11 SPECIAL SESSION — JANUARY 18,2011 11
The Cape Girardeau City Council convened in special session on Tuesday, January 18, 2011, at
7:00 p.m., with Mayor Harry E. Rediger presiding and Council Members Meg Davis Proffer,
Loretta Schneider, Kathy Swan, Debra Tracy and John Voss present Mark Lanzottl was absent
Mr. Voss made a motion, seconded by Mrs. Swan, to adopt the Agenda as presented. The motion
was approved upon the following vote: Ayes, Davis Proffer, Rediger, Schneider, Swan, Tracy and
Voss. Nays, none.
City Attorney Eric Cunningham gave BILL NO. 11-10 first, second and third readings as follows:
AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF CAPE GIRARDEAU,
MISSOURI, ON THE QUESTION OF WHETHER TO ADOPT AN INITIATIVE ORDINANCE
KNOWN AS THE "CAPE GIRARDEAU SMOKE-FREE AIR ACT" TO PROHIBIT
SMOKING IN INDOOR WORKPLACES AND PUBLIC PLACES; DESIGNATING THE
TIME OF HOLDING THE ELECTION; AUTHORIZING AND DIRECTING THE CITY
CLERK TO GIVE NOTICE OF THE ELECTION
Mr. Voss made a motion, seconded by Mrs. Swan, to approve the three readings of BILL NO. I I-
10 and to adopt the ordinance. Mr. Voss stated that it was identified after the last special meeting
that the ordinance calling an election on the Smoke -Free Air Act was only given one reading.
With the divisiveness of this issue, it is necessary to dot all i's and cross all t's in order to meet the
requirements of the City Charter and to place this issue on the ballot. The motion was approved
upon the following roll call vote: Davis Proffer, aye; Lanzotti, absent; Rediger, aye; Schneider,
aye; Swan, aye; Tracy, aye; Voss, aye. BILL NO. I I -10 is ORDINANCE NO. 4190.
There being no further business, the City Council adjourned upon Mrs. Swan's motion, Mrs.
Davis Proffer's second, and the following vote: Ayes, Davis Proffer, Rediger, Schneider, Swan,
Tracy and Voss. Nays, none.
