REZONINGS, SPECIAL USE PERMITS AND EXCEPTIONS A public hearing was held on the request of McDonald's USA, LLC for an exception from Development Code Section 25-911(b)(1), driveway throat length, at 1701 North Kingshighway. Mr. Thompson recused himself from the discussion and vote for business reasons. Matthew Allen, American Engineers, Inc., presented the request. He explained that the property has an unusual shape, making it challenging to meet McDonald's site design requirements as well as the City's requirements In order to provide the minimum number of off-street parking spaces, the throat length of the driveway in the southwest corner of the site must be reduced. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Finding: The primary purpose of the driveway throat length requirement is to ensure sufficient stacking room for vehicles entering and exiting via the driveway. The driveway in question is one-way (exit only). There are two other driveways serving the site, both of which are two-way (enter and exit). The exit -only designation of the driveway in question and the provision of additional driveways, which will allow exiting traffic to disperse, serve as a substantial equivalent because fewer stacking spaces will be needed for the driveway in question. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes February 10, 2021 Page 2 of 5 Finding; The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request. Chairman Greaser opened the public hearing. Seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Koetting and seconded by Ms. Stickel to approve the exception request. The motion passed with a roll call vote of 7 in favor, 0 in opposition, and 1 abstaining. (Aye: Blank, Greaser, Jackson, Koetting, Stickel, Whittington, Young; Abstain: Thompson) 2. A public hearing was held on the request of McDonald's USA, LLC for an exception from Development Code Section 25-804(a), street landscaping strip, at 1701 North Kingshighway. Mr. Thompson recused himself from the discussion and vote for business reasons. Matthew Allen, American Engineers, Inc., presented the request. He explained that, like the previous request, the unusual shape of the property and the various site design requirements make it necessary to reduce the width of the street landscaping strip along North Mount Auburn Road and North Kingshighway. In these areas, a white 3 -rail fence is proposed since there will not be enough room for the required plantings. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion, #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Finding: The primary. purpose of the street landscaping strip requirement is to visually enhance the areas between, parking spaces and the public right-of-way when the spaces are in close proximity to the right-of-way. The visual enhancement is in the form of plantings. A minimum width of 10 feet is required for, the street landscaping strip in order to provide sufficient room for the plantings, including the root systems: In lieu of providing the minimum width, the applicant is proposing to install a white 3 -rail fence where the plantings are required along North Mount Auburn Road and North Kingshighway. This qualifies as a substantial equivalent because the fence is decorative in nature and will effectively serve as a visual enhancement. However, staff feels it is still important to provide the plantings on the site, especially since there are other areas along the right-of-way where they could be planted. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code: Findin : The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes February 10, 2021 Page 3 of 5 Based on the above findings, staff recommended approval of the exception request, subject to the following conditions: 1. The final design and location of the proposed fence shall be subject to approval by the City staff; and 2. Any plantings required for the street landscaping strip that are not planted therein shall be planted elsewhere on the site, with the types and locations of the plantings subject to approval by the City staff. Chairman Greaser opened the public hearing. Seeing no appearances to speak, he closed the public hearing. Mr. Whittington asked if the fence will cause any sight distance issues at the exits. Mr. Allen replied that the fence will be far enough away from the exits that it won't cause any sight distance issues. Mr. Blank asked about the type of material for the fence. Mr. Allen stated that the fence will most likely be vinyl. Mr. Blank questioned the need for the fence. Mr. Shrimplin explained that, unlike a variance, an exception cannot be granted unless a substantial equivalent is provided. The fence qualifies as a substantial equivalent. A motion was made by Mr. Whittington and seconded by Mr. Jackson to approve the exception request with the conditions in the staff report. The motion passed with a roll call vote of 7 in favor, 0 in opposition, and 1 abstaining. (Aye: Blank, Greaser, Jackson, Koetting, Stickel, Whittington, Young, Abstain: Thompson) SUBDIVISION PLATS 3. The record plat of Cape West 18th Subdivision was reviewed by the Commission. Mr. Greaser recused himself from the discussion and vote for business reasons. A staff report was submitted to the Commission, which recommended approval of the plat, subject to staff's comments being successfully addressed. A motion was made by Mr. Koetting and seconded by Mr. Blank to recommend approval of the plat per the staff report recommendation. The motion passed with a roll call vote of 7 in favor, 0 in opposition, and 1 abstaining. (Aye: Blank, Jackson, Koetting, Stickel, Thompson, Whittington, Young, Abstain: Greaser) OTHER ITEMS AND COMMUNICATION Amended Rules of Procedure Mr. Shrimplin asked if there were any questions or comments regarding the amended Rules of Procedure. There being no questions or comments, the amended Rules of Procedure were unanimously approved upon a motion made by Mr. Koetting and seconded by Ms. Stickel. Commission Appointment Recommendation Chairman Greaser explained that Mr. Skinner resigned from the Commission due to a conflict with his new teaching schedule. Ms. Peters obtained the advisory board applications from the City Manager's Office, which were emailed to the Commission members. Mr. Thompson stated that he was not able to open the files containing the applications. He made a motion to table the discussion to the next meeting. Mr. Koetting seconded the motion, which passed unanimously. 0 Commission Communication City of Cape Girardeau Planning & Zoning Commission Meeting Minutes February 10, 2021 Page 4 of 5 Chairman Greaser informed the Commission that he will be out of town for the next meeting on March 10, 2021, Staff Communication Mr. Shrimplin gave the following updates: 1. Update on items from previous Commission meetings going on to City Council The City Council approved the following on January 19, 2021: • Zoning of annexed property at 4178 State Highway K 2nd & 3rd Readings The City Council approved the following on February 1, 2021: • Rezoning of property at 1246 & 1248 Meadowbrook Lane -1St Reading • Chapter 25 Amendment Regarding Administrative Relief and Exceptions —1St Reading Mr. Shrimplin explained that the Chapter 25 Amendment Regarding Administrative Relief and Exceptions was not reviewed by the Commission because the changes only involved administrative relief, a staff approval process. The amendment created a special type of administrative relief for properties taken out of compliance with the Development Code as a direct result of a City transportation project. 2. Update on Transportation Trust Fund (TTF) Projects Transportation Trust Fund 5 (TTF5)` • Fountain Street from William Street to Independence Street The City Manager is discussing the project with the City Council to determine the next course of action. Staff is awaiting a decision on the project. • Independences Street from Gordonville Road/East Rodney Drive to Caruthers Avenue — Staff is continuing negotiations with the affected property owners. • Main Street from Roberts Street. to East Cape Rock Drive - Staff has started the acquisition process: • Sprigg Street from William Street to Broadway Based on the results of the traffic study, a dedicated right turn lane for southbound North Sprigg Street at William Street is not warranted. Staff will focus on making improvements at the southwest corner of this intersection instead. The consultant is -looking 'at pavement core samples. • West End Boulevard from Rose Street to Bertling Street The project is in the final stages of acquisition. Staff plans, to advertise for bids in late winter, with construction beginning in early spring. Adjournment City of Cape Girardeau Planning & Zoning Commission Meeting Minutes February 10, 2021 Page 5 of 5 There being no further business, the Commission voted unanimously to adjourn the meeting at 7;35 p.m. upon a motion made by Mr. Koetting and seconded by Mr. Jackson. Respectfully submitted, Patrick Koetting, Secretary Planning & Zoning Commission PROPERTY OWNER: APPLICANT/ REPRESENTATIVE: CURRENT ZONING: REQUESTED ZONING: Parcel between 937 Hawthorne Road & 2901 Hawthorne Road A. G. Jones Properties, LLC Gerry Jones R-1 (Single-family Suburban Residential) R-3 (High Density Single-family Residential) CITY of CAPE GIRAR EAU COMMUNITY DEVELOPMENT TO: Planning and Zoning Commission FROM: Ryan Shrimplin, City Planner MEETING DATE: March 10, 2021 SUBJECT: Rezoning Request for Property on Hawthorne Road A rezoning application has been submitted for a property on Hawthorne Road. The applicant is requesting that the property be rezoned from R-1 (Single -Family Suburban Residential District) to R-3 (High Density Single -Family Residential District). The immediately surrounding properties are zoned R-1 (Single -Family Suburban Residential District) to the north, northeast, and west; PD (Planned Development District) to the southeast; and AG (Agricultural District) to the south. This area is characterized by residential, institutional, and recreational uses. The Cape Vision 2040 Future Land Use Map shows the subject property as Low Density Residential. In considering a rezoning request, both the Planning and Zoning Commission and the City Council must determine if the proposed zoning district is reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. At the time the Cape Vision 2040 comprehensive plan was developed, there were no known plans for the subject property. The Low Density Residential future land use category was assigned to the property based on an assumption that it would be developed for a single-family residential subdivision in the future. The applicant recently acquired the property, however, and would like to develop it for duplexes and/or townhouses. Although most of the surrounding residential properties contain single- family dwellings, the Shadow Wood Villas development across the street contains a mix of single-family and duplex lots. Further south on Hawthorne Road, there are several duplexes adjacent to the Arena Park Sports Complex. The mix of single-family dwellings and duplexes along Hawthorne Road makes the proposed zoning district reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. Based on the above findings, staff recommends approval of the rezoning request. o° Bg,L 401 Independence St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org Rezoning Request Hawthorne Road Requested Rezoning from R-1 (Single -Family Suburban Residential) to R-3 (High Density Single -Family Residential) Future Land Use Recommendation: Low Density Residential 2880 R1 C 1 A HOpper Rd ` 3013 - - R ► ,; ,--__.._,r o 3007 ® 2975 1!+ - 0 2883 © 2879; 288 ® 2873 R1 ° 2871 o R1 R1 R1 R1 286 R1 286 0 R1 2885 937 R1 ° R1 R1 i 2992 R1 - R1 EZ, L; l PD f F. The property contains a small, one-story building and a parking lot with five (5) parking spaces. The applicant is proposing to operate a barber shop on the property, which is a special use in the RUMD district. The Zoning Code (Chapter 30 of the City's Code of Ordinances) authorizes the City Council to grant special use permits in accordance with Section 30-401. In order for a special use permit to be granted, both the Planning and Zoning Commission and the City Council must consider and make findings of fact with regard to certain criteria. Staff has reviewed the application using the criteria and made the following findings: Criterion #1: The proposed special use will not substantially increase traffic hazards or congestion. - Finding: The Development Code (Chapter 25 of the City's Code of Ordinances) requires two and one-half (2.5) off-street parking spaces for each work station in a barber shop. Because there are five (5) off-street parking spaces, the barber shop is limited to two (2) work stations. The volume of traffic generated by a barber shop of this size will not substantially increase traffic hazards or congestion. Criterion #2: The proposed special use will not substantially increase fire hazards. Finding: In general, barber shops do not involve any activities that substantially increase fire hazards. Criterion #3: The proposed special use will not adversely affect the character of the neighborhood. Finding: At this time, the applicant only plans on remodeling the interior of the building. The physical appearance of the building's exterior and the parking lot ( 401 Independence St Cape Girardeau, Mb 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape, org CITY of CARE GIRARDEAU COMMUNITY DEVELOPMENT are not expected to change significantly. All activities will be conducted indoors and the volume of traffic will be relatively low. Criterion #4: The proposed special use will not adversely affect the general welfare of the community. Finding: The property proposed for the barber shop is suitable for this type of use, based on its location and the existing improvements. The barber shop will serve the neighborhood and contribute to the general welfare of the community in a positive way. Criterion #5: The proposed special use will not overtax public utilities. Finding: In general, barber shops do not generate high utility demand. Based on the above findings, staff recommends approval of the special use permit request, subject to the following conditions: 1. The special use shall meet all applicable requirements of the Zoning and Development Codes. 2. Major modifications to the special use (including, but not limited to, the site plan) shall require the approval of the City Council 3. This permit shall automatically expire twelve (12) months from the date of issuance if the use for which it was granted has not commenced. 4. This permit is not transferable without the consent of the City Council. 5. PROFESSIONAL SURVEYOR/ ENGINEER: Record Plat Cypress Grove Subdivision 447 Edgewood Road Jeremy Pincosy Richards Land Surveying CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT TO: Planning and Zoning Commission FROM: Ryan Shrimplin, City Planner &tg MEETING ®ATE: March 10, 2021 SUBJECT: Cypress Grove Subdivision Record Plat A record plat has been submitted for Cypress Grove Subdivision, located at 447 Edgewood Road. The property is zoned R-1 (Single -Family Suburban Residential). The plat subdivides a lot to form two new lots. The plat shows an exception for the omission of the required 10 foot utility easement along the rear line of both lots. Staff supports the exception for Lot #1 only, as there are no existing or proposed City utilities in the area where the easement is required. Staff is having the plat revised to show the required easement on Lot #2. In addition to the exception, the plat shows a variance for reduced lot width for Lot #2 along Edgewood Road. Staff supports the variance because the lot is designed to accommodate a house in the rear portion, which is much wider than the front portion and exceeds the minimum lot width. The front portion does have the minimum width required for fire department access (20 feet). The attached staff review letter was sent to the applicant. At the time of this report, the corrected plat had not yet been received. Based on the above findings, staff recommends approval of the record plat, subject to staff's comments being successfully addressed. 44 o ___p .P4\ W 401 Independence St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT February 26, 2021 VIA EMAIL ONLY: pincosyconstruction(c g mail. com Jeremy Pincosy 220 Independence Street, Unit A Cape Girardeau, Missouri 63703 RE: Cypress Grove Subdivision Record Plat Dear Mr. Pincosy: City staff has completed its review of the above plat. During the review, the following items were found which need correction or attention (text in red is to be added or changed verbatim): 1. Lot #1 does not appear to have the minimum lot width of 80 feet. Staff does not support a variance for a reduced lot width for this lot. Revise the drawing to show an 80 foot width for Lot #1 and update the plat accordingly. 2. Revise the vicinity map as follows: ® Change "BROADVIEW" to "S BROADVIEW ST". ® Add the names of the streets labeled "ST" below Quince Street. 3. In the legend, change "KAP" to "CAP". 4. Change SETBACK LINE to a symbol that does not contain three dots. It is too similar to the NEW LOT LINE symbol. 5. In the line table, the bearing of L1 does not match the corresponding bearing in the legal description. 6. Detail the found iron rod at the west terminus of L6. 7. Some of the adjacent property labels are missing the owner name. 8. Add the right-of-way width to the Edgewood Road label. 9. Label the 30 foot setback line on Lot #2 along Edgewood Road. 10. Label the 6 foot setback line along the south side of the narrow portion of Lot #2. 11. Add crow's feet for the distance of the rear line of Lot #1. 0 401 Independence St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRARDEAU COMMUNITY DEVELOPMENT 12. Add "NEW" to the front of the 10 foot utility easement label. 13. Show the required new 10 foot utility easement along the rear line of Lot #2. 14. Revise Note #1 to read as follows: AN EXCEPTION IS SHOWN FOR THE OMISSION OF THE REQUIRED 10 FT. UTILITY EASEMENT ALONG THE REAR LINE OF LOT #1. 15. Add a period at the end of Note #2. 16. Remove the 20 foot wide cross access and utility easement unless the lots will have shared access, in which case the label will need to be revised and language will need to be added to the Subdivision Dedication section. Contact Ryan Shrimplin, City Planner, at (573) 339-6327 if shared access is proposed. 17. Contact Teresa Heifner, GIS Coordinator, at (573) 339-6327 to discuss the alley. 18. In the Zoning Information section, revise the maximum height standard to read as follows: MAXIMUM HEIGHT = TWO AND ONE-HALF (2 1/2) STORIES, NOT TO EXCEED THIRTY-FIVE (35) FEET 19. In the Subdivision Dedication section, first line, add "HUSBAND AND WIFE," after "JOANNA PI NCOSY,". 20. In the Subdivision Dedication section, last paragraph, add "SUBDIVISION" at the end of "CYPRESS GROVE". 21. In the second to last line of the Subdivision Dedication section, change the comma after "SYSTEMS" to a period. 22. In the Recorder of Deeds' certificate, revise to read: "THE OFFICE OF THE RECORDER OF DEEDS OF CAPE GIRARDEAU COUNTY". 23. In the Recorder of Deeds' certificate, below Mr. Blattner's name and title, add: "CAPE GIRARDEAU COUNTY, MISSOURI". Please make the above corrections to the plat and email a .pdf file of the corrected plat to me at rshrimplinQcityofcape.org by March 8, 2021. Once the .pdf file is received, City staff will review it to make sure all of the corrections have been made. If there are no further corrections, then you will be notified to submit six (6) signed and sealed prints of the corrected plat. If the .pdf file is not received by March 8, 2021, then the Planning and Zoning Commission may postpone taking action on the plat or recommend approval, subject to staff's comments being successfully addressed. All staff comments must be successfully addressed prior to review of the plat by the City Council. 4uuW t e m s ML 401 Independence St Cape Girardeau, MO 63703 573-339-6327 Tel 573-339-6303 Fax cityofcape.org CITY of CAPE GIRAR®EAU COMMUNI'T'Y DEVELOPMENT Please contact me if you have questions or comments.
