Regular August 17, 2020 KK-395 Session STUDY SESSION—August 17,2020 m NO ACTION TAKEN DURING THE STUDY SESSION I 17 The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, August 17, 2020, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Robbie Guard, Shelly Moore, Nate Thomas, and Shannon Truxel present. Dan Presson was in attendance by videoconferencing. Stacy Kinder was absent. REGULAR SESSION—August 17,2020 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, August 17, 2020, at 5:20 p.m., with Mayor Bob Fox presiding and Council Members Robbie Guard, Shelly Moore, Nate Thomas, and Shannon Truxel present. Dan Presson was in attendance by videoconferencing. Stacy Kinder was absent. ADOPTION OF THE AGENDA A Motion was made by Nate Thomas, Seconded by Shannon Truxel,to adopt the Agenda. Motion passed. 6-0. Ayes: Fox, Guard,Moore, Presson, Thomas, Truxel. Absent: Kinder. APPEARANCES None. CONSENT AGENDA Approval of the August 3, 2020, City Council regular session minutes and closed session minutes. BILL NO. 20-114, an Ordinance readopting Sections 2-76 to 2-83 of the City Code of Cape Girardeau, Missouri, relating to Conflicts of Interest. Second and Third Readings. BILL NO. 20-115, an Ordinance annexing land into the city limits of the City of Cape Girardeau, Missouri, located at 4072 State Highway K, upon the request of Midamerica Highway K, LLC. Second and Third Readings. BILL NO. 20-116, an Ordinance extending the boundaries of Ward 6 to include property newly annexed into the city limits of the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 20-117, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau,Missouri, by zoning property located at 4072 State Highway K, as C-2, Highway Commercial District. Second and Third Readings. BILL NO. 20-118, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau,Missouri,by changing the zoning of property located at 1017 and 1019 Harmony Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 17, 2020 KK-396 Street, in the City and County of Cape Girardeau, Missouri, from R-3 to CBD. Second and Third Readings. BILL NO. 20-119, an Ordinance providing for the levying of the annual City revenue tax; public health tax; Special Business District No. 2 tax; for the fiscal year ending on the 30th day of June, 2021. Second and Third Readings. BILL NO. 20-120, an Ordinance amending Chapter 26 of the Code of Ordinances of the City of Cape Girardeau,Missouri,regarding helmet requirements. Second and Third Readings. BILL NO. 20-121, an Ordinance amending Chapter 17 of the Code of Ordinances of the City of Cape Girardeau, Missouri, regarding regulation of methamphetamine precursor drugs. Second and Third Readings. BILL NO. 20-122, an Ordinance accepting Temporary Construction Easements from various property owners, for the Good Hope Drainage Project, in the City of Cape Girardeau, Missouri. Second and Third Readings. Approval of the Release of Performance Guarantee Agreement for Auburn Park Place One. Accept Improvements and Authorize Final Payment to Nip Kelley Equipment Company Inc., for the Gordonville Booster Pump Station. A Motion was made by Robbie Guard, Seconded by Nate Thomas,to approve and adopt. Motion passed. 6-0. Ayes: Fox, Guard,Moore, Presson, Thomas, Truxel. Absent: Kinder. NEW ORDINANCES BILL NO. 20-123, an Ordinance appropriating funds for debt service expenditures for the fiscal year ending June 30,2020, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Robbie Guard, Seconded by Dan Presson,to approve. Motion passed. 6-0. Ayes: Fox, Guard,Moore, Presson, Thomas, Truxel. Absent: Kinder. BILL NO. 20-124, an Ordinance authorizing the issuance of a Special Tax Bill for property located at 838 South Ellis Street, for the demolition of a dangerous building and for the abatement of nuisances, under the provisions of Chapter 7 and Chapter 13 of the Code of Ordinances of the City of Cape Girardeau,Missouri. First Reading. A Motion was made by Nate Thomas, Seconded by Shannon Truxel, to approve. Motion passed. 6-0. Ayes: Fox, Guard,Moore,Presson,Thomas, Truxel. Absent: Kinder. Bill NO. 20-125, an Ordinance amending Chapter 6 of the Code of Ordinances of the City of Cape Girardeau,Missouri,regarding Dog and Cat Licensing. First Reading. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 17, 2020 KK-397 A Motion was made by Robbie Guard, Seconded by Dan Presson,to approve. O Council Member Shannon Truxel voiced concerns with the elimination of the pet licenses, and whether the proposal was vetted through the Police Department and Nuisance Abatement Officers who deal with animal complaints. She asked for more information and to postpone action to eliminate the dog and cat licenses. A Motion was made by Shannon Truxel, Seconded by Nate Thomas, to postpone to a future meeting. Motion passed. 6-0.Ayes: Fox, Guard,Moore,Presson, Thomas, Truxel. Absent: Kinder. BILL NO. 20-126, an Ordinance approving the record plat of St. Jude's Second Subdivision. First Reading. A Motion was made by Robbie Guard, Seconded by Nate Thomas,to approve. Motion passed. 6-0.Ayes: Fox, Guard,Moore,Presson, Thomas, Truxel. Absent: Kinder. APPOINTMENTS Appointments to the Board of Adjustment A Motion was made by Robbie Guard, Seconded by Nate Thomas, to appoint David Hinton, Edward Hart, and Raymond Buhs as Alternate Members to the Board of Adjustment, for terms expiring September 4, 2025. Motion passed. 6-0.Ayes: Fox, Guard,Moore, Presson, Thomas,Truxel. Absent: Kinder. Appointment to the Board of Appeals • A Motion was made by Nate Thomas, Seconded by Shannon Truxel, to appoint Nicole Annis to the Board of Appeals, for terms expiring September 4,2025. Motion passed. 6-0. Ayes: Fox, Guard,Moore,Presson, Thomas, Truxel. Absent: Kinder. Appointments to the Golf Course Advisory Board A Motion was made by Robbie Guard, Seconded by Shelly Moore, to appoint Gary Wren and Joshua Schulz to the Golf Course Advisory Board,for terms expiring September 4, 2023. Motion passed. 6-0. Ayes: Fox, Guard,Moore, Presson, Thomas, Truxel.Absent: Kinder. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Shannon Truxel, to adjourn from regular session and to convene in closed session for legal actions and litigation, confidential communications with legal counsel, property acquisition, and personnel issues, pursuant to RSMo. Sections 610.021(1), (2), and(3). Motion passed. 6-0. Ayes: Fox, Guard,Moore, Presson,Thomas, Truxel.Absent: Kinder.
