A public hearing was held on the request of Koehler Engineering on behalf of Mayson Investments, LLC to rezone property located at 3203 Bloomfield Road, 440 South Mount Auburn Road, 614 Northview Drive, and a portion of the vacated Northview Drive right-of- way from R-1 (Single -Family Suburban Residential District) to C-2 (Highway Commercial District). Chris Koehler, Koehler Engineering, presented the request. He explained that although the subject properties are zoned residential, they are located in a commercial corridor. Ms. Young asked if there are any families with children in the surrounding neighborhood and if the safety of those children was considered. Mr. Koehler responded by explaining that the developer has discussed his plans with the residents who would be most affected by the project. The residents expressed support for the project. He stated that a privacy fence would be installed to screen the new development from the adjacent residential properties. A staff report was submitted to the Commission, which recommended approval of the rezoning request. Chairman Greaser opened the public hearing and, seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Koetting and seconded by Ms. Stickel to recommend approval of the rezoning request. The motion passed with a roll call vote of 7 in favor, 0 in opposition, and 0 abstaining. A public hearing was held on the request of Catholic Charities of Southern Missouri for an exception from Development Code Section 25-804(a), street landscaping strip, for property City of Cape Girardeau Planning & Zoning Commission Meeting Mirutes August 11, 2021 Page 2 of 4 .i located at 475 North Main Street. Mr. Thompson recused himself from the discussion and vote due to his involvement with the applicant. Chris Koehler, Koehler Engineering, presented the request. He explained that due to space constraints on the lot, the applicant is requesting approval to install a decorative fence along North Spanish Street in lieu of a full ten (10) foot wide street landscaping strip. Because the street landscaping strip would not be wide enough to accommodate the required plantings, the applicant would provide additional plantings elsewhere on the site. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Finding.. The subject property is proposed to be developed for a transitional housing facility that will include a parking lot along North Spanish Street. Due to the positioning of the buildings on the property, there is not room to provide the standard 10 foot street landscaping strip. The applicant is proposing a reduced width (approximately 2 feet) along with a black metal fence in lieu of the full width and plantings. The primary purpose of the street landscaping strip requirement is to visually enhance the areas between parking spaces and the public right-of-way when the spaces are in close proximity to the right-of-way. The visual enhancement is in the form of plantings. A minimum width of 10 feet is required for the street .+ landscaping strip in order to provide sufficient room for the plantings, including the root systems. The proposed fence has a decorative design and will serve as a visual enhancement; as such, it qualifies as a substantial equivalent. The proposed width of the street landscaping strip is adequate for the installation and maintenance of the fence. The standard 10 foot width is not necessary because there will be no plantings. While the primary purpose of the required plantings is visual enhancement, the plantings also serve to screen vehicle headlights from the right-of- way and from properties across the street. For this reason, the fence should contain a screening element to reduce headlight glare. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code, Finding: The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request, subject to the following condition: 1. The fence shall contain a screening element to reduce headlight glare. The nature of the screening shall be subject to approval by the City staff. Chairman Greaser opened the public hearing and, seeing no appearances to speak, he closed the public hearing- A motion was made by Mr. Koetting and seconded by Ms. Stickel to approve the exception request with the condition stated in the staff report. Marc Mahnke, Strickland Engineering, presented the plat. He stated that the record plat is consistent with the approved preliminary plat for Deer Run Estates. He explained that the plat shows the existing drainage easement for the stormwater detention basin as being released by the City. This is because the detention basin will be reshaped, and a new easement is being granted for it. Teresa Wilke, 3726 Old Hopper Road, asked if a sidewalk will be installed along Old Hopper Road as part of the subdivision improvements. Mr. Mahnke stated that the improvement plans for the subdivision do show a new sidewalk along Old Hopper Road.
