REZONINGS SPECIAL USE PERMITS AND EXCEPTIONS
1, A public hearing was held on the request of RCH Development, Inc, for an exception from
Development Code Section 25-604(a), fence height and surface requirements, at 1145
Walnut Street. Mr, Ryan Roth, Koehler Engineering and Land Surveying, represented the
applicant. He explained that the applicant is requesting an exception to exceed the
maximum fence height in the front yard. The proposed fence height is six (6) feet, which
exceeds the maximum height by three (3) feet. As a substantial equivalent, the applicant is
proposing a metal picket fence with a black finish. He added that the fence is needed for
security purposes.
A staff report was submitted to the Commission, which contained the following findings of
fact
Criterion #1: As part of the exception request, a 'substantial equivalent' is proposed.
`Substantial equivalent- means an alternate design, method or feature that accomplishes
the same purpose as the applicable Development Cade requirement.
Findin : The applicant is proposing a powder -coated black ornamental fence that is
more than 50% open as a substantial equivalent. The intent of the height restriction
is to prevent fences that create a visual barrier in the front yard. Due to its
predominantly open surface, the fence will not create a visual barrier; instead, it will
serve as an attractive means of enclosing the property for security purposes while
allowing full visibility of the development.
Criterion #2: Approval of the exception request is consistent with the general spirit and
intent of the Development Code.

Chairman Skinner opened the public hearing. Seeing no appearances to speak, he closed
the public hearing. A motion was made by Mr. Spooler and seconded by Mr. Jackson to

OTHER ITEMS AND COMMUNICATION
& Chapter 25 Amendment Regarding Landscaping Buffervards and Screening
Mr. Shrimplin presented a proposed amendment to the Landscaping, Bufferyards, and
Screening section of the Development Code (Chapter 25 of the City's Code of Ordinances).
He explained that this amendment, along with the amendment for required number of
parking spaces, is proposed to be included in a larger amendment to the Development Code
that will be presented to the City Council at an upcoming meeting. The other portions of the
larger amendment are minor and do not require a recommendation from the Commission.
Mr. Shrimplin then explained that this amendment revises the landscaping. bufferyard; and
screening regulations to clarify what types of projects are exempt from the regulations. It
also adds clauses to allow an existing development that does not meet the minimum site
and/or parking lot interior landscaping area percentages to be redeveloped without having to
provide additional landscaping, as long as the existing percentage is not reduced. The
amendment also exempts parking structures from the parking lot interior landscaping
requirements and revises the bufferyard requirements to add a privacy fence option for
some development types. Lastly. the amendment removes loading docks and mechanical
equipment from the screening requirements.
A motion was made by Mr. Spooler and seconded by Mr. Koetting to recommend approval
of the amendment as proposed. The motion passed unanimously.
7. Chapter 25 Amendment Regarding Required Number of Parking Spaces
Mr. Shrimplin presented a proposed amendment to the Required Number of Parking Spaces
section of the Development Code (Chapter 25 of the City's Code of Ordinances). He
explained that the amendment adds some uses to the off-street parking and loading spaces
table (including bed and breakfasts; campgrounds, travel trailer and recreational vehicle
parks; and behavioral health hospitals). The amendment also modifies the formula for
general retail uses in order to reduce the number of parking spaces required. These
changes are being driven by recent, pending, and/or upcoming development projects.
A motion was made by Mr. Koetting and seconded by Mr. Thompson to recommend
approval of the amendment as proposed. The motion passed unanimously.
