Regular Session October 4, 2021 LL-101 STUDY SESSION—October 4,2021 I NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, October 4, 2021, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Shelly Moore, Dan Presson, Nate Thomas, and Shannon Truxel present. REGULAR SESSION—October 4,2021 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, October 4, 2021, starting at 6:00 p.m. with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Shelly Moore, Dan Presson, Nate Thomas, and Shannon Truxel present. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Nate Thomas,to adopt the Agenda. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore, Presson,Thomas,Truxel. PUBLIC HEARINGS A public hearing to consider a request for a special use permit for purposes of constructing, maintaining, and operating a fiber optic equipment shelter facility at 2365 Independence Street. The Agenda Report in the agenda packet presented for the record, a certified copy of the following items: (1) Section 30-401 entitled "Special Use Permits" from the City Code; (2) the application for Special Use Permit; and(3)the application file. Mayor Fox opened the hearing. David Jordan representing Ritter Communications appeared in favor, and he explained the proposed project. There being no other appearances,the hearing was closed. A public hearing to consider a request to rezone property at the northeast corner of Baldwin Drive and County Road 618 from C-2 to R-3. Mayor Fox opened the hearing. There being no appearances,the hearing was closed. APPEARANCES None. Regular Session October 4, 2021 LL-102 BILL NO. 21-145, an Ordinance amending Chapter 5 of the Code of Ordinances of the City of Cape Girardeau, Missouri,regarding Sunday Liquor Sales. Second and Third Readings. BILL NO. 21-146, an Ordinance Appropriating the Expenditure of Transportation Trust Fund 6 Funds for Capital Expenditures for the Fiscal Year Ending June 30, 2022, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 21-147, a Resolution authorizing the City Manager to execute a Release of Lien for property located at 1215 Good Hope Street, under the Home Repair Opportunity Grant Program, in the City of Cape Girardeau, Missouri.Reading and Passage. Acceptance of waterline and sidewalk public improvements to serve the new VA (Veterans Administration) Behavioral Health Hospital at 711 S. Mt. Auburn Rd., in the City of Cape Girardeau. A Motion was made by Robbie Guard, Seconded by Dan Presson,to approve and adopt. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore, Presson, Thomas,Truxel. BILL NO. 21-145 will be Ordinance NO. 5458; BILL NO. 21-146 will be Ordinance NO. 5459; and BILL NO. 21-147 will be Resolution NO. 3432. NEW ORDINANCES BILL NO. 21-148, an Ordinance granting a special use permit to Ritter Communications and Henderson Enterprises, LLC, for purposes of constructing, maintaining, and operating a fiber optic equipment shelter facility at 2365 Independence Street, in the City and County of Cape Girardeau, Missouri. First Reading. A Motion was made by Shannon Truxel, Seconded by Dan Presson,to approve. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson,Thomas, Truxel. BILL NO. 21-149, an Ordinance approving the record plat of Wood and Huston, Plat No. 1. First Reading. A Motion was made by Shannon Truxel, Seconded by Robbie Guard,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore, Presson,Thomas,Truxel. BILL NO. 21-150, an Ordinance approving the record plat of Humane Society Subdivision. First Reading. A Motion was made by Shannon Truxel, Seconded by Nate Thomas,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore, Presson,Thomas,Truxel. BILL NO. 21-151, an Ordinance authorizing the Mayor to execute Temporary Construction Easements, a Permanent Drainage easement, and a Special Warranty Deed to the Missouri Department of Transportation, for a project on Missouri Highway 177, in the City of Cape Girardeau,Missouri. First Reading. A Motion was made by Dan Presson, Seconded by Nate Thomas,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore,Presson,Thomas, Truxel. Regular Session October 4,2021 LL-103 BILL NO. 21-152, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at the northeast corner of Baldwin Drive and County Road 618, in the City and County of Cape Girardeau, Missouri, from C-2 to R-3. First Reading. A Motion was made by Robbie Guard, Seconded by Stacy Kinder,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore, Presson, Thomas,Truxel. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Nate Thomas, to adjourn from regular session and to convene in closed session for legal actions and litigation, confidential communications with legal counsel, and leasing, purchase or sale of real estate, pursuant to RSMo. Section 610.021(1)and(2). Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore, Presson, Thomas, Truxel.
