers would be on a single water meter. Rademaker added that when the park was full, there was no problem carrying that load. Chairman Hinckley stated that he understands that Rademaker wants to improve his mobile home park. However, Hinckley stated that his concern was that if someone else would purchase the lot in the future, that they may not continue that improvement. Wallace stated that the Special Use Permit goes with the owner so if someone buys the park, they will have to go to City Council to have it transferred to their name. Chairman Hinckley stated that the problem is still the same. The vote count on the motion to recommend approval was 7 in favor and 2 in opposition with Chairman Hinckley and Vice-Chairman Maxton in opposition. ther Items and Communications 3.
