Regular July 20, 2020 kK-389 Session STUDY SESSION—July 20,2020 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, July 20, 2020, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Dan Presson, Shelly Moore, Nate Thomas, and Shannon Truxel present. REGULAR SESSION—July 20,2020 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, July 20, 2020, at 6:30 p.m., with Mayor Bob Fox presiding and Council Members Robbie Guard, Stacy Kinder, Dan Presson, Shelly Moore, Nate Thomas, and Shannon Truxel present. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Nate Thomas,to adopt the Agenda. Motion passed. 7-0.Ayes: Fox, Guard,Kinder, Moore, Presson,Thomas,Truxel. PUBLIC HEARINGS A public hearing to consider the proposed voluntary annexation of property_located at 4072 State Highway K as requested by Midamerica Highway K, LLC, and the proposed zoning of the same property as C-2,Highway Commercial District. Mayor Bob Fox opened the public hearing. Dan Drury President of Midamerca Hotels appeared in favor. There being no other appearances the public hearing was closed. APPEARANCES None. CONSENT AGENDA Approval of the July 6, 2020, City Council regular session minutes and closed session minutes. BILL NO. 20-99, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 920 North Middle Street, in the City and County of Cape Girardeau, Missouri, from R-2 to RUMD. Second and Third Readings. BILL NO. 20-100, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 900 South Proceedigs of the City Council, City of Cape Girardeau, Mo. Regular Session July 20, 2020 KK-390 Kingshighway, in the City and County of Cape Girardeau, Missouri, from M-2 to M-1. Second and Third Readings. BILL NO. 20-101, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located on the north side of LaSalle Avenue, east of Baldwin Drive, in the City and County of Cape Girardeau, Missouri, from C-2 to R-1. Second and Third Readings. BILL NO. 20-102 An Ordinance Amending Chapter 26 of the Code of Ordinances of the City of Cape Girardeau, Missouri,regarding Speed Limits and Penalties. Second and Third Readings. BILL NO. 20-103, an Ordinance accepting a Permanent Utility Easement from Liberty Apartments of Cape, LLC, for property located at 1145 Walnut Street, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 20-104, an Ordinance to repeal Ordinance No. 5076, regarding a Permanent Utility and Sewer Easement for unimproved Decatur Street Right-of-Way, in the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 20-107, an Ordinance amending Schedule G of Section 26-249 and Schedule R of Section 26-248 of the City Code, by establishing 30 minute parking along Broadway Street, in the City of Cape Girardeau,Missouri. Second and Third Readings. A Motion was made by Robbie Guard, Seconded by Nate Thomas,to approve and adopt. Motion passed. 7-0. Ayes: Fox, Guard,Kinder, Moore,Presson,Thomas, Truxel. Council Member Robbie Guard abstained for financial reasons, from Bill. No. 20-100 regarding changing the zoning of property located at 900 South Kingshighway, due to his employment with MRV Bank. BILL NO. 20-99 will be Ordinance No. 5309; BILL NO. 20-100 will be Ordinance No. 5310; BILL NO. 20-101 will be Ordinance No. 5311; BILL NO. 20-102 will be Ordinance No. 5312; BILL NO. 20-103 will be Ordinance No. 5313; BILL NO. 20-104 will be Ordinance No. 5314; and BILL NO. 20-107 will be Ordinance No. 5315. BILL NO. 20-110, an Ordinance authorizing the issuance of Special Tax Bills on certain properties for the demolition of dangerous buildings and for nuisance abatements under the Proceedings of the City Council, City of Cape Girardeau Mo. Reg lar July 20, 2020 kK-391 Session provisions of Chapter 7 and Chapter 13 of the Code of Ordinances of the City of Cape Girardeau, Missouri. First Reading. 0 A Motion was made by Dan Presson, Seconded by Nate Thomas,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore,Presson, Thomas, Truxel. Council Member Stacy Kinder asked about the dangerous building condemnation process, and staff gave her a summary of the procedure. BILL NO. 20-111, an Ordinance appropriating funds for operating expenditures, capital expenditures, debt service expenditures, and transfers for the fiscal year ending June 30, 2020, in the City of Cape Girardeau,Missouri. First Reading. City Manager Scott Meyer explained that this is an annual process to balance the books at the end of the fiscal year. Revenue from grants and other sources is moved to appropriate funds for those expenses,and also to cover for unforeseen expenses. A Motion was made by Robbie Guard, Seconded by Shannon Truxel,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore,Presson,Thomas, Truxel. BILL NO. 20-112, an Ordinance approving a Redevelopment Agreement in Connection with the North Middle/Broadway Area Tax Increment Financing Redevelopment Plan. First Reading. A Motion was made by Robbie Guard, Seconded by Shannon Truxel,to approve. Motion passed. 7-0. Ayes: Fox,Guard,Kinder,Moore,Presson,Thomas,Truxel. BILL NO. 20-113, an Ordinance designating a portion of the City of Cape Girardeau, Missouri, as a Redevelopment Area; approving North Middle/Broadway Tax Increment Financing Redevelopment Plan; making findings related thereto; and authorizing certain actions by City Officials. First Reading. A Motion was made by Nate Thomas, Seconded by Dan Presson,to approve. Motion passed. 7-0. Ayes: Fox, Guard,Kinder,Moore,Presson, Thomas, Truxel.
