impressed with the support of other agencies in the community. She commended Steve Williams
of the Planning Services Office for his work on this project.

CITY MANAGER COMMUNICATION
City Manager Doug Leslie introduced Bill Burke of Arcturis who is working on a Comprehensive
Plan for the City. Mr. Burke reported on the status of the process. His firm is developing a citizen
based, citizen driven plan. They engaged the public by receiving input through community
surveys, focus.group sessions and town planning workshops. Upcoming issues that will need to be
addressed are development to the north and west and its impact on the infrastructure, annexation,
school district boundaries, downtown development, parks and trails. The Parks Master Plan has
identified major projects, and citizens see these as quality of life issues to bring community groups
together. Communities across the country are investing in quality of life issues and are attracting

new businesses and families. Mr. Burke discussed the next steps and the continuing processes
involved in the comp plan and implementation. He believes from public input that parks
improvements are wanted as well as other quality of life issues.
PUBLIC HEARINGS
This being the date set for a public hearing to discuss the past performance of the City in carrying
out the Grow Missouri Loan Fund Program, a multi jurisdictional program on behalf of the Delta
Region to provide seed money to be used by small business operators to retain and create jobs and
stimulate investment, the hearing was opened. Mr. Steve Williams of Planning Services appeared
and explained that the City of Cape Girardeau is the grantee for the Grow Missouri Loan Fund
Program to provide seed money to be used by small business operators to retain and create jobs
and stimulate investment. The five Regional Planning Commissions in the Delta Region are the
sub-grantees. The Delta Region includes the SEMO Regional Planning Commission, Bootheel
Regional Planning Commission, Ozark Foothills Regional Planning Commission, South Central
Ozark Council of Governments and the Meramec Regional Planning Commission. Each Regional
Planning Commission received seed money for their loan fund program in the amount of
$100,000. Eleven loans were made by the Commissions totaling $500,000. Twenty-seven jobs
were created or retained and 21 of these jobs were low to moderate income (78%). Mr. Williams
asked if anyone had comments to please come forward. He explained this will finalize the
closeout of the program.
Mrs. Schneider asked how people applied for these loans and the amount of the average loan. Mr.
Williams explained that all applicants applied through the Regional Planning Commissions and
each handled their own loans. The loans made ranged for $8,000 to $100,000. There being no
further appearances,the hearing was closed.
This being the date set for a public hearing to consider the request of Jerry and Carol McGuire for
a Special Use Permit to construct and operate a wedding chapel and banquet hall on an existing
vacant lot in the 1900 block of North Sprigg Street, on the west side of the street, between
Lexington Avenue and Bertling Street, within an R-2, Single-Family Residential District, the
hearing was opened. The City Planner's Council Letter in the agenda packet presented for the
record a certified copy of the following items: (1) Section 30-39 entitled "Special Use
Regulations" from the City Code; (2)the application for special use permit; and(3)the application
file.
Mr. Jerry McGuire and Mrs. Carol McGuire appeared stating they had appeared before the
Planning and Zoning in March and did not present enough information. They are proposing to
construct a banquet hall and chapel at the property next to the new fire station on Sprigg Street.
The property is 11.76 acres, and they are requesting a special use permit on three acres. They are
willing to change the location to the property behind the fire station to get it away from the
residents across the street. Mr. McGuire stated he allowed the fire station to put a detention basin
on their property and allowed the City to use their land during construction. He is requesting the
special use permit for whichever area of their property would be most acceptable to the Council.
In addition, he explained that he plans to build his home on this land and will be able to monitor
the area. He does not intend to rent the facility for any college activities.
Mayor Knudtson stated that the Planning and Zoning Commission unanimously recommended to
deny the issue. Ms. Schneider stated if the location is being changed then maybe the application
should be returned to the Commission for reconsideration.

Proceedings of the City Council, City of Cape Girardeau, Mo.
Regular Session May 7,2007 FF-291
FOOF4)0,Q7nW
Mr. Daryl Morgan, a resident of Forest Hills Subdivision, appeared on behalf of 11 residents in the
subdivision and expressed their opposition to this request. He stated the residents feel it is a good
idea but just in the wrong location. They are worried about increased noise, traffic, littering and
other nuisances,as well as the type of people who will rent the facility.
Mr. Richard Renfrow appeared and explained this property adjoins his family farm property. This
hall is a commercial operation in a nice residential area. He feels it is not in the best interest of the
neighborhood to put any type of commercial use in the area.
Mr. Bob Myer appeared in support of the request for the banquet hall. Mr. Myer and his wife are
partners with Mr. and Mrs. McGuire. They do not plan to apply for a liquor license and will
discourage the use of alcohol on the premises. They will personally manage all activities at the
chapel and banquet hall to maintain it in an orderly fashion in a residential area. They plan to
make this a secluded quiet, area.
Mr. Basil Harrison appeared in opposition to the location of the chapel in a residential area and
was concerned with added traffic and trash.
There being no further appearances, the hearing was closed.
BILL NO 07-78 was given first reading as follows:
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO JERRY MCGUIRE AND
CAROL MCGUIRE FOR PURPOSES OF CONSTRUCTING, MAINTAINING AND
OPERATING A WEDDING CHAPEL AND BANQUET HALL IN THE 1900 BLOCK OF
NORTH SPRIGG STREET, IN THE CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI
Mr. Herbst made a motion, seconded by Mr. Hopkins, to approve the first reading of BILL NO.
07-78. Following discussion by the Council, the motion failed upon the following vote: Ayes,
none. Nays, Herbst,Hopkins,Knudtson,Ritter, Schneider, Tracy and Voss.
Mr. Hopkins made a motion, second by Mr. Herbst, to adopt the findings and conclusions stating
the basis for denial of this request. The motion was approved upon the following vote: Ayes,
Herbst,Hopkins, Knudtson, Ritter, Schneider, Tracy and Voss. Nays, none.
This being the date set for a public hearing to consider the request of Palmer& Palmer, LLC, for a
Special Use Permit to construct a 26-unit senior citizen housing project at 1400 West Cape Rock
Drive, at the northwest corner of West Cape Rock Drive and Lexington Avenue, within an R-4,
Multi-Family Residential District, the hearing was opened.
Mr. Jeff Jackson appeared in support of the request and to answer questions. He explained it was
the suggestion of staff to bring this proposal to the Council to designate it as senior housing, even
though a special use permit is not necessary to build an apartment at this location.
Mr. Basil Harrison, 1530 Oak Lei Drive, appeared and stated he owns property across the street. It
is his understanding that this will be public housing. While he does agree with having an
apartment at this location,he opposes public housing due to problems it typically has.
Proceedings of the City Council, City of Cape Girardeau, Mo.
Regulai Session May 7, 2007 X92

Mrs. Jeanie Asher of Amblewood Drive asked for clarification if this proposed housing would be
subsidized by the government. She expressed opposition to any type of public funding for this
housing project.
Mr. Richard Renfrow asked if there was any way to clarify whether public funding would be
involved before the City Council votes on the issue. He stated if Mr. Jackson could sign a written
statement that he would not request government subsidy, this would satisfy the neighbors.
Mr. Jackson stated there is no mention of public housing or any type of public assistance in his
proposal. He would simply like to build affordable housing for senior citizens. He plans to have
an on-site manager and all units will be handicap accessible. He will not do anything questionable
or substandard. The neighbors originally had concerns with storm water issues, and he will strictly
follow all engineering requirements.
Mayor Knudtson stated that the Council cannot deny this request based on whether there is public
funding for the project.
Ms. Ritter questioned if there was anyone present who lives within 185' of this property. Mayor
Knudtson stated Mr. Harrison has adjoining property but no one else present does. The Mayor
explained that Mr. Jackson does not need a special use permit to build apartments on this property.
Mr. Jackson has stated he has no intentions of putting in public housing.
There being no further appearances, the hearing was closed.
BILL NO 07-79 was given first reading as follows:
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO PALMER AND PALMER,
LLC, FOR PURPOSES OF CONSTRUCTING, MAINTAINING AND OPERATING A
SENIOR CITIZEN HOUSING PROJECT AT 1400 WEST CAPE ROCK DRIVE, IN THE CITY
AND COUNTY OF CAPE GIRARDEAU, MISSOURI
Mr. Voss made a motion, seconded by Mr. Hopkins, to approve the first reading of BILL NO. 07-
79. Following comments by Council members, the motion was approved upon the following vote:
Ayes, Herbst, Hopkins,Knudtson, Ritter, Tracy and Voss. Nays, Schneider.
APPEARANCES
Mr. Chris Koehler appeared on behalf of Chad Hartle in support of the preliminary plat of
Victorian Estates. This property is at the end of North Clark Street. He wants to proceed with the
development and is asking that the plat be renewed as is. The plat is for single family homes at
this time. If anything other than that is done, it will be necessary to get approval by the Planning
and Zoning Commission and the City Council.
Mrs. Tracy made a motion, seconded by Mrs. Schneider, to renew the approval of the preliminary
plat of a Replat of Victorian Estates. The motion was approved upon the following vote: Ayes,
Herbst, Hopkins, Knudtson,Ritter, Schneider,Tracy and Voss. Nays, none.
Mr. Felix Kinsley appeared to endorse the transit bus system. In addition, he felt the Council
made the right decision at the last meeting regarding the Community Counseling Center based on
the information it had. However, he is familiar with people with mental disabilities, and he is not
afraid of them.
Proceedings of the City Council, City of Cape Girardeau, Mo.
Regular Session May 7,2007 FF-293
C806001070W
Mrs. Erin Venable, wife of Cape Firefighter Chris Venable, appeared in opposition to the changes
in sick and vacation leave accrual for new fireman effective October, 2006. She requested the
Council reinstate all leave time accruals retroactive to August 2006.
Mayor Knudtson stated there is a process in the City that is defined by the City Charter to address
these issues. The City Administration came to the conclusion that this was the right thing to do and
the Council supports the decision.
' Rev. Cecil Thomas of the Second Missionary Baptist Church on Beaudean Lane shared with the
Council a list of issues on the south side of Cape that have been discussed by his church. He
organized the Pastors Coalition Committee and over 100 attended. He expressed concerns with
the appearance of the walking bridge over highway 74, additional lighting needed on Elm Street
near the church, the roughness of Sprigg Street, vacant lots that need the grass cut, and houses
with broken windows. Rev. Thomas stated he would like to ride along with a city employee and
show them the properties that need attention.
Mr. Herbst explained that the pedestrian bridge is made of a material that is designed not to be
painted to maintain the integrity of the structure, and the bridge is owned by the Missouri
Department of Transportation. Mr. Herbst stated he would like to see a welcome to Cape sign on
the bridge or to name the highway and put up a sign. He has been in contact with a State
Representative about this issue.
Mr. Richard Renfrow appeared and questioned whether the adjoining property owners are notified
by mail when a request has been made to rezone a particular tract of land. City Manager stated
