White, Absent. APPEARANCES Mr. John Mehner, President and CEO of the Chamber of Commerce and Chuck Martin, Director of the Convention and Visitors Bureau, appeared regarding the request of the Greater Cape Historical Association for the City to allocate excess CVB funds for improvements to the Glenn House. Mr. Mehner stated he previously sent a letter to the Council explaining the process followed by the CVB Task Force in reviewing the Association's request. Two recommendations from the Task Force were presented to the Council for consideration: (1)appropriate$31,117 from the CVB unspent funds, or (2) appropriate $12,000 from the CVB Operating Budget. Both proposals provide funding of the Glenn House, just in two different ways and amounts. The Task Force approved the second option by majority vote; however, two members were not present for the vote. Mayor Knudtson explained that in March of 2003 Mr. Mehner appeared before the Council and requested jurisdiction to oversee the excess CVB funds and prioritize requests for funds as they came in. Following this, the North Star marketing study was approved to evaluate and make recommendations on the direction of tourism in the City. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 7, 2004 —24-- Upon questioning by Ms. Ritter, Mr. Martin confirmed that this request falls into the objectives, criteria and general direction of the CVB. He stated no member of the task force argued against funding the Glenn House project; however, no more than 50 percent funding has ever been F approved for one project. Mr. John Wyman appeared and stated he is on the CVB Task Force and the committee to research the Glenn House. The Task Force was to determine the validity of the request and if it fit within the parameters. The $31,117 will cover large repairs to the Glenn House that the Association cannot fund. He and Chuck Stotz did not attend the Task Force meeting when the vote was taken, and he and Mr. Stotz would have both voted for the full funding of$31,117 for the Glenn House. Mr. Chuck Stotz appeared and stated he is on the Chamber Board, on the CVB Task Force and on the Glenn House sub-committee. He stated the Red House and the Fire House Museum have had support from the city in the past, and this project cannot be done piecemeal. Mr. Stotz stated he would have voted for the full funding of the Glenn House repairs if he would been at the meeting. Ms. Loretta Schneider, a member of the Board of the Historical Association of Greater Cape Girardeau, appeared and gave a brief history of the ordinance establishing the hotel/motel/ restaurant tax. This tax was set up in a special fund and is not part of the general fund to be used by the city. She stated the intent of the Council in the 1980's was to use the tax money to help with the upkeep of historical areas of Cape. The ordinance establishing the tax states it is to be used to promote tourism, conventions, and economic development. The Association has requested funds from the City in the past, and if an annual allocation had been made, the Glenn House would not be in this situation. She did not feel this request was premature. Mr. Bill Port, the Caretaker of the Glenn House, appeared and explained that in 2001 Jeremy Wells developed a list of problems with the Glenn House. Since that time, the Association has been trying to correct as many as possible, and has spent $50,000 on the repairs. The Association is now out of money, and the volunteers are not able to complete the repairs that are needed. He reviewed the needed repairs and stated and these will cost $31,117. The Association has contracted with Jerry Casper to do the repairs, and he wants to complete them before winter. Upon the request of Mayor Knudtson, Finance Director John Richbourg explained the history of the Hotel/Motel/Restaurant Tax approved in 1983, and amended in 1987 and 1998. Through 1987 the tax produced more revenue than projected, so the city completed two park projects. In 1998 the definition of"prepared food"was changed, and the tax was increased and extended to 2030 to assist in funding of the River Campus. He has always used conservative revenue projections, and as a result, at the end of June there was $825,000 of uncommitted tax revenues in the fund. These are one time funds to be used to pay for one time expenses. Mr. Leland Frek Shivelbine, 2917 Bernice, appeared and stated he is an active member and the Treasurer of the Historical Association. The requested $31,117 would be used for emergency repairs to the Glenn House. Over $53,000 has been spent over the last three years to maintain the Glenn House. This included many volunteer hours and fundraisers to help maintain the house. The house has been maintained for 30 years by volunteers, it is an important part of tourism in Cape, and funding is needed to keep it from falling down. The Association does not expect to ask for more money in near future. It will be generating funds through promotions and tours. It is trying to raise $15,000 to improve the interior of the Glenn House. The unspent CVB funds should be used to promote tourism with an emphasis on the river area, and this is a great use for the funds. The North Star Report supports promotion of the riverfront, and the Glenn House is in Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 7, 2004 25 the center of the current redevelopment downtown. He requested the City Council take action tonight. m Mr. Bill Port again appeared and explained the Association will have a major fundraiser on October 9 with an antique road show. Individuals from galleries will bring antiques to get appraised, and this will raise significant funds. Ms. Loretta Schneider again appeared stating that the decision tonight is untimely because many people who support this, including members of the Task Force, could not be here. Ms. Boardman stated there have been many volunteers for this project. She felt the Glenn House project is part of tourism in the City, and she supports full funding of the repairs. Mr. Herbst recognized the Chamber and CVB Task Force for receiving the funding requests and reviewing them thoroughly. He stated he felt the Glenn House request meets the plan for the excess CVB funds, but questioned whether$31,117 was the appropriate amount of seed money for this project. Upon questioning by Mr. Herbst, City Attorney Eric Cunningham explained that if the Council wishes to authorize $12,000 in funding from the CVB operating budget, a motion would be sufficient. If the Council wishes to spend the excess CVB funds, an appropriation ordinance would need to be approved by the Council. Ms. Ritter stated she did feel there was a need for this funding. The Association has proven it has a plan for the facilities, and she will support the $31,117. Mr. Herbst commented that there are many larger projects to look at as well, such as landscaping around the interstate, and the City should look into possible match money from MoDOT. Mr. Purcell stated he supports the $31,117 funding all at one time so the repairs cannot be done piecemeal. Mayor Knudtson stated that the Glenn House represents the history of Cape Girardeau. The $12,000 recommendation had a lot to do with providing seed money for this project. He expressed concern with what the unspent funds represent, and the City has only one shot at spending this money. In addition, he stated this request is premature and should have been part of a master plan reviewed by the CVB Task Force. He suggested the CVB Task Force develop a master plan for the excess funds and that the City should place a moratorium on all future requests until this master plan is complete. He expressed concerns that if the Council gives a small amount to many projects, the money will disappear quickly with only making small groups happy. Mr. Mehner stated that there is no master plan. On November 15` the money will stop accumulating in the CVB fund. At that time they will know how much money they are dealing with. He explained there are two lines of thinking for the money: 1)have a big project and use all the money, or 2) invest the money and use it on many smaller developing projects. The CVB Task Force needs to know the preference of the Council on which path to follow. It will be end of 2004 before the task force will have a recommendation on how to spend the money. He suggested the Council approve an ordinance appropriating $31,117 from the unspent CVB finds and then put a moratorium on spending funds until the full report is submitted to the Council from the task force. Following discussion by the Council, Mr. Herbst made a motion, seconded by Mr. Purcell, directing city staff prepare a budge appropriation ordinance for $31,117 from the unspent CVB funds for the Glenn House Project as requested by the Greater Cape Historic Association. The motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell,Ritter. Nays,None. White, Absent. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 2,2004 _26 Mr. Purcell made motion, seconded by Ms. Ritter, to place a moratorium through December 31, 2004, on expenditures from unspent CVB funds accumulated through November 1, 2004. Nays, None. White, Absent. Ms. Jenny Stigers appeared regarding the proposed animal control ordinance. She reviewed issues outlined in the report prepared by Lt. Mark Majoros, including records relating to violations of the dog ordinance which have gone through municipal court. She stated that some cities in other states have had animal limiting ordinances thrown out for unconstitutionality. She continued that Lt. Majoros reported that three cities had limitation ordinances which were withdrawn. She also spoke with a supervisor of St. Louis County, and he said that their ordinances were zoning ordinances and not animal limiting ordinances. She requested an animal citizen advisory committee be established to address animal issues in the city, and that the Council not adopt the proposed ordinance. Mr. Mike Ballou, 409 N. Louisiana, stated he requested a copy of Lt. Majoros' report and received a list of 27 cities with animal limitation ordinances. The rest of the cities were included under St. Louis County. Rolla, Jefferson City, and Webster Groves withdrew their animal limitation ordinances. It is a constitutional right and property right to have animals. In 1998 the Council passed an ordinance relating to the costs for dog licenses. At that time people on the radio stated that $15.00 was the average tax on animals in the State of Missouri; however, this was not correct. He called six cities and only one had a $15.00 tax, which was Kansas City. Most were $4.00 or $5.00 and one had no dog tax. He heard the City is now discussing home based businesses with the Chamber, and he will appear before the Council on this issue as well. He stated he is disappointed that there is no stop sign at Louisiana and Themis, even though a petition was submitted. He continued that Loretta Schneider and Mary Wulfers were great voices on Council and now the Council is a get along gang. He expressed his support for Danny Niswonger for County Commissioner. Ms. Requi Salter of the Humane Society appeared and stated the proposed ordinance will not solve any animal problems the city is facing, such as barking dogs. Individuals that take care of their animals do not cause problems, and therefore the Council has not heard from these people. Ms. Salter stated that the problem is the nuisance and not the number of animals. Upon questioning by the Mayor, she discussed future technology of"chipping" animals, and this will be discussed with city staff and presented at a future date. Ms. Ritter discussed whether the Council would be interested in establishing an animal control advisory board if it was structured properly to have representation from the City staff, Humane Society and from citizens. Mr. Leslie stated there are many advisory boards to assist city in decisions, and the police are informally working on this already. BILL NO. 04-140 was given second and third reading as follows: AN ORDINANCE AMENDING CHAPTER 6 OF THE CITY CODE RELATING TO ANIMALS AND FOWL The second and third readings of BILL NO. 04-140 were approved upon Mr. Herbst's motion, Ms. Boardman's second, and the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter.
