(a) Suspension or revocation, The city manager may suspend or revoke the license of any licensee under this chapter who has failed to meet the standards of conducting business set forth In this chapter or who has made any false, misleading or fraudulent statement in the license application. Whenever a license holder under this chapter shall be closed for business for over thirty (30) consecutive calendar days, the license holder's license shall be subject to suspension or revocation upon notification by the city manager. (b) Notice of suspension or revocation. The city manager shall suspend or revoke a license issued under this chapter by sending notice of the suspension or revocation to the licensee by first class mail or by personal service on the licensee or the person in charge at the licensed premises. Mailed notice shall be presumed received three (3) days after it is mailed. The notice shall contain: (1) A statement of the grounds for the suspension or revocation. (2) The effective date of the suspension or revocation, which shall be at least ten (10) days after the notice is received. (.3) In the case of a suspension, the length of the suspension. (4) Instructions on how to appeal the suspension or revocation, (c) Appeal to liquor license review board. The licensee may appeal the suspension or revocation by requesting a hearing before the liquor license review board. The appeal must be in writing, addressed to the assistant to the chief review officer and received by the chief review officer within ten (10) days after the notice of suspension or revocation was received, Receipt of an appeal by the chief review officer shall automatically stay enforcement of the suspension or revocation. The hearing shall be conducted In the same manner as under ,section 5.3Z of this Code. (Code 7967, 4 5-30, Ord. No, 4233, art, 4, 5-'6-77) Sec. 5-37. - Review of license denial. (a) The chief review officer, after receiving a notice of appeal from an applicant, shall schedule a meeting of the liquor license review board. Before the meeting, the board members shall be provided with copies of the letter of denial, the notice of appeal and any documentation and position statements provided by the city manager and the applicant pertaining to the license denial. The board may allow the city manager and the applicant or the applicant's representative to explain their positions to the board at the meeting. The board may either affirm the denial of the license or direct the city manager to grant the license. The license, in the board's discretion, may be for less than the full period of time ending on June 30. In that case, the licensee shall pay only a prorated license fee. If the board affirms the denial, it shall set forth the grounds for denial in a letter to the applicant. The letter shall be hand delivered or sent by first class mail. A mailed letter shall be presumed received three (3) days after it was mailed. (b) The chief review officer, after receiving a notice of appeal from an objecting neighbor, shall schedule a meeting of the liquor license review board. Before the meeting, the board members shall be provided with copies of the letter of objection, the notice of appeal and any documentation and position statements provided by the objecting neighbor, the city manager and the licensee. The board may allow the objecting neighbor, the city manager and the licensee or the licensee's representative to explain their positions to the board at the meeting. The board may either affirm the renewal or granting of the license or deny the license. The license, in the board's discretion, may be for less than the full period of time ending onJune 30. In that case, the licensee shall pay only a prorated license fee. The board shall set forth the grounds for its decision in a letter to the objecting neighbor and the licensee. The letter shall be hand delivered or sent by first class mail. A mailed letter shall be presumed received three (3) days after it was mailed. (c) A decision of the liquor license review board to deny a license may be appealed by the applicant to the city council. A written notice of appeal must be received by the city manager no later than ten (10) days after the applicant received the letter from the liquor license review board denying the license. The city council shall only review an appeal made from a denial of a license. The city council shall act upon the notice of appeal after its receipt at the next regularly scheduled city council meeting. If the appeal request is received less than two (2) full working days prior to a regularly scheduled council meeting, the appeal shall be delayed to the following regularly scheduled council meeting. Spanish St, Cape Girardeau, MO 63701 Incident #: 13009151 On Thursday, December 19, 2013 Officers of the Cape Girardeau Police Department conducted a series of alcohol compliance checks throughout our jurisdiction. Working with the department was cooperating minor witness or youth buyer, who was youthful in appearance and complied with the state guidelines regarding alcohol compliance checks. A criminal history check was conducted of the youth buyer and it was established that the youth buyers did not have any chrinhel record on file. The youth buyers are identified as UC # 121913 -1 WIM 19 years of age, DOB 02-20-1994 and UC # 121913-2 W!M 1S years of age. DOB 01-03-1995. 1 h Cape Girardeau Police Department Conducted an age verification of the youth buyer on 12-19-2013 and the average age provided by ten (10) random citizens was 20.6. The youth were trained on and briefed to carry and presentwhen asked for, their true identification, and not to make any false or misleading statements concerning their age, nor to remain silent when asked questions about their age. The youth were further instructed to enter the establishment and proceed immediately to attempt to purchase intoxicating liquor utilizing the pre-recomed purchase money provided by the police department. The youth buyers were searched at the police station prior to - departure and it was established that the only identification he possessed was his valid Missouri Driver's License. A photograph of the buyer were taken prior to departing the police station. All transactions were recorded and all evidence seized by the Cape Girardeau Police Department will be retained until final deposition of the state and municipal violations. The facts in this case are as follows. At approximately 2215 hours the youth buyers along with Officers Couch #243 and Hickey #263 amved at That One Bar at 36 N. Spanish Street in Cape Girardeau, MO. Officer touch activated a video recorder and recorded the date, time and business name. Officer Couch provided the youth buyers with the activated recorder and U.S. currency, Moments later the youth buyers entered the bar had their identification checked by the doorman. The youth buyers each approached the bar and made contact with the bartender, Jennifer Sinn. They both requested a bottle of Budlight beer each. The clerk was a male. The Clerk did ask to see the youth buyers identification. The bartender requested $5.00 for the `. beers. The youth buyers provided the U.S. currency to the bartender. The bartender then provided the beers to the youth buyers ultimately selling the beers to the youth buyers. The doorman then realized that he had not looked at the youth buyers identification correctly and grabbed the beers from youth buyers. It should be noted that both youth buyers identifications clearly stated that the were under the age of ' twenty-one (21). The youth buyers were escorted out of the bar by other officers. Officer Couch made contact with the owner Alicia Dambach and asked her to have the bartender to meet me outside the bar as it was extremely loud inside. I made contact wrth Jennifer Sinn who staled that she thought the youth buyers were over the age of twenty-one (21) because they were allowed entry inside the bar. I made contact with the doorman who stated that he looked at the identifications and allowed the youih buyers to enter the bar. In addition, the youth buyer completed a minor report form detailing the specifics of the transaction and it was placed in the buyer's file along with a photocopy of their valid identification. Sprigg St. (Cape PD Station). While working the desk I was contacted in the lobby by Jia" Yu, who informed me that he had been assaulted. Victim Yu, Jian No POE When Yu walked into the lobby of station he had a large amount of blood on his shirt and pants. He had a white towel wrapped around his right hand. The towel was soaked with hired. I brought Yu into the booking room so that I could tend to his hand. i took photographs of the wound and then had him wash his hand. I then dressed the cut with gauze and tape. Yu said that he had been at 36 N. Spanish St. (That One Bar) with some friends and his girlfriend. Yu said that two while males that he did not know grabbed his girlfriend's butt. Yu said that his friend, identified only as Meng Nan, told the two white males to not do that. Yu said that the two males then began attacking Meng Nan. Yu said that he then pushed the two males away from his friend. Yu said that the two males then knocked him to [fie ground and repeatedly punched him in the head. Yu pointed to the left side of his head. i observed some markings and bruising behind his left ear. I took photographs of that injury as well. Yu said that while he was on the ground his hand was cut by broken glass on the ground. Yu said that the two males then ran away while he was still on the ground. I Yu told are that a me" approached him after the attack. Yu said that this man identified himself as the owner of the bar. Yu told me that this man repeatedly told him not to contact law enforcement. Yu said that he then immediately walked to the station to report the attack. We written statement is included in this report. Yu told me that this had occurred approximately 15 minutes ago. Yu told me that his friends that were with him at the bar were too scared to make a statement. Patrolman Eggers (DSN: 306) responded to 36 N. Spanish Si. and spoke with the owner, idantified only as Jeff Koenig, Koenig advised that none of his employees had seen anything and they did not have any video surveillance. At this location I went inside the business for an alcohol compliance investigation. When I walked into the business I observed a short white female with blonde hair standing in a group to my right. She had a fed Solo cup in her hand and a wristband on her wort. The bouncer at the door had told me that the wristbands were given to patrons to show who was at least 21 years in age. The female appeared to be younger than 21 and she was turning away as I began to walk towards her. I made contact with the female and asked her for her ID. She told me that she didn't have it with her, I asked her how she was able to get inside the bar and get a wristband without an ID. She then told me that she did have an ID earlier in the evening and that she had lost it after getting into the bar. I then had the female walk with me to ;he front of the bar so I could get her Identifying information. She identified herself as Tessa Meyer. Arrested Meyer, Tessa Elisabeth No POE Meyer admitted to me that she was only 19 years aid. She told me that she had used a fake ID to enter the bar. I asked her where the ID was now and she told me, that she really had last it after getting into the bar. I asked her what she was drinking out of the red Solo cup. She told me that it was Sprite and vodka. I escorted Meyer out of the bar. i photographed the cup of alcohol and kept a sample for evidence. 1 placed the sample into evidence and sent it to the lab for analysis. Cape Girardeau Police Departure Incident # 14007615 Phone : (573) 335-6621 aPr,YY. .epe INCIDENT NARRAnVt On Thursday, November 13, 2014 Officers of the Cape Girardeau Police Department conducted a series of alcohol compliance checks throughout our jurisdiction. Working with the department was a cooperating minor witness or youth buyer, who was youthful in appearance and complied with the state guidelines regarding alcohol compliance checks. A criminal history check was conducted of the youth buyer and it was established that the youth buyer did not have any criminal record on file. The youth buyer is identified as UC # 111314-01, She is a White Female who is 18 years of age, DOB 07-18-1996. The Cape Girardeau Police Department conducted an age verification of the youth buyer on 09-22-2014 and the average age provided by ten (10) random citizens was 17.1. The youth was trained on and briefed to carry and present when asked for, their true identification, and not to make any false or misleading statements concerning their age, nor to remain silent when asked questions about their age. The youth was further instructed to enter the establishment and proceed immediately to attempt to purchase intoxicating liquor utilizing the purchase money provided by the police department, T he youth buyer was searched at the police station prior to departure and it was established that the only identification she possessed was her valid Missouri Drivers License. A photograph of the buyer was taken prior to departing the police station. The facts in this case are as follows: At approximately 2220 hours the youth buyer along with myself and Lieutenant Smith #148 arrived at That One Bar located at 36 N Spanish St In Cape Girardeau, Missouri. The youth buyer entered the bar and was met at the door by a security employee who checked her identification and placed a large X on the back side of both of the youth buyers hands to indicate to the bartender or other employees that she was under the age of 21. 1 not only observed the X marks but also photographed them and placed a copy of the photograph into evidence. The youth buyer then made her way to the bar where she ordered and received a Bud Light beer. She says the bartender did not check or identification nor did she look at her hands. She then attempted to enter a bathroom in an effort to pour a sample of the beer into a container that I provided to her but was told by an employee that she could not lake alcohol into the bathroom. The youth buyer then concealed herself behind other patrons and poured the alcohol into the container that I provided to her and exited the bar at which point she provided the container to me. It was later placed into evidence with a lab request along with a copy of a picture of it. The youth buyer stated that the alcohol was purchased from a white female wearing big glasses and a plaid shirt. She estimated her age to be 25 years old and described her build as thin and her hair color to be brown. I along with Lt Smith then entered the bar and made contact with a subject matching the description provided by the youth buyer. While completing a summons for Alisa the youth buyer was able to positively identify her (Alisa) as the person that sold her the alcohol inside the bar. Alisa was issued a citation (#130438033) for Supplying Alcohol to a Minor 5-4 and given a court date of 12116/2014 at 0900. In addition, the youth buyer completed a minor report form detailing the specifics of the transaction and it was placed in the buyers file along with a photocopy of their valid identification. An information and consent document and a list of the establishments visited noting the date, time and outcome of the check, are on file. I Cleared by arrest.
