Schneider, Kathy Swan, and John Voss present. Council Members Meg Proffer and Trent
Summers were absent.

confidential communications with the city attorney, property acquisition and personnel matters,
pursuant to RSMo. Sections 610.021(1), (2), and (3), upon Mr. Voss' motion, Mrs. Schneider's
second, and the following vote: Ayes, Lanzotti, Rediger, Schneider5wan, and Voss. Nays, none.

PRESENTATIONS
Mayor Rediger presented a Proclamation to representatives from the Alzheimer's Association
recognizing September 15`h as "Walk to End Alzheimer's" Day in the City at Cape Girardeau
County Park North.
Assistant City Manager — Director of Development Services Kelly Green gave a presentation of
the new Residential Rental Licensing Ordinance. She noted the changes made to the Ordinance
since the Council last reviewed the Ordinance and the recommendations made by the Cape Area
Landlord Association. Mrs. Green said that she had reached out to Ms. Nancy Jernigan, with the
Cape Girardeau United Way, and she spoke to the Cape Leaders Alliance and presented the
Ordinance to get their feedback from a tenant's standpoint. They represent the south side of Cape
Girardeau and the Red Star area. Mrs. Green reviewed all the changes made to the Ordinance after
meeting with those organizations. She said the Cape Area Landlord Association had voted 25-7 in
support of this Ordinance as written. She said that if there are no major changes made to the
Ordinance, she would like to put it on the August 20, City Council agenda for the first reading.
Mayor Rediger expressed support for the Ordinance and thanked Mrs. Green for her work. Mrs.
Swan expressed the appreciation of the Council to the property owners and landlords for their
input.
Mr. Robert Blasiney, of 12 Schonoff Lane, addressed the Council regarding the Residential Rental
Licensing Ordinance. He said that he had met with the Mayor in opposition of this Ordinance
when it was first proposed, now, he agrees totally with it. Mr. Blasiney said that he and a group of
people worked with Mr. Jason Coalter and communicated with Mrs. Green. There are many rental
properties in the south side of Cape Girardeau that will need a lot of attention. Mr. Blasiney asked
that the inspections are fair and ample time is given for repairs.
Mrs. Schneider said that she has attended Cape Area Landlord Association meetings, and this
issue has been -discussed for many years. She said that she appreciated the process this Ordinance
has gone throdgh to reach this point.
Proceedings of the City Council, City of Cape Girardeau, Mo.
Regular Session _ August 6, 2012 — 128
Mr. Voss confirmed that the fee structure is assessed by landlord, rather than by unit. He asked
how many landlords will have to be registered. Mrs. Green answered that the City does not know
how many. Once this Ordinance is adopted, landlords will have six months to register with the
City. Mr. Voss asked about the seven opposing votes from the Cape Area Landlord Association,
was there a common theme to their objection, or do they just oppose regulation.
Mr. James Shandy, of 3702 Old Hopper Road, addressed the Council and said that he has been in
the rental business for 46 years. He is opposed to this Ordinance because he did not see the need
for a licensing requirement. He said that it is nice to have an Association, but it is nice to have due
process to make decisions in an association. He didn't feel due process was granted, and that is
why he is opposed to this Ordinance. If there is to be a regulation controlling landlords, it should
have been presented to the organization before the Council would make decisions about it. Mr.
Shandy said that the extra regulations will be a burden, and it will be an imposition that will
decrease growth in Cape Girardeau. He could see na beneficial reason for this Ordinance.
COMMUNICATIONS/REPORTS
Mayor Rediger urged all citizens to vote on Tuesday. He said that he had presented a
Proclamation to Mr. Ron Nall this past Wednesday, recognizing his 20`h year as conductor of the
Cape Girardeau Municipal Band. The Mayor announced that Mr. Scott Moyers, with the
Southeast Missourian, is moving to the crime beat, and Ms. Erin Reagan will become the city beat
reporter.
Mr. Voss said that he had welcomed the U 12 Midwest Plains Regional Babe Ruth Tournament on
behalf of the City on July 19. He had thrown the ceremonial first pitch, and Vic Lanzotti, son of
Mark Lanzotti, caught the pitch. Mr. Lanzotti said that he had attended the tournament with the
perspective of a participant. He said that 16 teams from all over Missouri attended, with over 400
boys and their families in town. He heard from many people about the professionalism and
flawlessness of the tournament. Mr. Lanzotti commended Parks and Recreation Department
Director Julia Thompson and her staff for their work on this tournament.
City Manager Scott Meyer updated the Council on the Broadway Corridor project. The contractor
is ahead of schedule, and the goal is to progress past Sprigg Street prior to the opening of the fall
semester at Southeast Missouri State University. The street lamps will be delivered and installed
this fall. The trees that have been planted are irrigated, but no more will be added until late fall.
The wayfinding signage bid opening will be next week. Work is being done on parking lots and
Main Street as well. Mr. Meyer commended City staff and partners in contracting and supplying
for this project.
PUBLIC HEARINGS
This being the date set for a public hearing regarding the proposed property tax rates for the fiscal
year ending June 30, 2013, the hearing was opened. There being no appearances, the hearing was
closed.
APPEARANCES
Mr. Mike Buchanan, of 221 Brandy Lane, in Wild Horse Creek Ranch Subdivision, addressed the
Council regarding the second and third readings of BILL NO. 12-82, an Ordinance annexing
unincorporated land into the City limits. He said that the City's position on accepting the street
maintenance has been a subject of disagreement and he has sought legal review of this policy and

sent a letter to the City Attorney. He said that when this annexation began, a member of City staff
told him that if a subdivision plat were recorded with the streets dedicated for public use, the City
would be obligated to provide street maintenance. Now he is told that since the County did not
maintain the streets, the City would not either, and since the property lines extend to the center of
the streets, the City cannot accept them for maintenance. Mr. Buchanan said that it appears that
the City is trying to extend as little maintenance to the subdivision residents even though they are
paying City taxes. He has been a resident and ran a business in Cape Girardeau for over 20 years.
It appears that the City is looking to get what it can from the residents of this subdivision, and that
is contrary to the spirit if the City. Mr. Buchanan said that if there is a grey area in this subject, the
residents should be given the benefit of the doubt, and maintenance should be extended to the
subdivision's streets.
Mayor Rediger said that he was recently in discussions about this with the subdivision residents
and he felt that City staff had answered many of the residents' questions relating to trash collection
and other issues. The City is still willing to meet and discuss street maintenance costs, the cost of
bringing the subdivision streets up to City standards snow removal, and other maintenance costs.
Mr. Buchanan said that the City staff he has dealt with have been great and have researched all the
residents' issues. The director of the City's solid waste collection visited one day to see what
streets in the subdivision the collection trucks could and could not travel. He felt that because of
the way the plat is recorded, the City is obligated to provide street maintenance. Mr. Buchanan
said that if there is a question about it, the City should take the street maintenance, instead of
trying to do the least it can get by with.
Mr. Bill Bennett, of 258 Ashley Drive, addressed the Council regarding the annexation. He said
that it is bad public policy for the City to annex land and not accept financial responsibility for the
public areas of the annexation. The plat shows that the streets are dedicated for public use. The
City will not offer a reduced tax rate even though it is not providing street maintenance. Mr.
Bennett asked about contiguous portions of their property, and if this annexation is voluntary. He
said that State statute says that the 15% of the proposed annexed property must be contiguous to
current City property.
City Attorney Eric Cunningham stated that the conditions for contiguous area are different for
voluntary annexation.

WHICH ESTABLISHED A SYSTEM OF URBAN DEER HUNTING IN THE CITY LIMITS;
DESIGNATING THE TIME OF HOLDING THE ELECTION; AUTHORIZING AND
DIRECTING THE CITY CLERK TO GIVE NOTICE OF THE ELECTION
Mr. Voss made a motion, seconded by Mr. Lanzotti to approve the first, second and third readings
of BILL NO. 12-110 and to adopt the Ordinance as an emergency measure. Mr. Voss said that he
had asked Mayor Rediger and Council Member Summers for their support to place this Ordinance
on the agenda for the Council's consideration. He said that he had thought about the discussion
regarding this issue in the community and how divisive it was. The group Cape Friends of
Wildlife has been staunch in its opposition, and he applauded their efforts to follow the Charter
and get the signatures to bring this issue to the people for a vote. He said that the Council could
resolve the issue quicker than the petition process. He understood that the matter will probably go
to a vote, and he felt that most residents want a chance to weigh in on the subject. A presidential
election is set for November, and this issue could be on the ballot at the same time. A presidential
election will draw more voters, and the cost to the City would be much less if this election is held
at the same time. It will cost an additional $10,000 to the City if a special election is held. Mr.

Voss said that he had visited with members of Cape Friends of Wildlife and suggested this
Ordinance. He is fulfilling his promise to propose this Ordinance, and he asked for the support of
the Council.
Mr. Lanzotti said that many questions have been raised from a legal standpoint, and he would not
support this Ordinance. The Cape Friends of Wildlife still intend to move forward with the
petition drive and thatcould make the Council's action tonight uncertain.
Mayor Rediger said that he felt this Ordinance was a good offer from Council Member Voss, and
he thought Mr. Voss' reasons were valid. Hetoo had spoken with members of the Cape Friends of
Wildlife, including Mr. Steven Stigers. The Mayor said that he was iiitially enthusiastic about this
Ordinance, but then backed from supporting it because he felt the best method to take is to let the
group follow through with their referendum petition process.
Mrs. Schneider said that she agreed that there are too many unanswered questions and felt it would
be best for the group to proceed with its petition process.
Mrs. Swan said that she will not support this Ordinance. She agreed that it is best if the Cape
Friends of Wildlife continue with their petition process tcput the matter on the ballot.
Mr. Lanzotti said that if the petitions are verified, then the Ordinanceadopted relating to the Urban
Deer Hunt will be suspended from taking effect, functionally prohibiting an urban deer hunt.
Mr. Cunningham said that upon submission and verification of the completed petition by the
Petitioner's Committee, the Ordinance they are acting on is suspended until such time as the
Council repeals the ordinance or the results of anelection are certified
The motion to approve the first, second, and third readings of BILL NO. 12-110 and adopt the
Ordinance as presented failed upon the following roll call vote: Rediger, nay; Schneider, nay;
Swan, nay; and Voss, aye; Lanzotti, nay.
APPOINTMENTS
Mr. Voss made a motion, seconded byMrs. Schneider, to approve the Mayor's appointment of Mr.
John McGowan to the Public Library Board of Directors for a term expiring June 30, 2014. The
motion was approved upon the following vote: Ayes, Lanzotti, Rediger, Schneider, Swan, and
Voss. Nays, none.
Mr. Lanzotti said that the Girardeau Goes Green Advisory Board had a number of qualified
applicants for their positions, and they had created meaningful roles for those applicants to
participate with the Board even without formal appointment. He encouraged the Library Board to
find ways to include the applicants as volunteers.
Mrs. Swan said that she had several conversations with people who lived in the City, who were not
members of the library district. The library district boundaries are not the same as the City limit
boundaries, and many Cape Girardeau residents have to go to the Riverside Regional Library in
Jackson. Mayor Rediger said that the library districts were set long ago, and their boundaries
continue to be a question of the State Legislature. Library Director Betty Martin remarked that an
out -of -district library card is available for $60 per household, per year.
