Regular Session February 18, 2019 'KK-217 REGULAR SESSION—February 18,2019 CALL TO ORDER The Cape Girardeau City Council convened in regular session on Monday, February 18, 2019, at 6:00 p.m., with Mayor Bob Fox presiding and Council Members Robbie Guard, Victor Gunn, Stacy Kinder,and Shelly Moore present. Ryan Essex and Daniel Presson were absent. ADOPTION OF THE AGENDA A Motion was made by Robbie Guard, Seconded by Shelly Moore to approve and adopt the Agenda. Motion passed. 5-0. Ayes: Fox, Guard, Gunn, Kinder, Moore. Absent: Essex, Presson. PUBLIC HEARINGS • Public Hearing on the 2019-2024 Capital Improvements Program. Mayor Bob Fox opened the Public Hearing. There being no appearances, the hearing was closed. Mayor Bob Fox reported that the City Council and City Staff had discussed the draft 2019-2024 Capital Improvements Program at the February 4, 2019 Study Session. A few revisions were offered by Council Members, and staff revised the draft document. APPEARANCES None. CONSENT AGENDA Approval of the February 4, 2019, City Council regular session and closed session minutes. BILL NO. 19-23, an Ordinance approving the Record Plat of The Lochs at Dalhousie- Phase V. Second and Third Readings. Bill No. 19-28, an Ordinance amending Chapter 24 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by adding a new article VI related to regulation of public rights-of-way. Second and Third Readings. BILL NO. 19-29, a Resolution authorizing the City Manager to execute an Agreement with Southeast Missouri State University to prepare an Historic Resource Survey, in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 19-32, a Resolution authorizing the City Manager to execute an Agreement with KT Power Systems, Inc., for the 2019 LED Streetlight Conversion Project, in the City of Cape Girardeau, Missouri. Reading and Passage. Approval of the transfer of ownership of the Special Use Permit for 1900 North Kingshighway from Thompson and Wesbecher, Inc. to Crooked Creek Real Estate, LLC. Regular Session February 18,2019 KK-218 Approval of the Partial Release of Performance Bond Agreement for Collins Mill Subdivision Phase 2. A Motion was made by Shelly Moore, Seconded by Robbie Guard to approve and adopt. Motion passed. 5-0. Ayes: Fox, Guard,Gunn, Kinder, Moore. Absent: Essex, Presson. Robbie Guard abstained for financial reasons on the Motion to approve the transfer of ownership of a Special Use Permit for 1900 North Kingshighway, and on the Motion to approve the Partial Release of Performance Bond Agreement for Collins Mill Subdivision Phase 2, due to his employment with MRV Banks. Bill No. 19-23 will be Ordinance No. 5161; Bill No. 19-28 will be Ordinance No. 5162; Bill No. 19-29 will be Resolution No. 3238; and Bill No. 19-32 will be Resolution No. 3239. NEW ORDINANCES BILL NO. 19-30, an Ordinance authorizing the City Manager to execute an Agreement with the Missouri Highways and Transportation Commission for Traffic Signal Repairs at William Street and South West End Boulevard, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Robbie Guard, Seconded by Victor Gunn to approve. Motion passed. 5-0. Ayes: Fox, Guard, Gunn, Kinder, Moore. Absent: Essex, Presson. BILL NO. 19-31, an Ordinance authorizing the City Manager to execute an Agreement with the Missouri Highways and Transportation Commission for repair of South Sprigg Street, in the City of Cape Girardeau,Missouri. First Reading. A Motion was made by Shelly Moore, Seconded by Stacy Kinder to approve. Motion passed. 5-0. Ayes: Fox, Guard,Gunn, Kinder, Moore. Absent: Essex, Presson. BILL NO. 19-33, an Ordinance amending Chapter 25 of the Code of Ordinances of the City of Cape Girardeau, Missouri,regarding Signs. First Reading. A Motion was made by Robbie Guard, Seconded by Shelly Moore to approve. Motion passed. 5-0. Ayes: Fox, Guard, Gunn, Kinder, Moore. Absent: Essex, Presson. BILL NO. 19-34, an Ordinance amending Chapter 25 of the Code of Ordinances of the City of Cape Girardeau, Missouri, regarding Driveway Spacing Requirements. First Reading. A Motion was made by Victor Gunn, Seconded by Stacy Kinder to approve. Motion passed. 5-0. Ayes: Fox,Guard,Gunn,Kinder, Moore. Absent: Essex, Presson. APPOINTMENTS Appointment to the University of Missouri Extension Council. Russell Humphrey was appointed by the Mayor to the Cape County University of Missouri Extension Council for a term expiring February 28, 2024. A Motion was made by Victor Gunn, Seconded by Robbie Guard to confirm the appointment. Motion passed. 5-0. Ayes: Fox,Guard,Gunn, Kinder, Moore. Absent: Essex, Presson.
