Welch Absent: Jeff Glenn, Patrick Koetting Staff Present: Carol Peters, Ryan Shrimplin Call to Order Chairman Skinner called the meeting to order at 7:00 p.m. Approval of Minutes The minutes of the August 12, 2020 meeting were unanimously approved upon a motion made by Mr. Thompson and seconded by Mr. Welch. REZONINGS SPECIAL USE PERMITS AND EXCEPTIONS 1. A public hearing was held on the request of JJP Investments, LLC for an exception from Development Code Section 25-102, driveway width, at 1134 North Sprigg Street. Mr. Jeff Maurer, JJP Investments, LLC, explained that the proposed driveway needs to be wider than the maximum width allowed by the code because it has three lanes: one entrance lane and two exit lanes (designated left turn and designated right turn). A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1; As part of the exception request, a "substantial equivalent' is proposed. 'Substantial equivalent' means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Finding: The subject property has frontage on two non -intersecting streets. The applicant has submitted a site plan for a new commercial development, which shows a single, 36 foot wide driveway on one of the streets (North Sprigg Street). Per the Development Code, the property is permitted one driveway on this street, with a maximum width of 30 feet. The property is also permitted two driveways on the other street (North Frederick Street). The applicant is proposing to forgo the driveways on North Frederick Street in order to have a wider driveway on North Sprigg Street. This qualifies as a substantial equivalent because the applicant is giving up rights to two driveways, each with a maximum width of 30 feet, in exchange for gaining an :,` additional 6 feet in width for the proposed driveway. Staff has determined that the additional driveway width will not adversely affect traffic on North Sprigg Street. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes September 9, 2020 Page 2 of 3 Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. Finding: The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request. Chairman Skinner opened the public hearing. Seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Dowdy and seconded by Mr. Jackson to approve the exception request. The motion passed with a roll call vote of 6 in favor, 0 in opposition, and 0 abstaining.
