City Manager Scott Meyer reported that he had met with representatives of Ameren UE this week.
Ameren is working on a transmission project just outside of Cape Girardeau, but the impact to our
community in reliability of services is striking. This project is a huge investment in this region
with over $50 million in this construction project, and the economic impact will be large. The
transmission lines are not directly paid for by rate increases. The cost of the project is spread over
a larger area so other carriers help pay for the transmission project as well. This project will
increase the capacity and reliability of services in the area.
Mr. Meyer said that Cape Girardeau was ranked 74`h on the Forbes Magazine list of Best Small
Places for Business and Careers.
APPEARANCES
Mr. Bill Bennett, of 258 Ashley Drive, addressed the Council regarding the annexation of
unincorporated land into City limits. He said that residents of his subdivision all signed an
annexation request, but they did so because they would not have received City water if they did
not. He said that at the time he was in the middle of building a house and had to have water hook-
up, and he had no option but to sign the agreement. Mr. Bennett said that about half of the current
residents did not live there when the agreements were signed and were unaware of the annexation
agreement. The residents will pay higher taxes, but he questioned what services they will receive
for it. They currently have fire and police protection from other entities, and he questionecbptions
for snow removal. Mr. Meyer answered that snow removal is a part of street maintenance, but
since the City will not be maintaining the streets in the subdivision, the City will not provide snow
removal service to the residents. Mr. Bennett said that they will not have library service, because
they do not live in the library district. He said that they will pay higher taxes, but will not receive
much in return. He said thaf many of the streets in the subdivision do not meet the current City
code or standard. Mr. Bennett said that if the City is going to annex the subdivision, the residents
should be afforded City services, and street repair and maintenance is one of those services the
City should provide. He said that the Council has the authority to push the agenda as it is
presented, but the residents would greatly appreciate if street maintenance were included in the
annexation. Mr. Bennett said that he did not receive a written statement from the City that they
will not provide street maintenance. Mr. Meyer said that since the streets in the subdivision are
not maintained by the County at this time, the City will not assume maintenance of the subdivision
streets.
Mrs. Jennie Stigers, of 1343 Oakenwald, appeared in opposition of the Urban Deer Hunting
Ordinance. She reviewed statistics and issues previously discussed and reviewed by the Deer
Management Committee, the Council, and the public. Mrs. Stigers said that if the Council
approves the Ordinance, her group of opponents plans to file a referendum petition, and if they are
successful, the Council must overturn the Ordinance, or put it to a vote of the people. However,
because the second and third readings of the Ordinance are delayed, they will not be able to put the
issue on the November ballot. She urged the Council to give other deer control options a chance
to work before adopting this Ordinance.
Mrs. Janet Presson, of 2245 Kent Drive, appeared in opposition of the Urban Deer Hunting
Ordinance. She reported that she has talked to several people in St. Louis, and that they only hunt
deer for two weeks a year and hire professional shooters to do it. Mrs. Presson alleged that
proponents of the Urban Deer Hunting Ordinance would benefit financially from its adoption.

Mrs. Judy Pulley, of 2206 Lakewood Drive, addressed the Council in opposition of the proposed
Urban Deer Hunting Ordinance. She said that this Ordinance is simply sport hunting, and it
disregards public safety. Since its first introduction, this Ordinance has shed requirements and
restrictions related to age, liability, notification, elevated stands, footage requirements, share the
harvest, does only, acreage, and deer survey. She reminded the Council that the more restrictions
imposed by the Council, the more City staff will have to monitor the hunt. However, the main
concern should not be how much staff time this will take, but public safety. Mrs. Pulley reviewed
previous comments by Councilmember Voss on issues he felt should be addressed in the
Ordinance, but are not included in this proposed Ordinance. This Ordinance is unsafe for
residents, and she asked the Council to put this issue on the ballot in November.
Mr. Gene Pulley, of 2206 Lakewood Drive, appeared in opposition of the Urban Deer Hunting
Ordinance. He said that Mayor Rediger had said that the hunt would be conducted in the northeast
section of the City, and that limitation is not in the Ordinance. The Mayor responded that he
believes the majority of the deer issues have been in the northeast portion of the City. Mr. Pulley
countered that this will be a City-wide hunt if the Ordinance is approved. He said that members of
the Council have promised residents that they will take care of their deer issues, and those
Councilmembers now want to pass this irresponsible Ordinance to save face. Mr. Pulley asked the
Council to place this issue on the November ballot
Mr. Keith Lear, of 1829 Old Sprigg Street Road, addressed the Council in opposition of an urban
deer hunt. He said that all of the Missouri Department of Conservation offices, and everything he
has read online, say that bow hunting is ineffectivq inhumane, and unsafe. For ethical reasons, he
has never fed deer and never scared them, but these deer do not run away from humans because
they are tame. It would be inhumane to hunt them. His property is surrounded by woods on all
four sides. If this Ordinance is passed, he will have hunters all around his house. When he finds
an arrow on his lawn, there will be nothing the Cape Girardeau Police Department can do about it.
Mr. Lear said that he has attended every meeting about this Urban Deer Hunting Ordinance, and
he has not seen one person appear in support of this Ordinance. There have been people opposed
to this Ordinance, but the Council is still supporting it. Mr. Lear stated that if he were shot with ar
arrow, the Council should hope that it would kill him.
Mrs. Kay Story, of 1630 Oxford Drive, appeared in opposition to the Urban Deer Hunting
Ordinance. She said that she has completed 38 years of teaching grades 8-10, and she is appalled
by the lack of respect towards animals and human life and the violence that kids are exposed to.
Mrs. Story said that how we treat animal life is a prototype for how children will treat their fellow
human beings, and they should be taught a more compassionate and civil attitude. Children
should be taught to respect animals and respect life. She has talked to many people who are
opposed to this deer hunting Ordinance, and the credibility of the Council rests on their stance on
this issue. If the Council respects their constituents, they will let the people vote on this issueShe
said that the Council is voting on the value placed on life, and their vote will follow them into
eternity.
Ms. Vivian Selby, of 1508 Briarcliff Drive, addressed the Council in opposition of an urban deer
hunt. She expressed concern at allowing four months of hunting in the City, sayinghat there is no
need for such a long hunt. Ms. Selby reviewed various sections of the Ordinance, including the
length of the urban hunt, the permission granted by the property owner, no liability insurance
required, and the lack of punishments listed for violators. She said that the Ordinance contradicts
itself. The Ordinance endangers people who live in the City. She asked the Council to conduct a
deer population count and notto pass this poorly written Ordinance.

Ms. Pat Wells, of 1902 Drury Lane, addressed the Council in opposition of the proposed Urban
Deer Hunting Ordinance. She initially did not oppose to deer hunting in the City. She volunteers
at the Missouri Department of Conservation Nature Center and understands that sometimes
wildlife needs to be controlled. However, when the proposed Ordinance was presented to the
Council, after it was changed, she changed her mind because of the safety issues and is now
opposed to it. If the safety factors were reinstated, she may again support the Oribance.
Ms. Joan Jones addressed the Council in opposition of the proposed Urban Deer Hunting
Ordinance. She said she used to live in the area near where there was a deer problem. She said
that she is opposed to an Urban Deer Hunt. Ms. Jones thanked the Council for listening to the
citizens and said that she knows they will do the right thing.

BILL NO. 12-73 was given second and third readings as follows:
W
AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AND ADOPTING A NEW SECTION 17-104
RELATING TO URBAN DEER HUNTING
Mr. Voss made a motion, seconded by Mr. Summers, to approve the second and third readings of
BILL NO. 12-73 and to adopt the Ordinance.
Mr. Voss said that he respected the opinions of everyone who has spoken on this issue. Several
residents have reached out to him and expressed support for some kind of deer population control
in the City. Property owners have been helpless to defend their property, and they have done
everything in their means to repel the deer and protect their land. Mr. Voss said that it is his
sincerest intent to offer all property owners the ability to peaceably occupy their property and keep
it from being destroyed. He said that he is offended by accusations that supporters of this
Ordinance would gain financially from its adoption. There were items stripped from the original
proposed Ordinance that he suggested. However, there are times when compromise is necessary,
and some Council members did not agree with his conservative measures. Mr. Voss suggested the
Council revisit certain items of discussion to include: 1) minimum parcel acreage; 2) the
appropriateness of elevated tree stands; 3) minimum hunting age, to reconsider a minimum age of
18 years; 4) does -only hunt, or earn -a -buck hunt as an important component; 5) minimum of 3 -
acre combined plot, not with a single owner; and 6) requiring the hunter to shoot from an elevated
position, such as a tree stand, on parcels of at least 3 acres, perhaps even 5 acres
A motion to amend the Ordinance to increase the minimum lot size to 3 acres, to add the provision
that hunters must shoot from an elevated position, and to increase the minimum hunting age to 18
years or older, was made by Mr. Voss, seconded by Mr. Summers.
Mr. Lanzotti said the amendments proposed by Councilmember Voss have merit in interior
portions of the City, but not in outer areas. He said that he would propose an amendment to the
Ordinance to remove the requirement for an elevated stand on parcels larger than 10 acres. Mr.
Lanzotti said that he would also propose an amendment to remove the minimum age requirement
and permit individuals under the age of 18 years to hunt supervised by a parent or guardian.
The Mayor said that he opposes the amendment proposed by Councilmember Voss. He said that
he would ask for a minimum parcel size of 5 acres with one owner. Mr. Summers said that he
would propose an amendment that would require notification of neighbors if three separate lots
were combined to make the minimum, 3,acre, parcel size required for the urban hunt
The motion to amend was approved, by the following roll call vote: Proffer, aye; Rediger, nay;
Schneider, nay, Swan, nay; Summers, aye; Voss, aye; and Lanzotti, aye.
A motion to amend the Ordinance to remove the requirement for an elevated tree stand to be used
when hunting on an individual parcel of 10 acres or more, and permit individuals under the age of
18 years to hunt in the presence of a parent or guardian on those tracts greater than 10 acres, was
made by Mr. Lanzotti, seconded by Ms. Proffer
Mr. Meyer asked if the 10 -acre parcel must be property owned by one individual. Mr. Lanzotti
replied that the requirement is the same for the3-acre parcel, and subject to the will of the Council,

but as written now, it must be owned by one individual. Mayor Rediger said that the amendment
would make the Ordinance difficult to enforce and confusing to understand. He said that he would
vote against this amendment. Mrs. Schneider stated that this discussion should have taken place
long ago, before this Ordinance wasdrafted and brought before the Council for a vote.
The motion to amend was approved, 4-3, by the following roll call vote: Rediger, nay; Schneider,
nay; Swan, nay; Summers, aye; Voss, aye; Lanzotti, aye; and Proffer, aye.
A motion to amend the Ordinance to add a written neighborhood notification requirement if there
is an aggregate of lots to meet the three acre minimum lot size, was made by Mr. Voss, seconded
by Mr. Summers, and approved, 5-2, by the following roll call vote: Schneider, nay; Swan, aye;
Summers, aye; Voss, aye; Lanzotti, aye; Proffer, aye; and Rediger, nay.
The original motion was approved as amended, 4-3, upon the following roll call vote: Swan, nay;
Summers, aye; Voss, aye; Lanzotti, aye; Proffer, aye; Rediger, nay; and Schneider, nay BILL NO.

LOCATION AGREEMENT WITH EZ PAY MISSOURI, LLC, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
Mr. Lanzotti made a motion, seconded by Mr. Voss, to approve the reading of BILL NO. 12-94
and to adopt the Resolution.
Mrs. Swan confirmed that the transaction fee and the merchandising fee are paid by the citizen
using the kiosk to pay their bill. Mrs. Brooks reviewed the fees in the agreement. Mr. Meyer said
that EZ Pay will put kiosk machines at City facilities that will allow citizens to come in and pay
their City bills using credit cards or other methods. That same service will allow them to call in
24/7 and pay their bills. There is a $3 convenience charge for services. Mrs. Brooks said that
residents can use credit cards or cash, and the 24/7 phone payment service will enhance what the
City now offers online. The kiosks can also be used to pay municipal court costs and to post
bonds.

the quality of life for citizens, a conference center was discussed. This Ordinance is requesting a
feasibility study to see if a conference center is a viable option for our community and to see if it
can be sustained. This is one of many projects on the list to vet for possible inclusion in a City
vote. The Mayor said that the City has had a long-standing need for a conference center. Even if
it does not appear on a project list in a future City vote, this feasibility study can be used in the
