I, along with Officers Bennett and Brotz arrived at this location, We made contact with the bar manager, Corey Huskey, and I Informed him of the complaint in which we received. Huskey was very welcoming. We informed him that we would be walking through the business and checking the identifications of any one we suspected of being under age. It should be noted that the door man of the business handed us a stack of suspected fake identification cards that he had previously seized from patrons who wanted to gain entry into the bar. Those identifications were eventually given to Lt. Brad Smith for training purposes. We began walking through the patio area of the bar. I checked one Identification of a youthful looking female who was determined to be 22 years of age. I then entered into the building where I stood in the bar area. She continued walking. I again tapped her on the shoulder and began saying, "ma'am, ma'am". She continued walking up the stairs with a drink in her hand toward the exit. I then grabbed her right upper arm and she turned around and faced me. She then handed her drink off to a second youthful looking female that was walking up the stairs in front of her. The second female I also instructed to come with me, she then sat their drinks down on the Floor. I Instructed both females to go back down the stairs and wait for me while I secured the evidence. Stephen stated the "bouncer" would look at his ID but not really examine it. Stephen stated he and Noah were also at Last Call last night and used the same IDs to get inside. COMMENTS, DISCUSSION & VOTING Review of appeal of suspension of liquor license for Whiskey Business LLC, d/b/a Last Call, 632 Broadway, Cape Girardeau, Missouri a. Ms. Meyer called for Applicant Comment. Mr. Tim Schloss, 9916 Winkle Road, St. Louis MO 63128, owner of Last Call appeared, presented a background of the business, and discussed the recent incidents that occurred at his bar. He reviewed improvements completed to prevent repeated occurrences and to prevent underage people from entering the bar, including improving staffing levels, training of staff, and installing cameras. He indicated he met with the Police Chief and staff in October of 2013 and February 2014 and has reached out to the Mayor and City Manager regarding issues that occurred at his establishment and how to be proactive to prevent them in the future. He continued that he has been hosting many philanthropic fundraiser events and intends to continue. Mr. Cory Huskey, General Manager of Last Call, also appeared. He indicated that he was not aware of the public urination incident referenced in the police Liquor License Review Board 1 March 26, 2015 CITY Of CAPE GIRARDEAU reports that occurred in the parking lot until he received the suspension notice. Videos of the premise are kept for 28 days, but the incident had occurred beyond that time frame. In addition, a residential unit that is rented to college students adjoins the Last Call building and shares the parking lot, and some of the incidents in the lot could be coming from this location. He reviewed the other events that occurred at the bar referenced in the police reports and discussed changes that have been made to prevent these from occurring in the future. Mr. Huskey stated he felt that he had proper security and training in place, but one of the bouncers did not act appropriately and is no longer employed. In addition, when a fake ID ring was occurring in the city, Mr. Huskey stated he turned over many fake IDs to the Police Department to assist them in its investigation. Unfortunately, with current technology, fake IDs are looking too real and are difficult to identify. b. Ms. Meyer called for City Staff Comment. Lt. Bradley Smith, Cape Girardeau Police Special Operations Bureau, appeared and reviewed the incidents that had occurred at Last Call, 632 Broadway, on February 6 and February 13. He stated that Last Call is about the only bar in the City that is age 21 and up. Mr. Wagoner questioned the evidence presented in the Police Report regarding the public urination incident, and he requested the disposition of the citations issued. Lt. Smith stated that when the violator was taken into custody, he refused a breath test, and the arresting officer witnessed slurred speech and other signs of intoxication. d. The Board reviewed and discussed the information provided. Ms. Meyer thanked the owner and manager for appearing before the Board. She indicated the board must determine whether to uphold the recommended 10 -day suspension. Ms. Meyer made a motion to support the City Manager's recommendation for a 10 -day liquor license suspension for Last Call. The motion failed for lack of a second. Mr. Wagoner indicated that he did not support the 10 -day suspension but would be agreeable to a 3 to 4 day suspension. Mr. Cook stated he could be comfortable with a shorter duration of suspension as the business has worked to make improvements. Following additional discussion by the board, a Motion was made by Mr. Cook, seconded by Mr. Wagoner, to amend the City Manager's recommended suspension and reduce it to a five-day suspension of the Liquor License for Whiskey Business, LLC, d/b/a Last Call, 632 Broadway, Cape Girardeau, Missouri. The motion was approved 3-0 upon the following vote: Ayes, Cook, Meyer, Wagoner. Nays, none. Mr. Schloss thanked the board for their consideration and requested that the suspension be arranged around already -established charitable events to be held at the bar on April 9, 17, 25, and May 1. City Attorney Eric Cunningham stated that the City Liquor License Review Board 2 March 26, 2015 CITY Of CAPE GIRARDEAU Manager will determine the dates of the suspension, and a letter will be sent to the owner and manager with the dates of the suspension. Ad'ourn A Motion was made by Mr. Wagoner, seconded by Mr. Cook, to adjourn. The motion was approved 3-0 upon the following vote: Ayes, Cook, Meyer, and Wagoner. Nays, none. RIfTIMI MAP fi MA Gayle Conrad, We would like to dispute the suspension of the liquor license of Whiskey Business d/b/a Last Call. We feel as though the severity and timing of the suspension are too severe and that several of the instances mentioned in the suspension were not issues that we could have prevented. We have always worked to hold our business in the highest regard including working with the city and the Cape Girardeau Police Department and plan to continue to maintain those relationships, but we do not feel we deserve the level of suspension that was handed down. I exited my patrol vehicle as the black male continued to urinate, with both hands located In front of his person near his wasitline, in full v ew of the public and approached the black male. I Identified myself as a police officer and inquired with the individual what he was doing. The subject stated he was playing with his phone, It should be noted before the Individual could move his hands from his waistline, I placed his hands behind his back and placed him Into handcuffs. His phone was later located In his right pants pocket, clearly showing at no point during my contact with him was he utilizing his cell phone device. I escorted the Individual to my patrol vehicle, which was a short distance away and conducted a cursory search of his person, removing his wallet containing his Missouri state issued identification card from his right rear pants pocket. The individual was then identified as Damon Washington. ARRESTED Washington Damon Ahmad If BIM DOB Washington was visibly intoxicated as demonstrated by his slurred speech, watery and blood shot eyes, Incoherent speech, and his Inability to answer simple questions and obey basic commands. It should be noted Washington admitted to consuming 1 (one) beer while at Last Call. Washington further indicated he was only twenty (20) years old. Washington was placed Into my patrol vehicle and subsequently transported to police head quarters where he was booked and processed accordingly. During the booking process, Washington was Informed of his charges and asked If he would submit to a chemical analysis of his breath in order to determine his level of intoxication (blood alcohol concentration). Washington refused this analysis. Continuing with the booking process, I Informed Washington of his citations and respective court date and time. Washington continued to inquire an exorbitant amount of times what he was being charged with, and each fine was read his citation narrative and corresponding court date and time. Washington never seamed to grasp the basic information of the citation and refused to sign the citations as he was fearful signing the citations would mean he was "signing his life away..".It was explained to Washington multiple limes in'no way would signing the citations mean he was signing his life away, only that it was his promise to show up to court and was therefore not an admission of guilt to the charges being brought against him. Washington -verbally stated he would show up to court, however continued his defiance in signing the citations. It was again explained to Washington the citations were not an admission of guilt, but were his promise to show up to court. Washington refused to sign the citations yet again and was then placed in a holding cell as a result of not having a sober party to release him to, was issued the following citations. printed; 02/06/2015 3:20:04 AIA Narrntive Page 1 of 2 rnddent Page 2 or 3 INCIDENT DETAIL REPORT INDECEN7EXPOSURE Agency: Cape Girardeau Police Departing - Incident p: 15000629 Phone: (571) 335.6621 Address! 40 5 Sprlaa, Cape Girardeau M0 63703 SUMMONS 130440688 5-12, Minor in possession of alcohol Court Date: 03-10-2015 CourtTme; 0900 hours 130440689 17-10, indecent Exposure Court Date: 03-10-2015 Court Time: 0900 hours A request has been submitted for booking room video for this incident. I along with Lt. Smith DSN 148 and Plim. Kidd DSN 249 responded to the area and began to do identification spot checks. It should be noted that while attempting to enter the establishment a subject that Identified himself " Kenny" an employee working the door, refused to allow us to enter stepping In rhe gate threshold, when told of the complaint of underage drinking. "Kenny" fudher stated that we would need search warrant to enter the establishment. After an explanation of the rules governing business laws "Kenny" removed himself f from the threshold and permitted myself and Lt. At this point the subject removed one Missouri Driver's license with an Ullnols driver's license underneath from his wallet. 1 could clearly observe that the Missouri driver's license had 'void' stamped thought It. From my training and experience, I knew this was a common means of false Identification. The Individual quickly attempted to conceal the Missouri driver's license back Into his wallet. I collected both drivers' Ilcense from the subject. The Missouri Dover's license had the name Cody Schonlau with a date of birth of 04-13-1993. The photo on the Missouri drivers license was clearly not the subject I was speaking to. The Illinois driver's license clearly had a photograph of the subject I was speaking with. According to Ptlm. Smelser, both subjects then went to 917 Bellevue, where the sexual assault reportedly took place. Ptlm. Smelser responded to 917 Bellevue, but was unable to make contact with anyone at the residence. He advised that he had received information the victim and suspect had entered the following vehicle: VEHICLE YEAR: 2006 MAKE: GMC MODEL: SIERRA COLOR: ORANGE MO LICENSE: 1 WP929 EXPIRED: 11/2012 Ptlm. Smelser advised the license plate was currently expired. He believed the owner of the vehicle resides at 917 Bellevue. At approximately 1615 hours, I observed the above vehicle traveling east on Bellevue. I initiated a traffic stop, and the vehicle pulled onto the private lot of 917 Bellevue. I made contact with the driver/sole occupant of the vehicle, who was identified as: DRIVER/ARRESTED GABBARD, Brandon Douglas W/M DOB: Elmo SSN: VMMEMMM (LOCALADDRESS) 917 BELLEVUE CAPE GIRARDEAU, MO (PERMANENT ADDRESS) 9220 NORTH 87TH AVE. PEORIA, AZ 85345 I advised Gabbard his license plate was expired. He said he was not aware the plates were expired, saying he -thought he renewed them. A check with Communications confirmed his license plates had expired in November, 2012. While issuing the citation, I asked Gabbard if he was the only person who drives this vehicle, to which he stated that he was. I then asked him if he had been driving the vehicle last night (January 25, 2013). He stated that he was not driving it last night. He further explained that sometimes his roommates operate his vehicle. I asked him which roommate was driving the vehicle last night (January 25, 2013), but Gabbard stated that he did not know, saying that he had left the keys out inside of the residence and was not aware of who may have driven it the previous evening. He claimed he "walked" by himself to the Last Call Bar, 632 Broadway, where he met up with the recruits. I advised him that I received information an assault had occurred at his residence that evening. Gabbard replied that he was not aware any assault had taken place. Gabbard was issued the following citation: CITATION JURISDICTION: Cape Girardeau Municipal UC #120688316 CHARGE: Unlicensed Vehicle ORDINANCE: 26-335 COURT DATE: 02-28-13 at 0900 hours Gabbard signed the above citation and was released. I obtained information the "recruits" would be at Port Cape, 19 North Water Street, at 1900 hours and advised Ptlm. Smelser. Later on Saturday, January 26, 2013, 1 was advised by Ptlm. Smelser he located the suspect in the sexual assault at Port Cape. The suspect was identified as the following: SUSPECT BUCE, Reed K Scott W/M DOB: SSN: 14109 NORTH 83RD AVE APT 129 PEORIA, AZ 85381 It should be noted this is the same city that Gabbard was from in Arizona. According to Ptlm. Smelser, Buce admitted to going to the Last Call Bar with Gabbard and other SEMO Redhawks Football players and recruits. Buce told Ptlm. Smelser that he had been given alcoholic drinks, purchased by other football players, at the Last Call Bar and consumed the drinks inside of the bar. These drinks included "Long Island Teas" and "shots" of liquor. It should be noted that BUCe is 18 years of age. Furthermore, he advised Ptlm. Smelser that Gabbard had driven him to the Last Call Bar and then drove him back to 917 Bellevue with the victim. On Sunday, January 27, 2013, at 0911 hours, I attempted to reach Gabbard through his provided phone number, which was listed on the above citation. Gabbard did not answer at that time, therefore I left him a message, stating that I needed to speak with him regarding the false information he had provided me the day before. Gabbard responded to 40 South Sprigg, Police Headquarters. At 1014 hours, I advised Gabbard of his Constitutional Rights (Miranda Warning). Gabbard stated that he understood his rights and signed CGPD Form 23, agreeing to speak to me without an attorney present. He stated that he was "scared" and should not have lied. Gabbard admitted he had taken a recruit, who he only knew as "Reed", to the Last Call bar on Friday, January 25, 2013, at approximately 2200 hours. Gabbard stated they went to the bar with several subjects that were on or associated with the SEMO Redhawks Football team. Gabbard said that none of the subjects had their identification checked when they entered the bar. Gabbard admitted that he purchased "Long Island Iced Tea" for "Reed" at the Last Call. It should be noted these drinks were alcoholic beverages. I asked Gabbard if he was aware of how old "Reed" was, to which he responded that he did not know exactly how old he was, but knew that he was under 21 years of age. I then asked him if he was aware that was illegal. Gabbard admitted that he was aware; furthermore, he claimed that he was a criminal justice major at SEMO. Gabbard explained to me that it was common practice to purchase alcoholic beverages for potential recruits to the football team. Gabbard stated that he had observed "Reed" "dancing" and "kissing" or "making out" with a white female, while they were at the Last Call Bar. Gabbard advised they arrived around 2200 hours. About an hour later, "Reed" reportedly met the female. Gabbard said they stayed at the Last Call until closing time (approximately 0130 hours). Gabbard advised "Reed" and the female were consuming intoxicating beverages at the bar, some of which he provided. He believed both subjects may have been intoxicated. When it was time to leave, Gabbard stated he entered his vehicle, with several more subjects getting inside the cab of the truck and the back. Gabbard said he transported all of the subjects back to 917 Bellevue, including "Reed" and the white female subject from the bar. Gabbard stated he did not know the female subject's name, but advised that she was accompanied by several of her friends. Gabbard said that upon entering 917 Bellevue, "Reed" and the female immediately went into an unoccupied room and shut the door. Gabbard stated he later knocked on the door and tried the door handle, but it was locked. He said he was told by the female's friends to "leave them alone". According to Gabbard, "Reed" exited the room approximately 45 minutes to 1 hour later. Gabbard stated "Reed" told him and another recruit he could only identify as "Greg", that he (Reed) had "sex" and had "hooked up" with the girl. Gabbard stated he did not see the female after she had entered the room, and did not know when she left. Gabbard stated he then took "Greg" and "Reed" back to the Drury Lodge, where they were staying. See Ptlm. Smelser's report, #13000736, for further details regarding the assault. Because Gabbard admitted to purchasing alcoholic beverages for an 18 year old subject, and Buse admitted to consuming the beverages, I issued Gabbard the following citation: CITATION JURISDICTION: Cape Girardeau Municipal UC #100289564 CHARGE: Supplying Liquor to a Minor ORDINANCE: 5-4 COURT DATE: 02-26-13 at 0900 hours This case is cleared by arrest. He says he was told that a member of the SEMO football team was standing on the roof of his car and caused several dents by doing so. He mentioned that a witness that observed the incident told him the suspect's name is Eric and that he is a freshman at SEMO and went to high school at Parkway Central High School. Nathan mentioned that the witness wished to remain anonymous but that if a statement was needed he would identify himself and provide a statement. I observed several shoe prints on the vehicle listed in this report with some on the trunk lid, several on the roof, and several more on the hood of the vehicle. The roof was also dented in. Patrolman McDonald DSN 276 took photographs of the damage and shoe prints which appeared to be in a Criss cross pattern. Upon arrival I made contact with: VICTIM SIEMERS, Jonathan Tyler WM 1431 Cnty Rd 208 Cape Girardeau, MO 63701 smonom SUSPECT SIEMERS, Jared Andrew WM low GNMEW 1431 Cnty Rd 208 Cape Girardeau, MO 63701 SWUM Jonathan was in room 6 and was receiving treatment for a out under his left eye. i asked Jonathan what had happened and he said that he had gotten Into a fight with his brother Jared at Last Call (632 Broadway) at approximately 0100 hours, Jonathan said that he and Jared were yelling at each other then he threw his drink on Jared. Jonathan said Jared threw his drink at him and the next thing he knew he was on the ground. Jonathan said that he did not know if his face got cut when Jared hit him or when he fell on the ground. Jonathan said several times that he did not want to make a report or pursue any charges on his brother. Jonathan was very cooperative despite not wanting to make a report. Jonathan had a large cut under his left eye and a split lip. I spoke with Jared, who was in the ER waiting room. Jared's shirt was torn on the back shoulder and there was a large spot of blood on the front, I asked Jared what happened and his version was similar to Jonathan's. Jared said that they had been yelling at each other and Jonathan threw his drink on him. Jared sold that he threw his drink at Jonathan, then Jonathan tried to swing and hit him. Jared said that Jonathan's punch glanced off the back of his head, then he swung and hit Jonathan In the face. Jared said that he then put his brother In a headlock and took him down to the ground, trying to get him to calm down. Jared said that he was holding Jonathan's head against his shirt and that is how it got blood on it. Both Jonathan and Jared said that they have always fought and believe it's more pronounced because they are twins. I made contact with both Hartmann and Gilbert. As I approached the two Gilbert attempted to stand up multiple times without success. Hartmann then assisted Gilbert and Gilbert was able to stand for a few seconds before she again fell to the ground. Gilbert appeared to be under the influence of intoxicants. She smelled of an intoxicating beverage and also was unable to speak clearly as her speech was very slurred. Hartmann repeatedly stated "We're Just trying to get a ride home. We're trying to be responsible. I can take care of her (Gilbert)." Hartmann also appeared to be under the influence of intoxicants as she was also speaking with slurred speech. Hartmann also stated she had consumed "a few. drinks" prior to her contact with police. Both Hartmann and Gilbert were taken into custody and transported to police headquarters.
