Session STUDY SESSION — November 16, 2020 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, November 16, 2020, starting at 5:00 p.m. with Mayor Pro Tempore Robbie Guard and Council Members Stacy Kinder, Shelly Moore, Dan Presson, Nate Thomas, and Shannon Truxel present. Mayor Bob Fox was unable to attend, but was on the telephone. REGULAR SESSION — November 16, 2020 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, November 16, 2020, at 5:47 p.m., with Mayor Pro Tempore Robbie Guard and Council Members Stacy Kinder, Shelly Moore, Dan Presson, Nate Thomas, and Shannon Truxel present. Mayor Bob Fox was unable to attend, but was on the telephone. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Nate Thomas, to adopt the agenda. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. A Public Hearing to consider vacating the City's interest in the Utility Easement located at 2128 Woodhollow Court, in the City of Cape Girardeau, Missouri. Mayor Pro Tempore Robbie Guard opened the public hearing. There being no appearances the public hearing was closed. A public hearing to consider the proposed voluntary annexation of property located adjacent to the Cape Girardeau Regional Airport, as requested by the City of Cape Girardeau, and the proposed zoning of the same property as A-1, Airport District. Mayor Pro Tempore Robbie Guard opened the public hearing. There being no appearances the public hearing was closed. APPEARANCES None. CONSENT AGENDA Approval of the November 2, 2020, City Council regular session minutes and closed session minutes. BILL NO. 20-159, an Ordinance approving the record plat of Walden Park Phase 5. Second and Third Readings. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session November 16, 2020 KK -424 BILL NO. 20-160, an Ordinance approving the record plat of Rhodes Mount Auburn Subdivision Number 2. Second and Third Readings. BILL NO. 20-168, a Resolution acknowledging receipt of an annexation petition for property locatedat4178 State Highway K, and setting a public hearing regarding the proposed annexation. Reading and Passage. Accept Improvements and Authorize Final Payment to Evrard Company, Inc. for the Fort D Roof Replacement Project. Acceptance of: public improvements to serve Walden Park Phase 5. Council Member Robbie Guard abstained for financial reasons, from Bill No. 20-159 and from Bill No. 20-160, and acceptance of public improvements to serve Walden Park Phase 5, due to his employment with MRV Bank. A Motion was made by Dan Presson, Seconded by Shannon Truxel, to approve and adopt. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. BILL NO. 20-159 will be Ordinance No. 5353; BILL NO. 20-160 will be Ordinance No. 5354; and BILL NO. 20-168 will be Resolution No. 3369. NEW ORDINANCES BILL NO. 20-164, an Ordinance accepting a Permanent Utility Easement from Paul D. Robison and Kristy A. Robison, for property located at 2128 Woodhollow Court, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Nate Thomas, Seconded by Dan Presson, to approve. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. BILL NO. 20-165, an Ordinance vacating the City's interest in the Utility Easement located at 2128 Woodhollow Court, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Dan Presson, Seconded by Shannon Truxel, to approve. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. BILL NO. 20-166, an Ordinance accepting a Permanent Utility Easement from Meyr Properties, L.P., a Missouri Limited Partnership, for Baldwin Place Phase III, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Shannon Truxel, Seconded by Stacy Kinder, to approve. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. BILL NO. 20-167 an Ordinance appropriating the expenditure of funds related to the Cares Act Grant for the fiscal year ending June 30, 2021, in the City of Cape Girardeau, Missouri. Regular Session November 16, 2020 kK-425 A Motion was made by Shannon Truxel, Seconded by Nate Thomas, to approve and adopt. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. BILL NO. 20-167 will be Ordinance No. 5355. BILL NO. 20-169, an Ordinance approving the record plat of Tara Estates Amended. First Reading. A Motion was made by Dan Presson, Seconded by Stacy Kinder, to approve. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. APPOINTMENTS Appointments to the Liquor License Review Board A Motion was made by Stacy Kinder, Seconded by Dan Presson, to appoint Richard Fehr to the Liquor License Review Board for a term expiring December 1, 2023. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. A Motion was made by Dan Presson, Seconded by Robbie Guard, to appoint David Schaffner to the Liquor License Review Board as an alternate member for a term expiring December 1, 2023. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. Appointment to the River Campus Board of Managers A Motion was made by Dan Presson, Seconded by Stacy Kinder, to appoint Sophia Han to the River Campus Board of Managers for a term expiring December 1, 2023. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. Appointment to the Parks and Recreation Advisory Board A Motion was made by Shannon Truxel, Seconded by Nate Thomas, to Meghan Harville to the Parks and Recreation Advisory Board for a term expiring October 29, 2021. Motion passed. 6-0. Ayes: Guard, Kinder, Moore, Presson, Thomas, Truxel. Absent: Fox. MEETING ADJOURNMENT A Motion was made by Nate Thomas, Seconded by Dan Presson, to adjourn from regular session and to convene in closed session for personnel issues, pursuant to RSMo.
