Items for Review Review of appeal of revocation of Retail Liquor by the Drink and Sunday Sales License for Whiskey Business, LLC, d/b/a Last Call, located at 632 Broadway, Cape Girardeau, Missouri. Mr. Cooper stated that he graduated with Mr. Huskey and knows him but has had no contact with him regarding the details of this proposed revocation. Chief Review Officer Lori Meyer called for Applicant Comment. Mr. Welker, attorney for Whiskey Business, stated that Last Call received the revocation notice on March 8 and has not conducted any business since that date. He reviewed the details of the violations which occurred on August 26, 2017, and February 11, 23 and 24, 2018, referenced in the Revocation Notice. Since August 26, 2017, Mr. Huskey, the I iminr IirtP.n,P. Reviam, Rnsrd 1 Marnh 1q 2018 CITY Of CAPE GIRARDEAU Manager of the bar, implemented a protocol to collect all counterfeit identification cards presented for admittance to the bar and turn them into the Cape Girardeau Police Department. Mr. Welker stated that defense of prosecution for sale of alcohol to a minor is that if liquor is sold to a minor exhibited to be 21, and the bar representative is given a fake ID and he believed the individual to be 21, then he cannot be prosecuted. Mr. Welker ask the Board to use that same standard of prosecution and dismiss all the incidents cited in the Revocation Notice. He continued by reviewing the steps and training the bar owner has taken to identify fake ID cards, and what the bar has done to be good stewards to the community and cooperate with the Police Department. It was his opinion that the issue of minors in possession will not be solved if this revocation is upheld. Mr. Cooper questioned the number of IDs turned over to the Police Department by Last Call, what percentage of IDs presented are fake, the number of customers at the bar when Southeast is in session, the patron to staff ratio, and numerous other questions. Mr. Welker, Mr. Huskey, and Mr. Schloss responded to all questions and reviewed their business practices to prevent patrons under 21 from entering the bar. Mr. Huskey further explained that with new technology, even scanner systems may not be able to detect a fake identification card, and he has provided additional staff training on recognizing fake IDs. Mr. Cooper also questioned why no violations occurred at this location until approximately 2012. Mr. Schloss responded that this is the first bar he has ever owned, and he noticed a difference in the crowd when Slingers on North Sprigg Street closed. Prosecuting Attorney Greg Young continued that liquor enforcement was previously handled by State Liquor Control. Due to budget cuts the liquor agents were removed from the Southeast Missouri area, and the city picked up the enforcement responsibility. Since that time, there have been more documented incidents. Chief Review Officer Lori Meyer called for Staff Comment. Lt. Brad Smith appeared and stated that Mr. Huskey keeps the Police Department informed on what is going on at the bar. Lt. Smith expressed concern with the technology to create fake IDs and the inability to distinguish a real ID from counterfeit. ID scanners utilize the magnetic strip on the back of an ID, and technology has provided for the ability to change these strips. One bar in the city uses ID scanners but still requires 2 forms of identification for admittance to the establishment. He and Corporal Richard Couch have spoken to university students, sororities and fraternities on what happens to them personally if they receive a citation for underage drinking or minor in possession. They have worked with the University Judicial Review Board and with the Department of Public Safety. Upon questioning by Mrs. Meyer, Lt. Smith stated that.it is the responsibility of the employees at the door of the establishment to carefully review all IDs and allow admittance. Sometimes the staff are quick to review IDs if they are overwhelmed with the volume of people trying to get in or may have improper lighting to view the IDs. Lt. Smith continued that the IDs presented at Last Call on 2/23 and 2/24 were obviously counterfeit due to the coloring and the photo not being properly centered. He did state with the new technology, it is difficult to identify counterfeit identification cards. Mr. Cook questioned if there was anything else Last Call could do to prevent underage admittance. Lt. Smith stated I iminr I irwnaa RaviPw Rnnrd 9 Mnrrh 1B 901A CITY of CAPE GIRARDEAU that Mr. Huskey is reporting any issues and providing fake IDs to the Police Department to use for training, many of which are hard to pick out as counterfeit. The Board reviewed and discussed the information provided. Chief Review Officer Lori Meyer called upon the Board to make a decision. A Motion was made by Cooper, Seconded by Cook, to deny the revocation and allow Last Call to remain open. Following discussion, the motion passed. 3-0. Ayes: Cook, Cooper and Meyer. Meeting Adjournment There being no further business, the meeting ended at 4:45 p.m. A Motion was made by Cooper, Seconded by Meyer, to adjourn. Motion passed. 3-0. Ayes: Cook, Cooper and Meyer. It should be noted there have been previous complaints of underage drinking occurring at Last Call. It should be noted Patrolman Steiner, DSN 303, was also with me while conducting the walk through. Upon entering the outside patio area of Last Call, I immediately observed a young female look at me and the attempt to hide behind a white male. The female appeared to be under the age of 21. The female and male then walked away from the area Patrolman Steiner and I were, to another area of the patio. While there the female was still attempting to hide behind the male. Patrolman Steiner and I walked over to where the female and male were and identified ourselves as Police Officers. While speaking with the male and female, two other white, young females attempted to quickly walk away. I informed both of the females to stop, which one did; however, the other one attempted to go inside the interior of Last Call, Patrolman Steiner was able to catch up to the female that attempted to make entry and escorted her back to my location. I then asked for identification from all individuals, to which all said they did not have identification. All individuals were then escorted out of Last Call. All Individuals were identified as: ARRESTED: Beauchaine, Aylssa L POE; SEMO Student Phone Number: 636-465-5981 Appleton, Joseph T Jr, POE: SEMO Student Phone Number: 314-315.1521 McCoy, Regan E POE: SEMO Student Phone Number: 618-980-9100 Willham, Kourtney Marie POE: SEMO Student Phone Number: 217-652-6090 McCoy, Willham, and Beauchaine both had large styrofoam cups in their hand. Upon smelling McCoy's and VVlllham's drink, Patrolman Steiner and I both detected the odor of Intoxicants. Beauchaine cup was determined to have water inside of it. McCoy and Wi[lham both admitted their drinks contained alcohol. McCoy stated her drink was called "Fuck My Face" and Willham's was called "Sex on the Beach." Wiliham and McCoy were unable to provide any identification. Willham and McCoy both stated they entered Last Call with members of the Sig Tau Fraternity, and that when they come with Sig Taus, to. Last Call, they are not asked for identification, as the bouncers are friends with the Sig Taus. Willham's and McCoy's information they provided was checked and they were both found to be 46 years old. 0 then spoke with Baauohaino and Appleton, again asked for identification at which time Appleton provided a Missouri I.D., which was valid and showed him to be 18 years old Beauchaine also provided --- - y JY - -- — Printed: 03/30/2018 4:55:29 AM Narrative Page S or 3 --' - incident Page 3 of 5 INCIDENT DETAIL REPORT LIQUOR LAWS POSSESSION OF INTOXICANTS Agency: CAPE GIRARDEAU POLICE DEPARTMO Incident 9: 16001729 Phone :t6731336-6621 Address: 2639 MARIA LOUISE, CAPE GIRARDEAU MO 63701 a Missouri I. D, which checked valid and showed her to be 18 years old, I then asked Appleton for his wallet and upon searching his wallet I located an Illinois I.D. The LD, appeared to be counterfeit as the texture did not feel like a normal Illinois I,D. The color scheme and picture of the I'D, also appeared to fraudulent, as some of the picture was covered. Appleton's last name was also spelled: Appelton and the DOB shown made him 21 years old. I then asked Beauchaine for her wallet that she was carrying, Upon searching Beauchaine's wallet I located two Florida I.D. cards. Both of the Florida cards had Beauchaine's picture and name; however, it showed her to be 21 years old, Both Beauchaine and acknowledged the I. D. card were fraudulent and that she ordered them online. Both Appleton and Beauchaine appeared to be intoxicated. I asked both had much alcohol they had consumed. Appleton stated he had approximately five beers and Beauchaine was unsure. It should be noted Beauchaine's speech was very slurred. At times Beauchaine would be come argumentative and would state that It was unfair that she was in trouble, but not everyone else, Both Appleton and Beauchaine provided Preliminary Breath Samples (PBT), which was positive for alcohol. Both admitted they were intoxicated. Appleton's and Beauchalne's fraudulent I. D. cards were seized and will be entered into evidence. Willham's drink was collected by Patrolman Steiner, see supplement. I collected McCoy's drink, which will be entered Into evidence and sent to the Missouri State Highway Patrol Crime Lab, for further analysis. Witham and McCoy did not appear to be visibly Intoxicated and were released on scene with citations. Due to Appleton's and Beauchaine's level of intoxication they were released on scene to a sober party and were issued citations. It should be noted Willham was issued a citation by Patrolman Steiner. Potts, DSN: 321, conducted a walkthrough of Last Call located at 632 Broadway. It should be noted this business has had recent complaints of underage drinking at the bar. I, along with Ptlm. Gerald Neels, DSN: R48, entered the bar and responded to the rear dance floor area. At this time, I observed an individual look at me, look down, and attempt to stand behind another subject In an attempt to conceal themselves. I then made contact with both individuals who looked young and did not appear to be 21 years of age. I asked the subjects if they had identification on their persons to which they stated they did not. I asked the subjects if they were under 21 to which they both stated yes. The subjects were then escorted out of the business and identified as: ARRESTED: OTHER: HENNINGSEN, Hayden B PH: 515-556-9317 POE: Student/Southeast Missouri State University SNEED, Sydney M PH:636-542.1368 POE: Student/Southeast Missouri State University It should be noted prior to escorting Henningsen out of the bar, he had a white Styrofoam cup which is what the drinks commonly are served In at Last Call I took the cup from Henningsen and asked what it contained to which he stated it was rum and Coke. I then smelled the cup and detected the strong odor of an Intoxicating beverage emanating from within the cup which appeared to be consistent with his statement. I confiscated the liquid which will be placed Into evidence and submitted to the Crime Lab for analysis. I then conducted a search incident to arrest on Henningsen and located his wallet which contained two Missouri identifications. One of the IDs showed Henningsen's DOB of 1996 and the other showed his DOB of 1998. I asked Henningsen and Sneed how they were able to make entry into Last Call to which they stated they use their underage ID and put $5 underneath it when they provide it to the bouncer. Henningsen and Sneed stated the bouncer doesn't look at the ID but accepts the money and allows them to enter the business. Henningsen and Sneed were both adamant they do not need to use the fraudulent ID to enter the business due to how easy it is to make entry. Sneed stated she has entered Last Call multiple times using the method of providing the bouncer with $5.OD.
