Regular Session , September 23, 2013 1135 e Motion passed. 4-2. Aye: Lanzotti, Rediger, Schneider, Summers. Nay: Bowen, Davis. Absent: Voss. Amend the Ordinance by adding the following: After the words, "Section 30-204(d)(2)..." at the end of the first sentence in Section 5-6(a), add the words "no such consent from the Board of Adjustment will permit the sale of package liquor at retail." The intent of the proposed amendment is to encourage restaurant development in the City. It is common practice in the state to exclude package liquor sales from proximity to churches and schools. Mayor Rediger said that he felt there could be some circumstances in which the prohibition should not apply, and he felt that the Board of Adjustment should make this determination. City Attorney Eric Cunningham stated that any such Board permission obtained for a current retail liquor license would only continue with the same owner, and not if there is a change in owner. Mr. Meyer asked if a convenience store wanted to sell package liquor, would they also fall under this amendment? Mr. Cunningham answered that a consent from the Board of Adjustment would not permit the sale at retail of package liquor. Under the proposed amendment, for any business that could sell package liquor as part of its license, such as a liquor by the drink, this amendment would prohibit them from selling any package liquor.
