APPEARANCES
Mr. Mike York, 903 Perry, appeared in opposition to a resolution authorizing the City Manager to
execute a License and Indemnity Agreement with Kenneth and Jane Windisch for improvements
on an alley right-of-way near his home. This alley is behind his home and is presently an
unimproved, grassy area. He doesn't want traffic in his back yard in this alley. The water from this
area runs downhill to Harry McDaniel's house at 1717 New Madrid. Mr. McDaniel appeared and
stated that he doesn't feel the gravel will stay in the alley and will wash down to his property. Mr.
Kenny Windisch appeared and explained that he wanted to open the alley to allow off street
parking behind his home. He doesn't feel it is safe to park on Perry Ave because the road is too
narrow. He was not aware that the neighbors opposed his request. Mayor Knudtson stated the
Council does have concerns with opening the alley.
BILL NO. 06-67 was presented as follows:
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AND
INDEMNITY AGREEMENT WITH THE KENNETH O. AND JANE E. WINDISCH TRUST

Mrs. Boardman made a motion, seconded by Mrs. Tracy to approve the reading of BILL NO. 06-
67 and adopt the resolution. Mrs. Tracy, Mrs. Schneider and Ms. Ritter expressed concerns with
opening this alley right-of-way, the ability to maintain it, and the effect it would have on
surrounding property owners. City Engineer Jay Stencel stated that this alley has a six percent
slope, and the alley way will move with rain. Following discussion, the motion failed upon the
following vote: Nays, Boardman, Herbst, Hopkins, Knudtson, Ritter, Schneider and Tracy. Ayes,
none.
Mr. Dru Reeves of Horizon Screen Printing appeared and expressed opposition to the proposed
sign ordinance, especially relating to banners. He reviewed the cost of signs versus banners. The
ordinance prohibits banners for special events, and restaurants will not be able to use banners for
advertising. He expressed concern with election signs, real estate signs and open house signs.
Mayor Knudtson explained that political signs are covered by the constitution and the City cannot
regulate these on private property. He reviewed the intent of the ordinance, regulations for real
estate signs, issues relating to signs for not-for-profit agencies, and enforcement of the ordinance
relating to city right-of-way. Real estate agents and larger sign companies have been involved in
the review process, and additional information letters were sent out last week.
Ms. Ann Foust with Cape County Master Gardeners appeared and expressed concerns that service
clubs would not be able to use banners and sandwich boards to advertise their special events.
Mayor Knudtson stated the staff prepared proposed language to address temporary signs relating to
not-for-profit organizations. The proposed change will allow a private property owner to place one
sign in their yard for a not-for-profit event.
BILL NO. 06-43 was given the second reading as follows:
AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY CODE RELATING TO SIGNS
Mr. Hopkins made a motion, seconded by Mrs. Boardman to approve the second reading of BILL
NO. 06-43. Mrs. Tracy made a motion, seconded by Mr. Herbst to amend the ordinance to include
the following language as Section 30-42(f)(10)f.: "Signs advertising an event sponsored by or
held by an institution or non-profit organization whose purpose is to further public welfare or
education in all zones, but limited to one sign per lot, with the owners permission, and not
exceeding three (3) feet in height and ten (10) square feet in area. Such signs shall not contain
commercial advertising and shall not be placed for more than thirty(30) days before the event and
shall be removed immediately after the event." The amending motion was approved on the
following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Ritter, Schneider and Tracy. Nays,
none. The original motion was approved as amended upon the following vote: Ayes, Boardman,
Herbst, Hopkins, Knudtson,Ritter, Schneider and Tracy. Nays, none.
Following discussion by the Council, Mayor Knudtson requested staff prepare language for the
proposed ordinance to allow schools, churches and other not-for-profit agencies to use banners.

days after that. Mrs. Schneider requested that when the ordinance is finally approved, the staff
prepare a brochure to inform the public of the changes.

Mr. James Cannon, 914 Jefferson, appeared regarding the CDBG program. City staff spoke with
people in this area over two years ago, and still nothing has been done for Jefferson Street or the
target area. A grant was awarded and ten houses have been rehabilitated on Pacific and
Bloomfield but none in the Jefferson Street area. The neighbors have done everything they were
told to do and nothing has been done. Mayor Knudtson explained that as soon as Steve Williams
of the Planning Services Office returns from medical leave, staff will follow-up on the
circumstances and address the concerns.
Mr. James Harris, 318 Middle, appeared regarding the proposed ordinance establishing two hour
parking on a portion of Bellevue Street. Many people who live in apartments in this area do not
have enough off-street parking, and he requested the parking be left as is. Parking should not
changed to accommodate one business when he operates 66 rental units in this area.
Ms. Vickie Thomas, 331 Bellevue, appeared and expressed her support for the two-hour parking
on Bellevue. The only place her clients can park is directly in front of the business and the tenants
of Mr. Harris' buildings park in front of her business. Ms. Thomas presented pictures of the
parking areas and signatures of surrounding property owners supporting her request.
Mayor Knudtson explained that the proposed two-hour parking is only from 8 a.m. to 5 p.m. on
weekdays. The Council discussed parking in this area, as well as issues with other two-hour
parking locations in the city.
