Regular Session October 19, 2020 kK-411 STUDY SESSION—October 19,2020 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, October 19, 2020, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Dan Presson, Nate Thomas, and Shannon Truxel present. Shelly Moore was absent. REGULAR SESSION—October 19,2020 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, October 19, 2020, at 6:45 p.m., with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Dan Presson, Nate Thomas, and Shannon Truxel present. Shelly Moore was absent. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Robbie Guard,to adopt the agenda. Motion passed. 6-0. Ayes: Fox, Guard, Kinder, Presson, Thomas, Truxel. Absent: Moore. APPEARANCES John Voss, resident of 834 Alta Vista Drive, and member of the Public Library Board of Trustees,appeared regarding the proposed amendments to the City Code about Advisory Boards and Commissions. He thanked the City Council for removing the Public Library Board of Trustees from the proposed Ordinance. CONSENT AGENDA Approval of the October 5,2020, City Council regular session minutes. BILL NO. 20-146, an Ordinance authorizing the issuance of Special Tax Bills on certain properties for the demolition of dangerous buildings and for nuisance abatements under the provisions of Chapter 7 and Chapter 13 of the Code of Ordinances of the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 20-147, an Ordinance approving the record plat of Walden Park Townhomes. Second and Third Readings. BILL NO. 20-148, an Ordinance Amending the Cape Girardeau City Code regarding Advisory Boards and Commissions. Second and Third Readings. Bill No. 20-149 A Resolution authorizing the City Manager to execute an Agreement with LNB Studio for Plan Review Services to assist with Commercial Plan Review, in the City of Cape Girardeau, Missouri. Reading and Passage. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session October 19, 2020 KK-412 Bill No. 20-150 A Resolution authorizing the City Manager to execute an Agreement with B&F Construction Code Services, Inc., for Plan Review Services to assist with Commercial Plan Review, in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 20-151, A Resolution authorizing the City Manager to execute a License and Indemnity Agreement with Southeast Missouri State University for installation of fiber optic cable along Morgan Oak Street, South Fountain Street, and South Frederick Street, in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 20-152, a Resolution authorizing the City Manager to execute an Agreement for Professional and Construction Services with Penzel Construction, Inc., for the relocation of Customer Service, in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 20-153 A Resolution authorizing the City Manager to execute a First Amendment to the Understanding and Agreement with Saint Francis Medical Center, regarding officer staffing and compensation. Reading and Passage. BILL NO. 20-154, a Resolution acknowledging receipt of an annexation petition for property located adjacent to the Cape Girardeau Regional Airport, and setting a public hearing regarding the proposed annexation. Reading and Passage. Acceptance of Improvements and Authorize Final Payment to Fronabarger Concreters Inc., for the Downtown Sidewalk Replacement and Lighting, Main Street: From Broadway to Independence Project. Acceptance of public improvements to serve Lot 3 of Walden Park Phase l - Amended. Council Member Robbie Guard abstained for financial reasons, from Bill No. 20-147, and from the acceptance of the improvements to serve Lot 3 of Walden Park Phase 1 — Amended, due to his employment with MRV Bank. A Motion was made by Dan Presson, Seconded by Shannon Truxel, to approve and adopt. Motion passed. 6-0. Ayes: Fox, Guard, Kinder, Presson, Thomas, Truxel. Absent: Moore. BILL NO. 20-146 will be Ordinance No. 5346; BILL NO. 20-147 will be Ordinance No. 5347; BILL NO. 20-148 will be Ordinance No. 5348; BILL NO. 20-149 will be Resolution No. 3359; BILL NO. 20-150 will be Resolution No. 3360; BILL NO. 20-151 will be Resolution No. 3361; BILL NO. 20-152 will be Resolution No. 3362; BILL NO. 20-153 will be Resolution No. 3363; and BILL NO. 20-154 will be Resolution No. 3364. NEW ORDINANCES BILL NO. 20-155, an Ordinance accepting a General Warranty Deed from the Jerry Lipps Voluntary Trust Agreement of April 1, 1982, for property located adjacent to the Cape Girardeau Regional Airport. First Reading. Council Member Robbie Guard abstained for financial reasons, due to his employment with MRV Bank. A Motion was made by Dan Presson, Seconded by Shannon Truxel,to approve. Motion passed. 5-0. Ayes: Fox, Kinder, Pressor, Thomas, Truxel. Absent: Moore. Abstain: Guard. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session October 19, 2020 KK-413 BILL NO. 20-156, an Ordinance accepting a Permanent Waterline Easement from D&D Cape Investments, L.P., for property located at 711 South Mount Auburn Road, in the City of Cape : Girardeau, Missouri. First Reading. i P A Motion was made by Nate Thomas, Seconded by Robbie Guard,to approve. Motion passed. 6-0. Ayes: Fox, Guard, Kinder, Presson, Thomas, Truxel. Absent: Moore. BILL NO. 20-157, an Ordinance amending the Sewer Tap Fees in Section 25-1105 (d)(3) of the Code of Ordinances of the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Shannon Truxel, Seconded by Nate Thomas,to approve. Motion passed. 6-0. Ayes: Fox, Guard, Kinder, Presson, Thomas, Truxel. Absent: Moore. BILL NO. 20-158, an Ordinance approving the record plat of Rally's Subdivision. First Reading. A Motion was made by Robbie Guard, Seconded by Dan Presson,to approve. Motion passed. 6-0. Ayes: Fox, Guard, Kinder, Presson, Thomas, Truxel. Absent: Moore. Appointments Appointment to the Parks and Recreation Advisory Board A Motion was made by Dan Presson, Seconded by Robbie Guard, to appoint Beverly Evans, Kevin Noel, and Pete Frazier to the Parks and Recreation Advisory Board for a terms expiring October 29, 2023. Motion passed. 6-0. Ayes: Fox, Guard,Kinder, Presson, Thomas, Truxel. Absent: Moore. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Nate Thomas, to adjourn from regular session and to convene in closed session for legal actions and litigation, confidential communications with legal counsel, property acquisition, and personnel issues, pursuant to RSMo. Sections 610.021(1), (2), and (3). Motion passed. 6-0. Ayes: Fox, Guard, Kinder, Presson, Thomas, Truxel. Absent: Moore.
