Session June 18, 2012 II -89 REGULAR SESSION —JUNE 18, 2012 The Cape Girardeau City Council convened in regular session on Monday, June 18, 2012, at 7:00 p.m., with Mayor Harry Rediger presiding and Council Members Mark Lanzotti, Meg Proffer, Loretta Schneider, Trent Summers, Kathy Swan, and John Voss present. Prior to the regular session, the City Council convened in closed session for purposes of confidential communications with legal counsel, litigation, and property acquisition, pursuant to RSMo. Sections 610.021(1) and (2), upon Mr. Voss' motion, Mrs. Swan's second, and the following vote: Ayes, Lanzotti, Proffer, Rediger, Schneider, Summers, Swan, and Voss. Nays, none. Pastor Mark Anderson, of the Lynwood Baptist Church, presented the invocation, and the Pledge of Allegiance was recited. Mr. Voss made a motion, seconded by Mrs. Swan, to adopt the Agenda as presented. The motion was approved upon the following vote: Ayes, Lanzotti, Proffer, Rediger, Schneider, Summers, Swan, and Voss. Nays, none. COMMUNICATIONS/REPORTS Mr. Voss said that he had attended The Mission Continues' `'Summer Service Slam" at Central Middle School athletic facilities and Lou Muegge Field on June 9. The Mission Continues brings veterans and civilians together in days of service nationwide, allowing veterans to feel more connected to their communities. The project in Cape Girardeau is one of three Service Slam projects planned for this summer, along with Columbia, Missouri, and Belleville, Illinois. Over 180 volunteers showed up to rehabilitate theballfield and facilities. Mr. Voss said he had also presented a Proclamation to Pastor Rodney Moody welcoming him and his family to St. James African Methodist Church and to Cape Girardeau. Mr. Voss said that on Saturday he had welcomed residents and victors to the City-wide Juneteenth celebration at the Second Baptist Church. Juneteenth is a holiday celebrating the end of slavery in America that commemorates June 19, 1865, the date when Union soldiers led by Major General Gordon Granger brought news of the Emancipation Proclamation to Galveston, Texas, two and a half years after the Proclamation was actually issued on January 1, 1863. Texas became the last state to recognize slaves' freedom, and this holiday is a celebration of that triumph in the history of our nation. Mr. Voss applauded Reverend Cecil Thompson for his efforts in promoting this event. City Manager Scott Meyer reported that the City had today finished installing three additional deer crossing signs. He said that he also received a letter from the Cape Girardeau Career and Technology Center recently that complimented the City Fire Department for their quick response and efficiency. Mr. Meyer reported continued progress on the Broadway Corridor project. The contractors are a little ahead of schedule, and citizensand businesses have been very cooperative. Progress is also being made on the Beautification Committee, he said. Parks and Recreation Director Julia Thompson is working on that issue, and she is still looking for Cape Girardeau citizens who want to be involved. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session ane 18,7017 -1[ -90 PUBLIC HEARINGS This being the date set for a public hearing to consider the proposed annexation of certain contiguous properties to the City limits, and the proposed zoning districts for those properties (Group 2), the hearing was opened. Mrs. Laura Bennett, of 258 Ashley Drive in Wild Horse Creek Ranch, appeared and said that the property owners were told by the Planning and Zoning Commission that the public hearing was scheduled for July 2. She said that several property owners had met with City staff on May 17 with concerns and questions. Two of those questions are still unanswered: 1) They were told that the plats recorded said that the streets will be dedicated for public use. However, there is still some disagreement between the City Attorney and the City Engineer, and the property owners still have not received an answer. 2) Regarding solid waste pick-up, one of the streets in the subdivision was not built with a cul-de-sac and the garbage trucks have nowhere to turn around. This street is also a dam for a pond in the subdivision, and the property owners fear the garbage truck will have to back down the street, or turn around in someone's driveway, and may damage the dam if they drive on this street. Mayor Rediger said that staff has been in contact with the residents of the subdivision. Public Works Director Tim Gramling stated that the City actually has a policy against backing garbage trucks down a street. They could investigate whether a smaller truck might be able to get in and out of that particular street. Mrs. Bennett said that she is concerned that if the City does not take the roads into the maintenance program, and the residents are left responsible for road repairs, they do not want the heavy trash trucks on the subdivision roads. The plat says that the streets are dedicated for public use. Mr. Meyer said that the City will provide a written response to the residents. Mr. Franz Meier, of 276 Brandy Lane in the Subdivision, addressed the Council and expressed concern with the trash collection in the subdivision. He lives on the highest point in the subdivision, and he stated there is no way he can bring the big trash containers the City uses down the hill and across the dam, where it can be picked up by the solid waste trucks. He said something else should be done to alleviate the problem. Mr. Meyer said that residents can request a smaller trash can, and the Public Works Department will work with Mr. Meier in addressing his concern. There being no appearances, the hearing was closed. APPEARANCES Mrs. Judy Pulley, of 2206 Lakewood Drive, addressed the Council in opposition of the proposed Urban Deer Hunting Ordinance. She said that she is against allowing weapons to be used in the City, and she is concerned about the safety of residents. Mr. Gene Pulley, of 2206 Lakewood Drive, appeared in opposition of the Urban Deer Hunting Ordinance. He said that the distances in the Ordinance are not safe, and residents should be required to notify neighbors if they going to allow hunting. He questioned what is a reasonable search for a wounded deer, if "No Hunting" signs would violate the sign Ordinance, and who would verify lot size. Mr. Pulley said that one member of the Friends of Wild Life Committee should be allowed to participate in the deer population count. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session June 18, 2012 11.91 Ms. Vivian Selby, of 1508 Briarcliff Drive, addressed the Council in opposition of an urban deer hunt and expressed concerns regarding the actions of the Deer Management Committee. She asserted that the public comment received by the Committee was discarded and discounted, and W that the proposed Urban Deer Hunting Ordinance does not reflect the original purpose of the Committee. Ms. Selby questioned the motive of this Ordinance. Sheasked the Council to conduct a deer population count and notto pass this Urban Deer Hunting Ordinance. Ms. Betsy Dinkins, of Bellridge Pike, addressed the Council in opposition of the proposed Urban Deer Hunting Ordinance. She said that she was disappointed by the way the Council has treated the members of the Cape Friends of Wild Life Committee and those opposed to urban deer hunting. She said that the Council is moving too fast to get an Urban Deer Hunting Ordinance in place for the next deer season Mr. Meyer commented that the City used established criteria for placing the deer crossing signs. Some of the current signs in place did not meet the criteria, but those were left in place, and three additional signs were installed today. Dr. Steven Stigers, of 1343 Oakenwald, appeared in opposition of the Urban Deer Hunting Ordinance. He said that he had made a commitment to do all he could to prevent deer hunting in Cape Girardeau, and he will not stop. If the Council passes this Ordinance, he will pursue a referendum. Mr. Jay Crosnoe, of 1901 Oak Hills Drive, addressed the Council in opposition of an urban deer hunt. He expressed concerns with the Deer Management Committee meetings and the process it followed. He is concerned about an Ordinance allowing bow hunting four months of the year within Cape Girardeau City limits, and is concerned about the acreage stated in the Ordinance. He said that he would prefer it if the Cape Girardeau Police Department would shoot the deer and thin the herd over a seven to ten day period. Mrs. Linda Crosnoe, of 1901 Oak Hills Drive, addressed the Council in opposition of the proposed Urban Deer Hunting Ordinance. Her property is full of woods behind her home and most lots in her neighborhood are 1 to 1.5 acres, and she is concerned for her grandchildren playing in the yard with someone hunting in the next lot. Mrs. Crosnoe said that she is not opposed to hunting or to thinning the deer herd, but it should be done safely for the residents of Cape Girardeau. She said a deer population count should be conducted before any type of hunt is allowed. Mr. Keith Lear, of 1829 Old Sprigg Street Road, addressed the Council in opposition of an urban deer hunt. He thanked Mr. Voss for speaking with him last week, but said that the discussion has been one-sided since the issue was first raised. He pointed out a few topics for discussion: 1) Safety is most important. 2) Urban hunting was originally proposed to thin the deer herd, but it has now been turned into a sport hunt. 3) No deer population count has been conducted, so the City cannot know if there is a problem. 4) No liability insurance requirement is included in the Ordinance. 5) The ethics of shooting an animal at close range gives hunters a bad name. Mr. Lear presented statistics about urban hunting, injuries to deer, urban deer hunting and maintenance programs. He said the City is moving forward withoutlooking at what it is doing. Mrs. Janet Presson, of 2245 Kent Drive, appeared in opposition of the Urban Deer Hunting Ordinance. She said that she has repeatedly contacted previous Mayors and asked them to clean the pond at Capaha Park for the health of the duck and fish. She asked the Council to not allow bow hunting within City limits and asserted that the Council is trying to control too much in the City. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session . a„nP 18,7017 .41-92 Mrs. Jennie Stigers, of 1343 Oakenwald, addressed the Council in opposition to the proposed deer hunt. She has had problems with this from the beginning and expressed concerns with the process followed and the report given by the Deer Management Committee. Mrs. Stigers complained that, at the public forum, the time was equally divided between those for and against urban deer hunting. However, the submitted comments from the public forum were overwhelmingly against hunting, as was the City web survey. She said the Missouri Department of Conservation course is not a safety course, it is a bow hunting course. Someone at Southeast Missouri State University told her that no hunting would be allowed on their property, and she said she was told the same was true for Cape Public Schools in this area, which is where most of the complaints are coming from. Mrs. Stigers said that the Council needs to develop long-term and short-term goals and common sense in proceeding on this issue. Mr. Barry Sitze, of 1738 Themis Street, addressed the Council in opposition of an urban deer hunt. He said that bow hunting is the most inhumane way to kill a deer. If the City is going to kill the deer, a more humane way shouldbe found to do it. BILL NO. 12-73 was given first reading as follows AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AND ADOPTING A NEW SECTION 17-104 RELATING TO URBAN DEER HUNTING Mayor Rediger stated that he felt there is a deer problem in the City, and many people have asked for help. He has previously stated that he would support a one-year, one-time hunt on a five acre tract to be designated by City staff, and that the City should conduct a deer population count, and see what results from those measures. He said that since he made those statements, he has heard from many residents. The comments he has received has made him question the acreage as the Ordinance is written now. On his own property, or on two small lots in an adjoining neighborhood, a deer hunt could be conducted, and he said that he cannot support that. He said that he could support a one-time five -acre test and a population count to determine future needs. Anything short of those points, he will vote against. Mrs. Swan said that she will not support the bow hunting Ordinance for the purpose of deer population management until after a count survey has been conducted. She said that she had committed to determine first if there is a problem, then use that information to craft an Ordinance. Mrs. Swan listed the options the Council has changed and then abandoned in this Ordinance since this issue was first addressed. Mrs. Schneider said that she has been opposed to this Ordinance from the beginning. When the Deer Management Committee was formed months ago, the Council began receiving information and research. The Council should look at every reason to conduct an urban hunt, and every reason not to, and she does not think the Council has gone about this properly. Without a count, the City cannot determine if the hunt is successful. Mrs. Schneider said that she will vote against this Ordinance. Mr. Lanzotti stated that he will vote in support of this Ordinance. Twenty-three cities in Missouri have some form of urban hunting Ordinance and many of those cities are smaller than Cape Girardeau. He said that he is comfortable moving forward with this Ordinance. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session June 18, 2012 II -93 0 Mr. Summers said that he had lived in a community that had an urban hunting program, and it was successful. Safety has been a concern in other cities. He said that he would be willing to make adjustments to the Ordinance in its current form. Mr. Summers said that he doesn't necessarily L agree with the acreage, but he is willing to accept something between one and five acres. Mrs. Swan said that she has a spreadsheet of other communities with urban hunting Ordinances, and none of them with a one -acre component are as lenient without safety restrictions as our final draft that specifies one acre. The Council should investigate what other requirements are in these Ordinances. The first reading of BILL NO. 12-73 was approved upon Mr. Voss' motion, Mr. Summers' second, and the following roll call vote: Rediger, nay; Schneider, nay; Swan, nay; Summers, aye; Voss, aye; Lanzotti, aye; and Proffer, aye.
