Gentlemen: The Planning and Zoning Commission met August 31, 1970 in Special Session and held a Public Hearing on the request of City Sanitation, Inc. to conduct a landfill operation in an area bounded by the Mississippi River on the east, the Frisco Railroad tracks on the west, Boundary Street on the north and LaCruz Street on the south, an area of approx- imately 28.5 acres. At the hearing City Sanitation, Inc. was represented by an attorn- ey who spoke on behalf of W.W. Juden, President of the firm and explained City Sanitation's position on why the landfill should be allowed to o- perate. A local attorney spoke against the matter and three citizens spoke against the location of the landfill. Each member of the Commission and its Advisors personally inspected the site involved. Most members walked over the intended landfill area. One member interviewed five residents of the area as to their opinion of the proposed landfill. The Commission finds the following facts: the area from the bridge south to Highway 74, and west to First Street and south of Highway 74 to the south and west corporate limits is zoned M-2, Heavy Industry. The only area, by City Ordinance, that a landfill or dump may be operated in is an M-2 area and the proposed site lies within this M-2 area. All private homes in this area at this time are non -conforming, and no new homes may be built or present homes modified, under present statutes adopted under the Bartholomew Plan, see Section 20.4 Zoning Ordinance. The City Sanitation, Inc. has approval of the State Board of Health for its location of the landfill and for its proposal of operation. The inspector from Jefferson City personally inspected the site for compliance before approval was given. The Board stringent, Inc smoke control, control these Health as well that violation of Health's conditions for operation of the landfill are Luding daily covering of material dumped and strong dust and as well as control of pests and insects. All measures to >roblems must be taken by the operator. The State Board of as the City Board of Health have instructed City Sanitation of any rules would result in a shut down of the operation. ,ipP, Inspection by the Planning and Zoning Commission indicates that thin: area '. has Seen used as a damping ground for years, and literally hundreds of derelict and abandoned cars and by report in excess of 3000 discarded tires are in the general area at the present time. The proposed dump area is now subject to periodic flooding and was partially tinder water last spring. Hader the Board of Health orders a dike must be constructed to keep this area from being flood- ed until the Landfill is completed. tipcn cea Senor, of the land fill the 28 acre area will be two fee`_ above the highest recorded flood stage. This process would take approximately ten to twelve years. The altimate use of this site could be beneficial to the South Cape area and to the citizenry as a whole. The Goamission listened with great interest to the remarks and objections made by those opposed to this location, mostly odor, dust and traffic, but fee, that strict compliance. by City Sanitation with the regulations of the, State Board of Health ;and the Boundary Street plan of the company should sat- isfy the objections. Therefore by majority action we recommend as follows: 1. That the City give consideration to filling the old creek bed run- ning from Sprigg Street: east of the river through the proposed landfill site to protect homes along Spri.gg Street north of LaCruz from £Loodi.ng by backup of river water through the creek bed as it has in the past. 2. Fiat as long as strict adherence to the rules of the State Board of Health and City Board of Health are followed, thatthe proposed landfill site be approved. Respectfully, For the Commission, t R.P.
