Regular Session May 4, 2020 KK -367 STUDY SESSION — May 4, 2020 NO ACTION TAKEN DURING THE STUDY SESSION Michael L. Parson, Governor of the State of Missouri, as authorized by the Constitution and the laws of the State of Missouri, including Sections 44.100 and 44.110, RSMo, declared that a State of Emergency exists in the State of Missouri. In accordance with that declaration, and pursuant to Sections 610.010 and 610.015, RSMo, the Cape Girardeau City Council held a study session at the Cape Girardeau City Hall Monday, May 4, 2020, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Ryan Essex, Robbie Guard, Stacy Kinder, Shelly Moore, Dan Presson, and Nate Thomas present via Internet videoconferencing (Zoom.us). REGULAR SESSION — May 4, 2020 CALL TO ORDER In further accordance with the Governor's Declaration, the Cape Girardeau City Council convened in regular session on Monday, May 4, 2020, at 6:11 p.m. via internet videoconference pursuant to Sections 610.010 and 610.015, RSMo. with Mayor Bob Fox presiding and Council Members Ryan Essex, Robbie Guard, Stacy Kinder, Shelly Moore, Dan Presson, and Nate Thomas participating via internet videoconference (Zoom.us). The votes taken shall be regarded as if all members were physically present and in attendance at the meeting. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Shelly Moore, to adopt the Agenda. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas. APPEARANCES None. CONSENT AGENDA Approval of the April 20, 2020, City Council regular minutes BILL NO. 20-59, an Ordinance approving the record plat of Rock Gardens Second Subdivision. Second and Third Readings. BILL NO. 20-60, an Ordinance approving the record plat of Rock Gardens Third Subdivision. Second and Third Readings. BILL NO. 20-61, an Ordinance approving the record plat of The Rialto. Second and Third Readings. BILL NO. 20-62, an Ordinance authorizing the City Manager to execute Supplemental Agreement No. 1 with the Missouri Highways and Transportation Commission to fund the promotion of scheduled Passenger Air Service at the Cape Girardeau Regional Airport. Regular Session ay 4, 202 KK -368 BILL NO. 20-66, a resolution authorizing the City Manager to Execute an Aviation Project Consultant Agreement with Crawford, Murphy and Tilly, Inc., for the New Passenger Facility Charge Program, at the Cape Girardeau Regional Airport. Accept Improvements and Authorize Final Payment to KT Power Systems, Inc., for the Water Treatment Plant No. 1 Automatic Transfer Switch Replacement Project. Acceptance of public improvements to serve Liberty Apartments. Approval of the Release of Performance Guarantee Agreement for Liberty Subdivision. A Motion was made by Robbie Guard, Seconded by Nate Thomas, to approve and adopt. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas, BILL NO. 20-59 will be Ordinance No. 5281; BILL NO. 20-60 will be Ordinance No. 5282; BILL NO. 20-61 will be Ordinance No. 5283; BILL NO. 20-62 will be Ordinance No. 5284; and BILL NO. 20-66 will be Resolution No. 3341. NEW ORDINANCES BILL NO. 20-67, an Ordinance annexing unincorporated land into the city limits of the City of Cape Girardeau, Missouri, located north of LaSalle Avenue and east of Baldwin Drive, upon the request of The Amendment and Restatement of the Ryland R. Meyr Voluntary Trust Agreement of December 29, 2006. First Reading. A Motion was made by Robbie Guard, Seconded by Dan Presson, to approve. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas. BILL NO. 20-68, an Ordinance extending the boundaries of Ward 4 to include property newly annexed into the City Limits of the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Robbie Guard, Seconded by Nate Thomas, to approve. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas. BILL NO. 20-69, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by zoning newly annexed property located north of LaSalle Avenue and east of Baldwin Drive, as R-1, Single -Family Suburban Residential District. First Reading. A Motion was made by Dan Presson, Seconded by Robbie Guard, to approve. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas. BILL NO. 20-70, an Ordinance authorizing the Mayor to execute a Permanent Utility Easement on behalf of the City of Cape Girardeau to Union Electric d/b/a Ameren Missouri, for property located at 3099 South Sprigg Street, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Nate Thomas, Seconded by Dan Presson, to approve. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas. Regular Session May 4, 2020 KK -369 APPOINTMENTS Appointments to the Downtown Cape Girardeau Community Improvement District Board of Directors A Motion was made by Dan Presson, Seconded by Nate Thomas, to confirm Mayor Bob Fox's appointments to the Downtown Cape Girardeau Community Improvement District Board of Directors. Mayor Fox appointed Laurie Everett, effective November 12, 2018, to fill the remaining unexpired term of Sheila Sailer, who had resigned from the CID Board, and appointed Laurie Everett, Kent Zickfield, and Lee Schlitt for terms expiring May 16, 2024. Motion passed. 7-0. Ayes: Essex, Fox, Guard, Kinder, Moore, Presson, Thomas. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Nate Thomas, to adjourn. Motion passed. 7-0.
