Rock Drive intersection and Route W, Lexington, North Kingshighway intersection.

Mr. Steve Stigers, 1343 Big Bend Road, a former board member of the Human Society, appeared
in opposition to the ordinance limiting the number of cats and dogs based on ethical grounds;
caring for animals shows a spirit of kindness. He suggested the city require people to show proof
that their animals have been spayed or neutered to help control the pet population. He also stated
that we have a huge over-population problem with dogs and cats in our community, and that leads
to thousands of healthy animals being killed every year.
Mr. Chuck Stucker, Director of the Humane Society, 2536 Boutin Drive, appeared in opposition to
the portion of the proposed ordinance limiting the number of cats and dogs. He realized that one
of the purposes of the proposed ordinance is to reduce the number of unwanted animals in the
City, but he stated he felt the current ordinances are adequate. If enforced properly, Sections 6-36
and 6-27 of the City Code would be as effective as the proposed ordinance. People who are
responsible are not the ones having or making the problems. He stated he could understand people
not wanting to live next door to someone with a lot of animals. Mr. Stucker stated he was not sure
how this ordinance would affect the Humane Society Foster Care Program. There is a three
phased application to become a foster parent and to make sure that the applicants are responsible
to handle these animals. Upon questioning by Ms. Ritter about a definition for foster care, Mr.
Stucker stated that there would never be more than eight licensed animals in a foster care
environment. The number limitation in the proposed ordinance would not affect their foster care
program. The licensing requirements would be the only problem. There are approximately 20
families in the foster care program with ten of these in city limits. He stated the Humane Society is
opposed to any limit on the number of animals, and those who do not spay or neuter should face
repercussions from the city.
Mayor Knudtson stated that the issue of enforcement of the current ordinances has driven the push
for limitation. It is difficult for a nuisance officer responding to an animal complaint to determine
if an animal has been altered. Mr. Stucker stated that the animal owner should have
documentation from a vet proving the animal has been altered.
Police Chief Steve Strong explained that under the present ordinance the burden of proof is on the
City to show that an animal has been altered. He discussed licensing provisions through
veterinarian offices in the city. Only about 1000 of the many dogs and cats in the City have
actually been licensed, and not all of the veterinarian records have been sent to the City.
Jenny Stigers, 1343 Big Bend Road, appeared and stated that animal owners are willing to accept
responsibility for providing proper documentation for dogs. She questioned what happens under
the proposed ordinance when a complaint is filed for too many dogs at one location. Chief Strong
responded that a nuisance officer will visit the location, and if a violation is noted, then the owner
will be given notice to reduce the number of animals to come into compliance. Ms. Stigers stated
she did not understand why the City can not check all City records to verify the number of dogs at
an address. If she has proof that all her animals are altered and licensed then she should be able to
keep as many as she wants. If the City requires licensing of animals, then the City should have all
documentation that is needed.
Mayor Knudtson explained that the Police Department researched 107 Municipalities in the State
of Missouri and 104 of those limit the number of animals in some way, and all of those are the

same or more restrictive than the proposed ordinance. In addition, Chief Strong stated that if a •
person wants to maintain more animals than allowed under the ordinance, he can apply for a
special use permit to operate a commercial kennel.
Mr. Michael Maguire, 4564 Hopper, appeared in opposition to the ordinance limiting the number
of animals. He discussed how this would have an adverse effect on fostering and caring for older
dogs, as well as limit the numbers of animals that could be brought into a home when a person has
visitors.
Ms. Joan Jones, 1514 Sylvan, asked the city to enforce animal control ordinances relating to
nuisance calls and not just on people with multiple dogs. Limiting the number of animals allowed
in a home punishes responsible owners and is unconstitutional in some areas. The existing
ordinance can address all these issues, and she did not feel that there was any reason to change it.
She questioned what is done with the money the city receives from the animal licenses. Mr. Leslie
explained that the funds received are put into the City's general fund which in turn supports the
Police Department enforcement efforts.
Ms. Mary LaClear, 418 South Benton, appeared and stated she has more than the limit of animals
as proposed under the new ordinance, and she takes care of all of them. The number of animals in
a home does not matter; it is how they are taken care of. Ms. LaClear explained that she has at
least five dogs, but even if they were licensed, the City would find a way around the ordinance to
give her a ticket. The Police Department is stretched to its limits, and the officers do not write
tickets on violations. She stated she felt the proposed ordinance is wrong, unfair, and unjust.
BILL NO. 04-140 was giving first reading as followed:
AN ORDINACE AMENDING CHAPTER 6 OF THE CITY CODE RELATING TO ANIMALS
AND FOWL
Mr. Hopkins made a motion, seconded by Mr. Herbst to approve the first reading of BILL NO. 04-
140. The Council considered information from City Staff that the Police Department receives 20
to 25 complaints per year regarding issues related to the number of animals a person has at their
residence. These complaints generally involve issues such as barking, odor and failure to properly
care for the animals. Upon questioning by Mr. Purcell, Chief Strong explained that this ordinance
does not address limits on other small animals. The ordinance also addresses dangerous animals.
Ms. Boardman spoke in favor of the ordinance, as well as Mr. Herbst. Ms. Boardman said she had
talked with many people over the weekend and none of them wanted four animals living next door.
They were very surprised that the proposed limitation was that generous. Mr. Herbst said he had
received the same comments. He worked as a police officer in his area for six years and dealt with
a large number of animal calls. In his area, lots are small, only 100 feet deep, and he wants people
to have the assurance that the neighbors will not be adversely affected if someone wants more than
four dogs. Ms. Boardman added that she wants the ordinance to be enforceable. Mr. White stated
that if a person has too many animals, it is very difficult to care for those animals in such a way
that they won't adversely affect the neighbors on either side of them. In addition, Mr. Herbst
suggested the council revisit in the future the provisions relating to fostering of animals under the
guidelines of the Humane Society. The council discussed issues relating to fostering of animals,
and upon questioning by Ms. Ritter, the Mayor explained that at the last City Council study
session, the council members present requested the staff remove from the ordinance the exemption
to the limitation for fostering of animals. Mr. Stucker also addressed issues relating to fostering of
animals, including input from neighbors. He again stated it would be rare if a foster home were to
have more than four animals anyway. The Mayor explained that if a person wants to house more

than the allowed number of animals, the person can apply for a special use permit for a
commercial kennel, and this process allows for input from neighbors. He stated that a fostering
exception would only affect approximately ten people in the city, and he felt the ordinance should
remain as proposed. City Attorney Eric Cunningham clarified that a person would not need a
special use permit for foster care unless they exceed the maximum number of animals. Following
discussion the motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins,
Knudtson, Purcell, Ritter,White. Nays,none.
Mr. Don Howard, 1100 Ranney, appeared and discussed the following:
1. There are existing ordinances that are not being enforced, such as loud music from cars and
underage drinking, and no tickets are being issued. There is also a drug dealer problem in his
neighborhood with no response from Police.
2. He questioned why the water rates are being raised.
3. He questioned why the city hired a consultant from out of state to do the salary survey The
money could have been used to buy equipment for the Police and Fire Departments.
Mayor Knudtson explained that water rates are being raised to cover the budget. Regarding the
hiring of a consultant, the Council made the decision for the betterment of the community and the
City employees and to make sure the City is not in the same situation in the future.
Mr. Felix Kinsley appeared and had a question about agenda item number 10. Mr. Leslie
responded that it is a grant for the taxi coupon program. This grant will give the City 50%
reimbursement for costs of the program and allows the city to continue the program.
Mr. Bill Whitlow, Project Manager for Marquette Plaza, appeared in support of agenda item
number 13 relating to traffic on Fountain Street.
Mr. Leslie explained that the five ordinances are needed to address the traffic flow and parking on
Fountain from Broadway to Bellevue for the Marquette Plaza. Traffic will be one-way northbound
on Fountain and for an adjoining alley. Angle parking will be provided on the east side of
Fountain, and parking will be eliminated on the west side. Mr. Herbst stated that at the corner of
Bellevue and Fountain he had a citizen inquiry relating to tenants from the Marquette parking in
front of the business at 301 Bellevue. He questioned if there will be two-hour parking in this area.
Mr. Leslie further explained that the City and the developer are in the process of fully developing
off and on street parking, and until that is done, it will be hard to determine limitations on parking.
Mr. Whitlow stated that the parking lots at the H & H building and radio station have all been
redone, and 40 parking spaces have been added. Ms. Ritter encouraged the City to look into
traffic issues with the new federal building and new additions to Fountain Street.
