Regular Session June 1, 202 KK-375 STUDY SESSION—June 1,2020 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday,June 1, 2020, starting at 5:00 p.m. with Mayor Bob Fox presiding and Council Members Ryan Essex, Robbie Guard, Stacy Kinder, Dan Presson, and Nate Thomas present. Shelly Moore was absent. REGULAR SESSION—June 1,2020 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, June 1, 2020, at 5:50 p.m., with Mayor Bob Fox presiding and Council Members Ryan Essex, Robbie Guard, Stacy Kinder, Dan Presson, and Nate Thomas present. Shelly Moore was absent. ADOPTION OF THE AGENDA A Motion was made by Robbie Guard, Seconded by Dan Presson, to adopt the Agenda. Motion passed. 6-0. Ayes: Essex, Fox, Guard, Kinder, Presson, Thomas. Absent: Moore. PUBLIC HEARINGS A Public Hearing to consider the proposed annual operating budget for the City of Cape Girardeau, Missouri, for the fiscal year beginning July 1, 2020. Mayor Bob Fox opened the public hearing. There being no appearances the public hearing was closed. A Public Hearing to consider a request to rezone property at 305, 307, and 309 North Frederick Street from RUMD (Residential Urban Mixed Density District) to NC (Neighborhood Commercial District) Mayor Bob Fox opened the public hearing. There being no appearances the public hearing was closed. A Public Hearing to consider a request to rezone property at the southeast corner of North Middle Street and Bellevue Street from RUMD(Residential Urban Mixed Density District)to CBD-DCC (Central Business District with Downtown Commercial Corridor Overlay). Mayor Bob Fox opened the public hearing. There being no appearances the public hearing was closed. A Public Hearing to consider a proposed amendment to Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, regarding CBD, Central Business District. BILL NO. 20-77, an Ordinance vacating the City's interest in unimproved right-of-way located at Collins Street and Hunze Drive, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 20-81, an Ordinance vacating the City's interest in the Utility Easement between 6022 and 6030 Cardrona Drive, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 20-71, an Ordinance vacating the City's interest in part of an unimproved alley right- of-way behind 621 and 623 Perry Avenue, in the City of Cape Girardeau, Missouri. BILL NO. 20-90, A Resolution authorizing the City Manager to execute a Performance Guarantee Agreement with Meyr Properties, L.P., for Baldwin Place Phase III, in the City of Cape Girardeau, Missouri. BILL NO. 20-95, a Resolution authorizing the City Manager to participate in the Fiscal Year 2020 Emergency Management Performance Grant program and accept the awarded funds as administered by the State Emergency Management Agency and funded by the Federal Emergency Management Agency, in the City of Cape Girardeau, Missouri. Regular Session June 1, 2020 KK-377 ITEMS REMOVED FROM CONSENT AGENDA BILL NO. 20-83, an Ordinance adopting the annual operating budget for the City of Cape Girardeau, Missouri, for the fiscal year beginning July 1, 2020. Second and Third Readings. A Motion was made by Robbie Guard, Seconded by Dan Presson, to amend the Ordinance as requested by staff to include a fifty cent increase to the Special Wednesday Pickup Fee, and Private Hauler Waste Disposal Fee Increases that includes a new $100 after hours dumping fee and a per gallon increase from $.07 to $.33, and to approve and adopt as amended. Motion passed. 6-0. Ayes: Essex, Fox, Guard, Kinder, Presson, Thomas. Absent: Moore. BILL NO. 20-83 will be Ordinance 5297. NEW ORDINANCES BILL NO. 20-86, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 305, 307, and 309 North Frederick Street, in the City and County of Cape Girardeau, Missouri, from RUMD to NC. APPOINTMENTS Appointment to the Board of Appeals A Motion was made by Ryan Essex, Seconded by Dan Presson to appoint Craig Milde to the Board of Appeals, for a terms expiring June 4, 2025. Motion passed. 6-0. Ayes: Essex, Fox, Guard, Kinder, Presson, Thomas. Absent: Moore. Appointment to the Downtown Cape Girardeau Community Improvement District Board of Directors. A Motion was made by Robbie Guard, Seconded by Nate Thomas, to confirm Mayor Bob Fox's appointments to the Downtown Cape Girardeau Community Improvement District Board of Directors. Mayor Fox appointed Nate Saverino for a term expiring May 16, 2024. Mayor Fox read a letter from Bruce Skinner the Board's form president concerning application process for the Downtown Cape Girardeau Community Improvement District Board of Directors. OTHER BUSINESS Motion to set a Special City Council Meeting to declare the results of the June 2,2020, municipal election. A Motion was made by Dan Presson, Seconded by Nate Thomas, to set a Special Meeting following the municipal election for Friday,June 5, 4:30 p.m. Motion passed. 6-0.
