City Manager Scott Meyer again recognized the new Police Chief. There will be a public reception
for Chief Blair in the coming weeks.
Mr. Meyer said that several weeks ago, a City employee fell in a silo, and several nearby Public
Works employees put their lives on the line to help him. The City Fire and Police Departments
responded as well. He commended everyone involved on their response, saying that "they had each
other's backs."
The City became a member of the U.S. Army's Partnership for Youth Success (PaYS) program
today, which guarantees a job interview to soldiers and ROTC cadets after the completion of their
Army obligations.
PUBLIC HEARINGS
A public hearing to consider a request to rezone property on LaSalle Avenue, Veterans Memorial
Drive, and County Road 618 from C-1 to M-1. Mayor Rediger opened the hearing for public
comment.
Ms. Kim Seyer appeared, speaking on behalf of Mrs. Dorothy Seyer. She wanted to show the
Council the revised map. She stated that it is her understanding that property adjacent to County
Road 618 is being excluded from the rezoning that is occurring at the meeting this evening. There
is a floodplain included in the property, but there are no plans to develop that land at this time. She
said that she wants the Council to amend the allowable uses in an M-1 zone to exclude recycling
centers and automotive painting businesses, since this area is close to a waterway.
Mayor Rediger said that there are no plans in mind for development for that land. He said that he
is not sure that certain uses can be excluded from certain areas in M-1 zoning.
Ms. Seyer asked if it can be a stipulation of the rezoning. M-1 allows for automotive painting, and
those chemicals are difficult to clean up. Recycling is also not an environmentally safe uses for this
property.
City Attorney Eric Cunningham answered that the City can look for another way to accomplish
this purpose, but he did not think that removing a particular use from a zoning district could be
done. Mayor Rediger said that the City is not in a position to do that this evening. Mr. Meyer said
that he has had conversations with the Department of Natural Resources, and he can look at the
possibility of putting a deed restriction on the property for these types of uses.
Mr. Lanzotti said that the City has created a subcommittee to create standards for the development
of this property and to explore options for handling this stormwater issue. The City has approached
the Department of Conservation and Department of Natural Resources on how to include some of
their new stormwater techniques on this property, and he has talked with the Parks and Recreation
Department about the feasibility of developing walking trails in this area.
Mayor Rediger said the wetland in the area will stay in place and possibly include park -like
enhancements, but this is still in the discussion phase.
Ms. Seyer said that a recycling facility and an automobile painting business do not follow the park-
like or campus -like setting that the Council is looking at.
Mr. Lanzotti said that the City also does not want to have those possible environmental impacts.

.Regular- Session Anguct 5, 2013 I1-323_
Mr. Mike Ingram, president of Whispering Oaks Subdivision Homeowners Association, appeared
in opposition. He asked if a survey was done when this parcel of land was purchased by City.
There are issues raised about a floodplain in the middle of the property - was City aware of this
w prior to purchase? The City Manager answered that, yes, they were aware. Mr. Ingram continued
that he has heard of terms like "technology park" or some typeof low density implication with nice
buildings and people riding bikes on the streets. Those uses correspond with C-1 zoning, so not
much concern was raised until now. The decision to change the zoning from C-1 to M-1 is raising
the question of what is going to be included in the business park that no one knows about. There is
a lot that can be done in an M-1 zone that cannot be done in a C-1 zone. He asked if the Council
envisions upgrading M-1 to M-2 or higher in the future.
The Mayor answered that this would not be a smokestack -type development. It is meant to be an
upscale distribution center with small hi -tech, clean businesses. The first client plans to set the
tone for the developmentof the area with an upscale brick building.
Mr. Ingram said the neighbors' issue is that this development progress as planned and match the
pieces that are already there. He asked at Planning and Zoning Commission meeting if there was a
plan or drawing, such as for the Veterans Memorial Parkway. The said no plan or drawings exist
for the development of this area. He asked if it would be possible to put something together and
presented to the residents of the area.
The Mayor replied that the Veterans Memorial Parkway is a phased project, and at this point the
City does not have that development carved into certain acre sites. The development will depend
on what types of prospects arise for the area. The prospect will be located on a site on the north
side of LaSalle Avenue that will encompass future 20-30 acre sites. There will be no plan for the
south side until the City has prospects for that area. The next phase of Veterans Memorial ParkwW
is Scenic Drive down to Hopper Road, and that project is on TT174. There are several more phases
to be completed.
Mr. Lanzotti said there are developers who have asked about small commercial sites for retail
development, and this is also being discussed. Much of the discussion has been on property north
of LaSalle Avenue, and The Cityhas discussed some commercial prospects.
Mr. Don Hopper, of 130 La Terra, President of the Meadows of Whispering Oaks Homeowners
Association, appeared and thanked the Council for their consideration of the neighbors' concerns.
He asked that when the south of LaSalle Avenue is developed, it be done in a tasteful manner.
Ms. Vickie Lance, of 2763 County Road 618, in the County and owner of the Lazy L Safari
Ranch, appeared and said that her business brings traffic from a 2 -hour distance through exit 102.
She asked if the Council has a plan for the property proposed to be remove from M-1. The Mayor
replied that there are no plans for this area. Theland was purchased in its entirety.
Mr. Bill LaFoe, of 309 Fox Run Lane, asked if the City has any plans to develop the north side of
LaSalle Avenue before developing the south side. The Mayor answered that the City is working on
plans for infrastructure now for the north side. There being no further appearances, the hearing
was closed.

congestion, high use and increased demand. The temporary tower will provided data to determine
where a more permanent tower is needed. Ms. Haskell said that the same needs are being assessed

Mayor Rediger opened the hearing for public comment.
Mr. Thomas Meyer, of 314 North Lorimier, appeared before the Council in support of the
rezoning request. He said that he wanted to build a single-family residence on this property, and
cannot 'do that in an R-4 zoning. He asked the Council to reconsider the R-4 zoning regulations in
their entirety and make adjustments or corrections as needed, because the zoning designation
restricts single-family residences in the downtown area. There being no further appearances, the
hearing was closed.

APPEARANCES
Mr. Chuck Ross, appeared on behalf of the Old St. Vincent's Catholic Church Council, in
opposition to the celltower proposed to be placed at 418 William Street.
Ms. Robyn Walker, of 133 South Lorimier Street, appeared before the Council, also opposed to
the proposed cell phone tower within the historical downtown district. She said that residents in
the historic district understand that there is a need for better cell coverage in downtown Cape
Girardeau, but there are less intrusive alternatives to provide this service. Mayor Rediger asked for
a show of hands of the spectators who oppose this cell tower. Sipeople raised their hands.
Mr. Sam Blackwell, of 133 South Lorimier Street, appeared and shared a Southeast Missourian
newspaper article in today's paper. The article said that AT&T has made changes to the cell tower
design in response to neighbor requests. However, those changes were made in response to
requests by City staff. It also said that the Historic Preservation Commission approved this project,
but Mr. Blackwell disagreed and said that it was not within their rights to do so. He said the
Historic Preservation Commission's report said that they agreed with the AT&T consultant's
report that this project could damage the view of the historic districts.
Ms. Haskell, of AT&T, said she met with a group of residents opposed to the cell tower, and
AT&T has pursued design changes as a result of this meeting. AT&T provided this group of
residents with details of the complexity of a wireless network and the steps AT&T took to find the
best location and still serve the needs in downtown. They did change the design to maintain the
integrity of the historic downtown area, and thought that the Missouri State flag would be a
positive landmark but have removed this at the request of the neighbors.
Mr. Lanzotti said the engineer told him that the mechanics to install a flag on the tower could be
built in to maintain the option for the future.
Ms. Haskell said that she would be agreeable to adding the hardware needed for the flag. She said
that she also suggested camouflaging the tower to look like a tree, but that idea was rejected. The
only solution is to move the tower or to provide alternative hardware that is not feasible for this
area. There are businesses, students andvisitors who want this coverage in the downtown area.
Dr. Frank Nickell, of 1627 Scivally Drive, appeared in opposition and said that we cannot measure
the value of the community and neighborhoods. He said that all of the neighborhoods in the
downtown area hold some of the most historic properties in the City, and they deserve the respect
and assistance of the City. Dr. Nickell urged the Council to show that they care for the
neighborhoods, and he urged AT&T to seek an alternative to the tower proposed on William
Street.
Mr. Tom O'Loughlin, an attorney representing Mr. John Heuer and his mother, owners of the
proposed location of the tower, appeared in support. He said that Mrs. Heuer needs the $960 a
month in rent to live on. Mr. Heuer obtained 52 pages of signatures in support of this tower. Mr.
O'Loughlin read comments from several of thepeople and businesses who signed in support of the

tower because of the lack of cell phone service in the downtown area. He presented the signatures
and pictures in support of the cell phone tower at 418 William to theCouncil for consideration.
Mr. Bill Anderson, with KWKZ Radio located at 753 Enterprise Street, spoke regarding the lack
of cell service in downtown Cape Girardeau and in support of this cell tower request. He said that
it would look like a flag poleand would not be intrusive to the area.
Ms. Jean Hampton, of 323 Goodhope Street, appeared in support. She said that she will see the
tower whenever she walks out her house, and she supports the tower construction.
Mr. John Heuer, of 1422 Parkmor Drive, appeared before the Council in support. He said that he
distributed packets to 50 businesses about the cell phone tower, and he has had a steady flow of
people returning consentforms in support of the tower.
Mr. Mike Woelk, of 316 Merriwether Street, appeared in opposition to the request. He said that he
has looked at alternative means of cell service, and there is new technology available to supply
strong cell service in dense, urban areas. He asked the Council to take more time before
considering this request and to research the technology that can address the cell service needs in
the downtown area.
BILL NO. 13-89, an Ordinance granting a Special Use Permit to AT&T Mobility and 418
William, LLC, for purposes of constructing and operating a telecommunication tower at 418
William Street, in the City and Countyof Cape Girardeau, Missouri. First Reading.
The City Planner's Council Report in the agenda packet presented for the record a certified copy of
the following items (1) Sections 30-332, 30-401 and 30-404 from the City Code; (2) the
application for special use permit; and(3) the application file.
Mrs. Schneider said that she is opposed to this tower. She said that she cares about the historic
district and its surroundings. Her main concern is the electromagnetic field put off by the
telecommunication towers and the danger poised to young people in the area. She said that she
feels there has to be abetter location.
Mr. Bowen read reports submitted by the State Historic Commission, hired consultants, and the
Historic Preservation Commission. He said there will be an adverse visual impact, but there is an
adverse visual impact with flood walls and power lines, and other necessities to our life. This is a
historic district, but the area does not have adequate cell coverage. Mr. Bowen said he doesn't feel
the City should hold back cell service for businessemnd emergency response in this area.
Mr. Summers said that he agreed. The downtown area is a historic district, and he works and lives
there. This is no longer a time where access to cellular technology is a luxury; it is a necessity for
safety and commerce.
Mr. Lanzotti also spoke in support of the request and the impact it will have. He said that he will
propose an amendment in the second and third readings of the Ordinance that the flag hardware be
included on the tower.
A Motion was made by Trent Summers, Seconded by Mark Lanzotti to approve.
