Regular Session November 2,2020 KK-417 STUDY SESSION—November 2,2020 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, November 2, 2020, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Shelly Moore, Dan Presson, Nate Thomas, and Shannon Truxel present. REGULAR SESSION—November 2,2020 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, November 2, 2020, at 5:55 p.m., with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Shelly Moore, Dan Presson, Nate Thomas, and Shannon Truxel present. ADOPTION OF THE AGENDA A Motion was made by Robbie Guard, Seconded by Dan Presson,to adopt the agenda. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson,Thomas, Truxel. APPEARANCES None. CONSENT AGENDA Approval of the October 19, 2020, City Council regular session minutes and closed session minutes. BILL NO. 20-155, an Ordinance accepting a General Warranty Deed from the Jerry Lipps Voluntary Trust Agreement of April 1, 1982, for property located adjacent to the Cape Girardeau Regional Airport. Second and Third Readings. BILL NO. 20-156, an Ordinance accepting a Permanent Waterline Easement from D&D Cape Investments, L.P., for property located at 711 South Mount Auburn Road, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 20-157, an Ordinance amending the Sewer Tap Fees in Section 25-1105 (d)(3) of the Code of Ordinances of the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 20-158, an Ordinance approving the record plat of Rally's Subdivision. Second and Third Readings. BILL NO. 20-161, a Resolution authorizing the City Manager to execute a Performance Guarantee Agreement with RiverWest Partners, L.C., for Walden Park Phase 5, in the City of Cape Girardeau, Missouri. Regular November 2,2020 KK-418 Session BILL NO. 20-162, a Resolution authorizing the City Manager to execute an Agreement with Nip Kelley Equipment Company, Inc., for the 2020-2021 CIST Street Repair Project, in the City of Cape Girardeau,Missouri. Reading and Passage. BILL NO. 20-163, a Resolution authorizing the City Manager to execute a contract with Anthem Blue Cross for Employee Health Insurance Services, in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 20-164, a Resolution authorizing the City Manager to execute a contract with Delta Dental for Employee Dental Insurance Services, in the City of Cape Girardeau, Missouri. Reading and Passage. Council Member Robbie Guard abstained for financial reasons, from Bill No. 20-155 and from Bill No. 20-161, due to his employment with MRV Bank. A Motion was made by Robbie Guard, Seconded by Shannon Truxel,to approve and adopt. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson,Thomas, Truxel. BILL NO. 20-155 will be Ordinance No. 5349; BILL NO. 20-156 will be Ordinance No. 5350; BILL NO. 20-157 will be Ordinance No. 5351; BILL NO. 20-158 will be Ordinance No. 5352; BILL NO. 20-161 will be Resolution No. 3365; BILL NO. 20-162 will be Resolution No. 3366; BILL NO. 20-163 will be Resolution No. 3367; and BILL NO. 20-164 will be Resolution No. 3368. NEW ORDINANCES BILL NO. 20-159, an Ordinance approving the record plat of Walden Park Phase 5. First Reading. Council Member Robbie Guard abstained for financial reasons, due to his employment with MRV Bank. A Motion was made by Dan Presson, Seconded by Nate Thomas,to approve. Motion passed. 6-0. Ayes: Fox, Kinder, Moore, Presson, Thomas, Truxel. Abstain: Guard BILL NO. 20-160, an Ordinance approving the record plat of Rhodes Mount Auburn Subdivision Number 2. First Reading. Council Member Robbie Guard abstained for financial reasons, due to his employment with MRV Bank. A Motion was made by Nate Thomas, Seconded by Shannon Truxel,to approve. Motion passed. 6-0. Ayes: Fox, Kinder, Moore, Presson, Thomas, Truxel. Abstain: Guard APPOINTMENTS Appointments to the Golf Course Advisory Board A Motion was made by Robbie Guard, Seconded by Nate Thomas, to appoint Clair Kneer to the Golf Course Advisory Board for a term expiring November 12, 2023. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson, Thomas, Truxel. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session November 2, 2020 KK-419 Appointment to the Historic Preservation Commission m P A Motion was made by Robbie Guard, Seconded by Nate Thomas, to appoint Brianna Biri to the Historic Preservation Commission for a term expiring April 16, 2022. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson, Thomas,Truxel. Appointment to the Planning and Zoning Commission A Motion was made by Robbie Guard, Seconded by Nate Thomas, to appoint Scott Blank and Jeff Glenn to the Planning and Zoning Commission for terms expiring November 1, 2024 Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson,Thomas, Truxel. A Motion was made by Stacy Kinder, Seconded by Dan Presson, to appoint Kevin Greaser and Melissa Stickel to the Planning and Zoning Commission for terms expiring November 1, 2021. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson, Thomas, Truxel. OTHER BUSINESS Set Regular City Council Meetings for the 2021 calendar year A Motion was made by Stacy Kinder, Seconded by Dan Presson, to set the 2021 Regular City Council Meetings per staff's recommendation. Motion passed. 7-0. Ayes: Fox, Guard, Kinder, Moore, Presson, Thomas, Truxel. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Nate Thomas, to adjourn from regular session and to convene in closed session for personnel issues, pursuant to RSMo.
