COUNCIL COMMUNICATIONS Upon questioning by Mrs. Schneider, City Manager Doug Leslie presented an update on the Lexington Trace sidewalk/trail project. It is anticipated that the project will be completed in the next 45 days. The City is working with the contractor to clean up yards where a sidewalk has already been poured. Ms. Ritter questioned why there were fireworks in the center part of town late Sunday Evening. Police Chief Steve Strong stated he was unaware of any fireworks; however, Mr. Hopkins commented that they could have been from the Rodeo at Arena Park. Mayor Knudtson announced that last week the City held a ceremony in Arena Park to kick off the new storm siren program. He thanked the Fair Board for funding the cost of this siren. Mr. Leslie continued that the purpose of a siren program is to warn people of inclement weather who are involved in outdoor activities and are not near a radio or television. The City is continuing to work to put sirens in other park areas, including Shawnee and Kiwanis Parks. CITY MANAGER'S COMMUNICATIONS Mr. Leslie introduced Josh Richardson as the new City Engineer and welcomed him to Cape Girardeau. He expressed appreciation to Tim Gramling and Abdul Alkadry for filling in during the interim period. PUBLIC HEARINGS This being the date set for a public hearing to receive input regarding the construction of a cul-de- sac at 2404 Kingsway Drive and the construction of a right turn lane on Kingshighway at Cape Rock Drive, the hearing was opened. Mr. Larry Clare, Executive Director of St. Andrew Lutheran Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session May 16, 2005 220 Church, appeared on behalf of the Board of Directors to express support for the cul-de-sac and the right turn lane in this area. This project will insure a safe entrance to this property for the church. Mr. Tim Gramling, Interim City Engineer, reviewed the improvements to be completed under this project. The City will construct a right turn lane northbound on Kingshighway at Cape Rock Drive. Kingsway Drive will be closed and a cul-de-sac constructed. The project should be completed in the summer to early fall. The cost of the cul-de-sac is $35,000 and the cost of the right turn lane, approximately $51,000, will be reimbursed to the City by MoDOT. A neighborhood meeting was held at the Osage Centre, and letters were sent to all residents and businesses in the area notifying them of this hearing. There being no further appearances, the hearing was closed. APPEARANCES Mr. Chris Hutson, 1014 North Henderson, appeared regarding item number 31 on the agenda and requested the Council to consider the action of the Planning and Zoning Commission which recommended denial of the request. A motion was made by Mrs. Tracy, seconded by Mr. Herbst, to file the Planning and Zoning Commission's recommendation regarding the request of Victor and Dee Gummersheimer and Cape Girardeau Baptist Association for a special use permit for an administrative facility for the Baptist Collegiate Ministries at 1016 North Henderson Avenue (rear) in an R-2, Single Family Residential District. The motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Ritter, Schneider and Tracy. Nays, none. Mr. Scott Browning, 724 Watkins, appeared in support of the Planning and Zoning Commission's recommendation to deny the request of Stacy Lange for a special use permit for a daycare for up to eight children with one assistant at 733 Watkins Drive in an R-4, Multi-Family Residential District. Ms. Stacy Lange appeared in support of her request for a daycare at 733 Watkins Drive. She stated that this will be a home daycare. She explained that she could rent the home and care for her three children as well as four other children under State law without a permit from the City. Mayor Knudtson responded that on June 6 the Council could have a Public Hearing to consider this request. Ms. Lange can present her information at that time, and others will be allowed to appear in support of or in opposition to the request. Ms. Lange requested that a public hearing be held at that time. A motion was made by Ms. Ritter, seconded by Mrs. Schneider to set a public hearing for June 6 to consider the request of Stacy Lange for a special use permit for daycare for up to eight (8) children with one assistant at 733 Watkins Drive in an R-4, Multi-Family Residential District. The motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Ritter, Schneider and Tracy. Nays, none. Mr. Ed Proffer appeared regarding the request for a three-way stop at the intersection of Kurre Lane, Rampart and Melrose. Mr. Proffer stated he was told by the Engineering that a warning sign and radar could be put up in this area; however, he felt none of these efforts will slow down the traffic. When cars come over the hill, the people are driving too fast off Rampart, missing the curve and driving into the yards. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session May 16,2005 -221— Mayor Knudtson stated the staff does not feel a three-way stop will address the speed problem, but enforcement efforts would. Mr. Leslie reviewed the accident history and traffic study for the speed of the traffic in this area. New technology is available to allow a unit to be added to the top of Ei speed limit signs which shows how fast a car is traveling. This, along with increased traffic enforcement, he felt would address the speed problem. Mayor Knudtson asked the staff to give a copy of this research to Mr. Proffer. Mr. Hopkins stated the City previously completed a study of the traffic at the intersection of Hopper and Mt Auburn, and the speed study did not show a need for a four-way stop. However, the City put one in anyway. Mr. Hopkins questioned what information is included in the report and how it compares to the current situation. The City must take into account that almost 100 percent of the residents want a sign put in. Ms. Tracy questioned if the speed limit can be lowered. Mr. Leslie explained that the present limit is 30 mph and the 80th percentile speed is 38. Mayor Knudtson asked if Mr. Proffer was willing to try these two efforts. If they do not help, then he can come back to the Staff and Council to request that the alternatives be reconsidered. Mr. Bob Uhrhan appeared in support of, and to answer any questions relating to, the request for a special use permit for Rhodes Properties, LLC at 1110 North Cape Rock Drive. Upon questioning by Mrs. Tracy, Mr. Gramling stated that the staff has checked on the sewer capacity and storm sewer concerns of the residents. These have been addressed, and comments will be sent to the developer. CONSENT ORDINANCES The following bills were given second and third readings. The requirement for an election if there is only one candidate for a position. 3. The fee limitations that are difficult on the City. 4. The Ethics Commission; there is already a process at the state level to handle these types of complaints After discussion by the council members, they agreed for each Council Member to submit two names from their ward to the Mayor to be considered for a Charter Review Committee. The Council will review the names submitted, develop a committee to review the issues the Council has addressed, and give the committee 120 days to complete the review.
