Introduction and Opening Comments: Mrs. Brooks introduced the members of the Liquor License Review Board and explained the rules of order for addressing the Board. Public Comments: Mrs. Brooks opened the meeting to hear public comments regarding the liquor license renewal application of Cape Mart, 238 North Fountain Street: Mr. Brian Langlois, owner of the Bellevue Bed and Breakfast at 312 Bellevue Street, addressed the Board to appeal the license renewal. He said that Cape Mart denigrated the character of the neighborhood. He said that the store previously at that location had sold a minute quantity of specialty liquor and that Cape Mart has become a full-blown liquor store that sold cheap alcohol and trashed the neighborhood. Mr. Langlois complained of noise and trash associated with the store. He said that his Bed and Breakfast hosted guests from all over the Country, and from all over the world, and his guests are surprised to see a liquor store so close to his business. Mr. Langlois said that Cape Mart opened under false pretenses and told untruths about the amount of alcohol that would be offered for sale. He said that the store greatly affects the psychology of the neighborhood. The`liquor license renewal should be brought before the entire City Council, he said. Every Councilmember should look them in the eye and explain why this liquor license is not denied. Mr. Larry Stroder, of 241 North Fountain Street, appeared to appeal the liquor license renewal of Cape Mart. He said that he picks up trash from his property every day. He said that he has lived there for 23 years and his property values have dropped. Mr. Stroder said that he has lost everything he has worked for. He said that there are drug deals in the street. He said that he calls the police, and nothing is done. He said that he would appreciate the City's help to get this straightened out. Mrs. Becky Mocherman, of 220 North Lorimier, addressed the Board to appeal the renewal of Cape Mart's liquor license. She said that she has a beautiful home and garden that has been featured on home D ya Y u Nxa ah B$.L 401 Independence Cape Girardeau, MO 63703 573-339-6320 Tel 573-339-6302 Fax https://www.cityofcapegirardeau.org/CityHaII/Liquor-License-Review-Board.aspx CITY Ot CAPE GIRARDEAU tours. She said that Cape Mart is denigrating the neighborhood. Mrs. Mocherman read an article from a St. Louis -area newspaper to the Board. She said that the article detailed a liquor license that was denied because it would not benefit the neighborhood, the only benefit would be to the business itself. Mr. Dennis Seyer, of 320 Bellevue Street, addressed the Board to appeal the liquor license renewal. He said that he has lived there for 33 years and now he finds trash in his yard. He said that once he found a hypodermic needle. Mr. Seyer said that the neighborhood was built in 1900 and this store has changed the whole environment of the neighborhood. Mr. Lyman Pitman, of 315 Bellevue Street, appeared to appeal the liquor license renewal. He said that it has been his lifetime dream to own an historic home and everything has changed since Cape Mart opened. He said that the City has invested a tremendous amount of money to improve the Broadway corridor, making the area user friendly for pedestrians, and user friendly as a downtown destination. Mr. Pitman said the City should create a consistent policy about the future direction of development for the Broadway corridor. Mr. David White addressed the Board in support of Cape Mart's liquor license renewal. He said that he lived on the corner of Lorimier and Bellevue Streets' and he has been a regular customer' of Mr. Shah Faisal, owner of Cape Mart, since before his business moved to Fountain Street. He said that denying the liquor license renewal would be unfair to the business owner and place him at a competitive disadvantage. He said that Mr. Faisal would have his employees and customers pick up the trash around his business. Mr. Rick Hetzel addressed the Board to appeal the renewal of Cape Mart's liquor license. He said that he owned property at 3107 Kage Road and 316 Bellevue Street, Mr. Hetzel said that he is familiar with the impact a liquor store has on a neighborhood and he said the Board should look closely at the number of incidents and criminal complaints in the area since the store opened. Mr. Wagoner asked if Cape Mart customers stay around the area after the store closes. He suggested signs reading "no loud noise" and "no congregating" like those found outside a local McDonalds store. He asked if any of the neighbors appealing the liquor license renewal had addressed their complaints directly to the owner of the business. Mr. Hetzel said that he had complained to Mr. Faisal about trash around the business and that the litter was picked up. He asked if anyone had explained to the neighborhood what a liquor license holder's responsibilities were. He read several provisions of a liquor license holder's responsibilities from Sec. 5-34 of the Cape Girardeau Municipal Code. He read aloud from the City Code regarding liquor licenses. Mr. Statler said that the applicant has complied with the requirements for the license renewal. He cited the inspection reports and approvals noted on the liquor license renewal application. He said that the Board cannot deny the renewal of Cape Mart's liquor license because of its patrons. Mr. Statler said that the applicant has complied with the conditions and requirements of the license renewal and the City has complied with its responsibilities. He said that the applicant has done everything correct and the license should be renewed. Board review, discussion, and possible action regarding renewal application and appeal letters for Cape Mart, 238 North Fountain Street, Cape Girardeau: There being no further comments from the applicant, Mrs. Brooks opened the meeting for review and discussion by the members of the Liquor License Review Board: Mrs. Brooks said that the Board asked Lt. Barry Hovis to represent the Cape Girardeau Police Department and answer questions about reports and calls associated with Cape Mart. Mrs, Trisha Holloway is present to offer historical perspective of the liquor license. Lt. Hovis said that he had brought police reports of complaints and calls to the applicant's address, 238 North Fountain Street. Mr. Young asked if the Board could be given copies of the reports. Mrs. Brooks said that she had not asked Lt. Hovis for copies of the police reports to be given to the Board members prior to the meeting because she did not want to prejudice the Board. Mr. Young asked if the Board could be given properly redacted copies of the reports Lt. Hovis was citing. Mr. Wagoner asked how many reports were associated with the address. The meeting paused as it was noted that the severe weather sirens could be heard. Mrs. Brooks asked the Board, observers, and the applicant if everyone felt comfortable proceeding with the meeting. With their confirmation, the meeting continued. Mr. Wagoner said that he felt sympathy for both sides of this issue, the business owner and the neighborhood residents, however, the Board must consider the law. He said that he saw no indication of a complaint made about Cape Mart since February. Mr. Wagoner asked if anyone present could offer proof of his or her complaints, like photographs or video. Mrs. Brooks asked what criteria the Police Department used to approve the liquor license application. Lt. Hovis said that there were six cases and calls where a police report was not generated. When he and retired Police Chief Carl Kinnison had reviewed the complaints and calls associated with Cape Mart, he said that they saw nothing that they thought should disallow Cape Mart's liquor license renewal. The Board considered whether they should delay further discussion until they have had an opportunity to review information regarding police reports and calls. Mr. Wagoner asked if the public would be given another opportunity to offer comments. Mrs. Brooks answered that public comment was not required. Mr. Young asked how many reports and calls would be included. Lt. Hovis said he had six or seven more to review. The Board decided to hear Lt. Hovis give a brief summary of each. Hovis gave a short description of eight calls: public urination; newspaper theft; theft of alcohol; report of a fight; loud music; an open container violation; and two incidents where the store was a victim of robbery, both solved with arrests. Mr. Wagoner asked who could make a complaint to police. Lt. Hovis answered that anyone can call in a complaint and the police will respond. He said that he did not have information regarding additional calls from the surrounding area that did not result in a report. Mrs. Brooks asked if Lt. Hovis reviews all liquor license applications and what he could offer in light of seeing so many applications. Lt. Hovis answered that he reviews all liquor license applications and said that he did not see a marked increase in calls to this location, as compared to other applicants. Lt. Hovis said that the Police Department assigned personnel to cover the area and the neighborhood. Mrs. Brooks asked about compliance checks conducted. Lt. Hovis said that compliance checks had been conducted for sale of alcohol to minors and Sunday sales, with no sale on either count. Police had conducted 8 surveillances to look for violations. Of 8 surveillances, only 2 resulted in citations. Mr. Wagoner asked if the federal tax stamp or County liquor license were checked on a liquor license application. Lt. Hovis said that he checks only for City Ordinance violations. Lt. Hovis asked if the Board still wanted copies of the police reports and calls at Cape Mart. Board Members indicated that they did not need to see the copies. Mrs. Brooks asked the Board if they needed more time to consider their decision. Mr. Young said that whatever the Board's decision, he would recommend the business owner work with neighbors to address their concerns. He said the Police Department is doing their part to patrol the neighborhood and dedicated time and resources to control the area. Board Members indicated that they were ready to vote on the issue. Roll Call Vote: Mrs. Brooks noted that a "yes" vote will affirm the renewal of Cape Mart's liquor license, a "no" vote will deny the license renewal. A Motion was made to affirm the renewal of the liquor license of Cape Mart, 238 North Fountain Street: Aye Nay ® ❑ Mrs. Brooks ® ❑ Mr. Wagoner ® ❑ Mr. Young The liquor license renewal is affirmed with a 3-0 vote by the Liquor License Review Board. Box 617 4011ndependence Cape Girardeau, MO 63702 Ms. Holloway: It is with sincere regret and embarrassment that I am writing you this letter. For a number of years my grandparents, parents, and I have operated our convenience stores in Cape Girardeau. I take a lot of pride in our family run business and obviously am not happy with our performance through our Sprigg Street location last year. As per our company policy, anytime an employee it is caught selling to a minor, they lose their job; no questions asked. So, not only am I disappointed in our lack of performance, but also not pleased to have to let three people go. Our past performance has been good, so I am surprised by our three violations last year. We have an extensive training program that we conduct before letting our sales associates go into the stores to train. At our office we have purchased training materials through our national association to train with. These include Techniques of Alcohol Management (TAM) and CAST, which is a Certified Alcohol Sales Training class. In addition, we cover the We Card materials and use these at store level too. Ongoing, we do follow up training at store level with We Card website and have thought about implementing a WE Card month, to which we would designate a month to symbolize as We Card month and we would use the entire month to promote "carding" and the safety of selling alcohol and tobacco products to those of legal age only. I think this is something we need to do and will this year. As in years past, we fully cooperate with the Division of Alcohol and Tobacco. My father was instrumental in establishing the "Badges in Business" when an agent would work in the store and handle a sale underage as an undercover officer. Lack of personnel has caused this to decrease and I cannot recall participating for a number of years. I wish they would bring this back. We enjoy working with local and state law enforcement. With such importance that we place on running a good operation, I am requesting a hearing before the liquor license review board. It is important to me to run a good business in Cape Girardeau and one that has a reputation for being a good operator. I am disappointed by our lack of performance, but can assure you this will improve. I look forward to meeting you, members of your board, and discussing our violations. I appreciate your time in reading this letter. Sincerely R. Working with the department was a cooperating minor witness, who was youthful in appearance and complied with the state guidelines regarding alcohol compliance checks. A criminal history check was conducted of the youth buyer and it was established that the youth buyer did not have any criminal record on file. The witness is identified as UC # 06192012-2 W/M 18 years of age, DOB RIM1994. The Cape Girardeau Police Department conducted an age verification of the youth buyer on 06/19/2012 and the average age provided by twelve (12) random citizens was 17.67 years of age. The youth was trained on and briefed to carry and present when asked for, their true identification, and not to make any false or misleading statements concerning their age, nor to remain silent when asked questions about their age. The youth was further instructed to enter the establishment and proceed immediately to attempt to purchase intoxicating liquor utilizing the pre-recorded purchase money provided by the police department. The youth buyer was searched at the police station prior to departure and it was established that the only identification he possessed was his valid Missouri Driver's License. A photograph of the buyer was taken prior to departing the police station. All transactions were recorded and all evidence seized by the Cape Girardeau police department will be retained until final deposition of the state and municipal violations. The facts in this case are as follows: On 06/19/2012, at approximately 2039 hours the cooperating witness along with Officers Hann #257 and Scheper #284, arrived at Bi -State convenience Store at 612 South Sprigg Street. Prior to sending our youth into the aforementioned business, I activated a video recorder and recorded the date, time and business name. I also provided the youth buyer with the activated recorder and U.S. currency. Moments later the youth buyers entered the business and walked directly to the cooler where alcoholic beverages were contained. The youth buyer obtained one (1) 24 ounce can of Busch Light beer and proceeded to the counter to pay for the item. The clerk, who was observed to be a white female with brown hair pulled back into a ponytail, did not ask to see the youth buyer's identification. The clerk did ask the youth buyer for his date of birth and the youth buyer provided the clerk with his actual date of birth, which is X1994. The clerk sold the alcohol to the youth buyer by requesting $1.89 from the youth buyer for the item. The youth buyer provided the U.S. currency to the clerk and exited the store with the alcohol. I immediately seized the alcohol and secured the recording device upon the youth buyer after he exited the business. The youth buyer described the clerk who sold the alcohol and his description matched the female clerk that I observed supervise the transaction from my vantage point outside the business. I then entered the business of Bi -State and made contact with the clerk, Lisa Michelle Williams. I advised Williams of the offense that I had witnessed and explained that she was responsible for Supplying Alcohol To A Minor. Williams stated, "Yeah, I know I messed up as soon as I sold to that guy." I asked Williams who she was referring to and she stated, "That guy in the blue shirt that just left. He told me his birthday and I sold beer to him before I realized he was actually too young." The facts in this case are as follows: At approximately 2109 hours, the cooperating witness along with Officer Robinson # 278 and myself, Officer Hann, DSN #257 arrived at Mobil Gas Station, located at 612 South Sprigg Street. Officer Hann activated a digital audio recorder and recorded the date, time and business name. Officer Hann provided the youth buyer with the activated recorder and a pre-recorded dollar amount. Moments later the youth buyer entered the store and walked directly to the beer cooler and selected a commercially labeled 24 ounce can of Bud Light brand beer and proceeded to the cash register in an attempt to purchase said alcoholic beverages. I positioned myself directly outside of the main doors in a manner that offered me a clear view of the transaction. The clerk, a young, white male, did not ask for or examine the youth's identification which indicated he was under the age of twenty — one. The clerk also did not ask any questions concerning his age. The clerk completed the sale by ringing up the purchase and requesting the purchase price of the alcohol from the youth buyer. The youth buyer handed the clerk the purchase amount and the clerk returned the change to the buyer. The buyer took his purchase and exited the store and immediately made contact with me to secure the beer and A.V. recording. I then made contact with the clerk, and advised him of the offense. The clerk Stated "Man, that guy just looked old enough and we were busy so I didn't even mess with it." While performing a walk through of the bar I noticed a male subject that appeared to be under the age of twenty one consuming what I believed to be an alcoholic beverage. I approached the subject and I asked him his age. The subject, later identified as August Lock, stated that he was twenty one. I again asked Lock how old he was and he stated that he was nineteen. I asked Lock what he was drinking and he stated a coke. I asked him if there was any alcohol in his drink and he said yes. I asked Lock how many drinks he had consumed and he stated approximately five. Lock had a strong odor of an alcoholic beverage on his breath and he swayed,,*Sze stood. R p *ited: August K. Lock DOB: 4W,1992 SSN: W/M 492 Kopp Rd Waterloo Illinois 62298 Student SEMO I then asked Lock if he entered the bar with his ID or if he used a fake ID. Lock stated that he had a fake ID and he removed it from his wallet. Lock possessed an ID with an older birth date that he used to misrepresent his age in order to obtain alcoholic beverages. I confiscated the ID and issued Lock citations for Minor in Possession by Consumption and Misrepresentation of Age. He was issued citation number 100 289946 and 100289947. He has a scheduled court date set for November 20, 2012 at 0900. Lock was released to a sober party pending his court appearances. The Fake ID was placed into evidence, I have nothing further to report at this time. NARRATIVE'.: On Friday, 12/07/2012, at approximately 0031 hours, Southeast Department of Public Safety Officer McCain, and 1, Patrolman Hann, DSN * 257, were conducting an alcohol compliance patrol when I observed a white male traveling on foot, west from Slinger's nightclub parking login the direction of Sprigg Street. I observed this subject as he traveled west across Sprigg Street and entered onto Southeast Missouri State University Tower's parking lot. I noted that this subject swayed considerably as he crossed Sprigg Street, displayed poor coordination as he dropped his cellular phone in the roadway and stumbled slightly as he stepped over the curb. It should be further noted that this subject was young in appearance and was traveling alone. Officer McCain and I then positioned our patrol vehicle at the tower's parking lot and approached this subject on foot. Upon making contact with this subject, I identified him as: Arrested: Schrempf, Jordan 0 Male/ White D08: 1992 SSN: 1202 Pine Tree Lane St Louis, MO 63119 POE: Unemployed/ Student Southeast Missouri State University It should be noted that as soon as I made contact with Schrempf, I observed numerous additional clues of impairment. Schrempf possessed blood shot eyes, slurred speech and I clearly detected the distinct odor of consumed intoxicants upon his breath. I then informed Schrempf that I was making contact with him as 1 suspected him to be a minor who was under the influence of alcohol and he replied, "191 be honest, I've been drinking and I'm twenty but I'm calling our sober phone and they are picking me up now." I then requested Schrempf's identification and he produced a Missouri license verifying that he was in fact only twenty years of age. I conducted a record's check on Schrempf and found him to be wanted on a Festus Missouri Police Department warrant for failure to appear upon traffic offenses_ Contact with Festus Police Department confirmed that this agency would not extradite Schrempf upon this active warrant. I then asked Schrempf where he had received this alcohol and he replied, "Stinger's." I saw that Schrempf was wearing a yellow wristband and I learned from contact with staff earlier in the night at Slinger's that this signified that he was a minor. I asked Schrempf how he received the alcohol and he stated, "My friends at Slinger's are Twenty-one and they ordered it for me." I asked Schrempf who his friends were who ordered the alcohol and he replied, "I'd rather not say." 1 asked Schrempf for the type and quantity of alcohol that he consumed and he stated, "Mainly vodka. Just whatever they brought back to my table. I drank a lot in the last few minutes before I left, probably too much." I then secured Schrempf and began transporting him to the Cape Girardeau Police Department for processing. While in route to the station, Jordan announced, "I'm getting sick! Stop the Carl" As I began Printed: 12107/201'2 1:13:59 PM Narrative Page 1 of 2 Incident Page 2 of 3 01 . cNv,\ *7757 INCIDENT DETAIL REPORT LIQUOR LAWS POSSESSION OF INTOXICANTS Agency: Gape Girardeau Police Departme Incident# : 12010294 Phone: (573) 335-6624 4ddress : 40 S Spriml. Cape Girardeau MO 63703 slowing my patrol vehicle to a stop to check on Schrempf s welfare, he vomited multiple times in the back seat and upon the floorboard of my patrol vehicle. I exited the vehicle to check upon Schrempf and noticed that he lost the ability to remain upright in a seated position. Schrempf also became unable to respond to basic questions and I determined that his level of intoxication was rapidly climbing. Due to Schrempf's increasing level of intoxication, I determined that it was necessary for him to receive medical treatment and I transported him to Southeast Hospital. At Southeast Hospital, it became necessary for McCain and I to carry Schrempf to the hospital entrance from our vehicle as he was not able stand on his own. Schrempf was then released from our custody and transferred over to the custody of Southeast Hospital emergency room staff. On 12/07/2012, at approximately 1250 hours, I made contact with Schrempf at his Southeast Missouri State University campus address of 630 Henderson, Apartment # 4. Schrempf advised that he was released from the hospital on 12/07/2012 at 0800 hours, Schrempf was then issued the following summons: Summons # 100289395 Offense: Minor in possession Ordinance: 5-12 (b) Municipal court date: 01/08/2012 This matter is cleared by arrest. Upon my arrival at this location, I observed a white male and a black male seated upon the curb across from Slingers parking entrance. The parties were then identified as: Victim: Stone, Blake E Male/ White DOB: JIM1992 144 Hogan Lane Jackson, Mo 63755 573-243-5619 Other. Buckner, Bruce Elliot Male/ Black DOB; OMI994 227 East Woodbine Saint Louis, Mo 63122 No phone No place of employment Upon making contact with Stone, he informed me that he had been inside Slingers with a friend when a group of four black males walked past his friend near the exit doors to the business. Stone stated that one the black males bumped shoulders with his friend as they exited and then immediately stepped in front of his face. Stone stated that he and his friend both tried to tell the group that they did not purposely bump shoulders with them but Stone explained teat it seemed evident that the group intentionally bumped shoulders in an attempt to initiate a physical confrontation. Stone stated that his friend stuck out his hand as if he was going to apologize when one of the black males struck him with a closed fist. Stone stated that he stepped between his friend and the suspect to push them apart when the rest of the group attacked him. Stone stated that the fight continued across the parking lot and he estimated that there were seven or eight black males swinging punches at hirn and his friend. Stone added that members of the crowd and Slingers' staff pulled the group apart until everyone dispersed. Patrolman Couch, DSN # 243, detained Buckner as he was in the crowd with the suspects and everyone else fled the area. Stone stated that his friend left on foot at the time that the crowd was dispersed and added that he did not want to involve him in the report. Stone had bruises on his cheeks, a small amount of blood coming from his mouth and a torn shirt which was consistent with his verbal account of the assault. Stone informed me that he could not identify the Printed: 12/16/2Di2 10:00:10 AM Narrative Page 1 of 2 Incident Page 2 of 3 INCIDENT DETAIL REPORT PEACE, DISTUR13ANCE PUBLIC Agency: Cape Girardeau Police Departme Incident # : 12090487 Phone: (573) 335-6621 Nddress : 40 S Sprigg, Cape Girardeau MO 63703 suspects who struck him and his friend. I then escorted Stone to a friend's apartment to avoid any further incidents. Nothing further.
