Nays, none. BILL NO. 06-165 is RESOLUTION NO. 2207. City Manager Doug Leslie stated that the public hearing will be held at the Council Meeting on September 5, 2006. The ordinance approving the annexation will be presented to the Council in October and be effective on November 3. Mr. Felix Kinsley, 225 N. Sprigg, appeared and spoke in support of the new bus service in the City. Ms. Hannah Conger, 836 N. Sprigg, appeared regarding the House Party Bar on North Sprigg Street. During the last school year at Semo, Wednesday night parties were very unruly, and she is concerned with the safety of patrons and residents. In addition, last May several hundred people were on the parking lot when fighting broke out and a gun was discharged. There needs to be more patrol in this area on Wednesday evenings. Mr. Leslie explained there were issues last year with this bar. The Police Department has met with the owner and put him on notice for activities for this coming year. Police Chief Carl Kinnison continued that he has personally spoken to the owner about security measures to reduce problems. The owner has responded to the concerns and has placed 10-12 security guards on the parking lot. In addition, the Police Department sends several officers to this location in the early morning hours on Thursdays. Mr. Rick Bond, 1611 Price Drive, appeared and stated he owns a restaurant at 435 Morgan Oak. He wants to sell his food from a mobile restaurant, and the city has issued him a business license. However, he was told that he can't sell food on city property, but he can sell on private property with the permission of the owner. He said these requirements are in the City Code from 1967, and he feels this is out of date. Mr. James Green was also present regarding this issue. Mr. Bond presented a copy of Section 15-15 of the City Code and expressed concerns that our city ordinances relating to mobile businesses conflict. There is an ice cream truck that sells goods on city streets, and there is a man that sells watermelons at Rhodes every day. Mr. Bond requested he be allowed to sell food from his trucks the same as other vendors. He wants to use his truck to sell his food on the street and in the parks, and he would be willing to pay any fees. He also said he had been approved by the County Health Department. Mr. Bond stated he had permission to set up in the parking lot of Cape Club Complex and the White House Bar parking lot, but he wants permission to park on the street to sell his food. Mr. Leslie stated the business license does authorize him to sell food on private property but not on public property. Mr. Bond was informed he could sell on parking lots where he has permission of the owner, but to park on city streets or in a public park and sell goods is not allowed under the City ordinances. This ordinance is enforced if the vendor does not have permission to sell on the property. The difference between Mr. Bond's truck and the roaming ice cream truck is that the ice cream truck is not parking and establishing a business. There is a simple transaction and then the vehicle moves on. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 7, 2006 FF 130 EUU6UUIU/UW City Attorney Eric Cunningham explained that Section 15-15 of the City Code makes it clear that a person can sell goods on private property, but only if he has the permission of the property owner. Mayor Knudtson stated he can understand why some business owners do not want Mr. Bond parked in front of their businesses. He said the act of selling in the parks seems grey because some vendors have paid a fee to sell during a specific event. The only valid complaint by Mr. Bond is the ice cream truck that has parked in a location. The City allows it to be mobile, but if it is in a location that it is not wanted, then the police ask them to move on. That is the same thing that happened to Mr. Bond. The only time they are being asked to move is when they receive a complaint. Mrs. Tracy stated she did not see a discrepancy in the ordinance regarding selling on private property, but there may be a valid complaint about the ice cream truck selling on the street and in the parks. She asked Mr. Bond if he had ever asked anyone for permission to sell on private property. He responded that his license says it is for a mobile enterprise and he wants to sell his food on public property. Upon questioning by Ms. Ritter, Mr. Leslie explained that it is not unusual to have an ordinance from 1967 that is still in effect. Many of the City ordinances are direct copies of state statutes. Mr. Green stated there are many mobile sandwich trucks in St. Louis and Jefferson City, and they should be allowed in Cape Girardeau. Mayor Knudtson stated this will be reviewed by City staff. Mr. Bond read letters of recommendation from several other cities supporting his sales activities. Mr. Don Howard appeared regarding the sign ordinance. He stated he does not hold the Police at fault for enforcement of the ordinance, but stated there are more important issues in Cape that the Police need to address. If one ordinance is going to be enforced, then the City needs to enforce them all. Mr. Howard stated that his son was on South Lotus Street and an officer took up a ten commandment sign and gave it back to the owner. We need more signs like that, and it doesn't matter if they are on public or private property. Mr. Howard also expressed his opposition to the Proposition 1 tax proposed by the Cape County Commission. Mr. Jeff Robinson of Cape Club Complex appeared and stated that on one occasion Mr. Bond parked his truck on the street in front of his business on South Spanish and asked him to use his electricity. He did allow it for one night. The second night Mr. Bond came back; however,he did not give Mr. Bond permission to be there and he asked them to leave. Mr. Harlan Smothers appeared regarding the City's sign ordinance. He owns an estate liquidation business. The police are taking his signs, and he doesn't know how to direct people to his sales. He runs an ad in the paper and gets good up front business, but it is difficult to get people to his sales when they are in remote locations. Mayor Knudtson stated the Council is looking to make some changes in the sign ordinance on directional signs. However, signs cannot be put on street right of way. Mr. Cunningham stated the definition of garage sale in the ordinance is broad enough to include estate sales, but the ordinance still does not allow placement of signs on public property. Mayor Knudtson discussed the proposed changes to the sign ordinance as presented in the Council letter. These are based on comments received by the Council, staff and a request from the Chamber of Commerce. The issues being considered are: (1) businesses located in commercial and manufacturing zoning districts would be allowed to display one banner sign on an exterior Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 7, 2006 FF-131 cOn600+O7nw wall or support structure of their building on a temporary basis; (2)no temporary sings would need a permit, except for portable signs; (3)residential properties would be allowed two on-premise real estate sings in order to accommodate "dot.com" signs; (4) up to four off-premise directional signs for garage sales would.be allowed; and (5) non-profit institutions would be allowed to display flags from light posts. The Chamber has requested that banner signs on commercial businesses be allowed. The Council discussed issues relating to each of these recommended changes and comments and concerns they have received from citizens. The Mayor requested the Council reconsider the original intent of the sign ordinance. The current ordinance is confusing and difficult to understand. Following additional discussion, the Council assigned BILL NO. 06-178 to the proposed sign ordinance and requested first reading as follows: AN ORDINANCE AMENDING SECTION 30-42 OF CHAPTER 30 OF THE CITY CODE RELATING TO SIGNS Mr. Voss made a motion, seconded by Mrs. Tracy, to approve the first reading of BILL NO. 06- 178. Mr. Hopkins made an amending motion, seconded by Mrs. Tracey, to remove from the ordinance proposed changes numbered 3 and 4 as follows: (3) residential properties would be allowed two on-premise real estate sings in order to accommodate "dot.com" signs; (4) up to four off-premise directional signs for garage sales would be allowed. The amending motion was approved upon the following vote: Herbst, Hopkins, Knudtson, Ritter, Tracy and Voss. Nays, none. The original ordinance was approved as amended upon the following vote: Herbst, Hopkins, Knudtson, Ritter, Tracy and Voss. Nays, none. Mayor Knudtson told Mr. Smothers he could place signs for his upcoming estate sale on private property. Mayor Knudtson directed staff to place proposed changes 3 and 4 on the next agenda for discussion.
