REZONINGS SPECIAL USE PERMITS, AND EXCEPTIONS A public hearing was held on the request of Scooter's Coffee for an exception from Development Code Section 25-102, driveway width, for property at 2404 William Street. Megan Andrews, Layton & Southard, LLC, presented the request on behalf of the applicant. She explained that, per the Development Code, the applicant is allowed access on both William Street and South Leming Lane. The applicant is willing to give up its rights to access on William Street in exchange for approval of a driveway exceeding the maximum driveway width of thirty (30) feet on South Leming Lane. She stated that a portion of the driveway will be on the adjacent Dairy Queen property, so the applicant is obtaining an access easement. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. 'Substantial equivalent' means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Finding: The subject property has frontage on two streets (William Street and South Leming Lane). Per Section 25-1003 of the Development Code, the property is allowed one driveway on each frontage. The applicant is willing to forego a driveway on the William Street frontage in exchange for a wider driveway on South Leming Lane. This counts as a substantial equivalent because the applicant is consolidating access and limiting it to the local street, which has lower traffic volumes and speeds than the arterial street. It should be noted that the proposed driveway encroaches on the adjacent property to the City of Cape Girardeau Planning & Zoning Commission Meeting Minutes June g, 2021 Page 2 of 4 north. The applicant is working with the adjacent property owner to obtain an access easement or additional land for the driveway. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. Finding: The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request, subject to the following condition: 1. A perpetual non-exclusive access easement or additional land shall be obtained from the adjacent property owner to the north for the driveway. Chairman Greaser opened the public hearing. Seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Koetting and seconded by Mr. Jackson to approve the exception request. The motion passed with a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining. (Aye: Blank, Greaser, Jackson, Koetting Martin, Stickel, Whittington, Young) SUBDIVISION PLATS 2.
