11 SPECIAL SESSION — FEBRUARY 16, 2012 11
The Cape Girardeau City Council convened in special session on Thursday, February 16, 2012, at
4:25 p.m., with Mayor Pro Tempore Loretta Schneider presiding and Council Members Meg
Proffer, Kathy Swan, and John Voss present. Mark Lanzotti, Harry Rediger and Debra Tracy were
absent.
Mr. Voss made a motion, seconded by Ms. Proffer, to adopt the Agenda as presented. The motion
was approved upon the following vote: Ayes, Proffer,Schneider, Swan, and Voss. Nays, none.
City Manager Scott Meyer explained that a special meeting of the City Council was called in order
to authorize the necessary paperwork for the Army Corps of Engineers to continue work on the
flood wall project in a timely manner. BNSF Railway Company currently has some track shut
down time already scheduled. Obtaining these approvals today will allow the work to be
performed without having to shut down rail traffic again at a later date and will avoid additional
expense for the project.
BILL NO. 12-17 was presented as follows:
BILL NO. 12-17, A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN EASEMENT AGREEMENT FOR SHEET PILE WALL PROJECT WITH
BNSF RAILWAY COMPANY, IN THE CITY OF CAPE GIRARDEAU, MISSOURI.
Reading and Passage.
The reading of BILL NO. 12-17 was approved and the Resolution adopted upon Mr. Voss'
motion, Mrs. Schneider's second, and the following vote: Ayes, Proffer, Schneider, Swan and
Voss. Nays, none. BILL NO. 12-17 is RESOLUTION NO. 2676.
BILL NO. 12-24, AN ORDINANCE ACCEPTING AN EASEMENT FOR THE SHEET
PILE WALL PROJECT EXECUTED BY BNSF RAILWAY COMPANY, IN THE CITY OF
CAPE GIRARDEAU MISSOURI. First, second and third readings.
The first, second and third readings of BILL NO. 12-24 were approved and the Ordinance adopted
upon Mrs. Schneider's motion, Ms. Proffers' second, and the following vote: Ayes, Proffer,
Schneider, Swan, and Voss. Nays, none. BILL NO. 12-27 is ORDINANCE NO. 4299.
There being no further business, the City Council adjourned upon Mr. Voss' motion, Ms. Proffer's
second, and the following vote: Ayes, Proffer, Schneider, Swap and Voss. Nays, none.
