ADOPTION OF THE AGENDA A Motion was made by Loretta Schneider, Seconded by Meg Davis to approve and adopt. Motion passed. 7-0. Aye: Buhs, Davis, Lanzotti, Rediger, Schneider, Summers, Voss. PRESENTATIONS Mayor Rediger presented a certificate to Mr. Tony Sebek, recognizing his 23 years of service on the Board of Appeals. He also served 9 years on the Golf Course Advisory Board. The Mayor thanked Mr. Sebek for his service to the City of Cape Girardeau. COMMUNICATIONS/REPORTS Mayor Rediger noted that Advisory Board members commit many hours of service for no compensation and thanked all members for their service to the City. Mr. Lanzotti announced the annual Father -Daughter dance this Saturday Night at the Osage Centre. Mrs. Schneider said that she wanted two members of the Council to support her request that the City look at updating its nuisance Ordinance. She said that she has dealt with certain nuisance issues in the past in which nothing could be done because of the current nuisance Ordinance. She wants to give nuisance abatement officers more authority to do more to clean up the City. One priority from the recent citizen satisfaction survey was beautification, landscaping and the upkeep of buildings in the City. The Keep Cape Beautiful Committee will be discussing this recommendation further. She requested two other Council Members to support her in asking the City Manager to look at what other cities have done with their nuisance Ordinance, to remove unsightly properties. Ms. Davis and Mr. Summers agreed to support her request. Mayor Rediger Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session Fehruary 19, 2013 L236 directed City Manager Scott Meyer to review the nuisance Ordinances in other cities, and to see what can be changed in the current Ordinance to make it more restrictive. Mr. Meyer said that he attended the Missouri Municipal League Legislative Conference last week and noted several legislative issues of interest to the City. He said there is a proposed bill that would require 60% approval for any tax measure that failed and was re -submitted to a vote of the people within a certain period of time. Other Bills discussed included: defining "maintenance" in the prevailing wage law; eliminating solid waste districts; requiring Cities to pay attorney fees in civil lawsuits if they lose, but they do not have to pay attorney fees if the plaintiff sues; capturing internet sales data; open meetings and records changes to require longer notice for meetings; and reinstating local sales tax on vehicle purchases. Mr. Meyer said that he was appointed to the Missouri Municipal League E -Commerce Tax Committee. PUBLIC HEARINGS Public Hearing on the 2013-2018 Capital Improvements Program. Mayor Rediger opened the hearing for public comment. Assistant City Manager Kelly Green said that the City Charter requires a public hearing. There have been a few minor changes made to the Capital Improvements Program since the Council last reviewed it. Mrs. Green listed projects added to the Capital Improvements Program: the Business Park street infrastructure, the riverfront lighting update, the new street light program, the Business Park sewer, the Police Station design and the transfer station. Mrs. Green said that the current Capital Improvements Program is funding approximately $69 million in projects. The unfunded projects total approximately $149 million. Mr. Meyer stated that the Council had asked if staff could provide a cash flow balance through the five years of the program. Mrs. Green responded that Finance Director John Richbourg provided a cash flow analysis to schedule the Capital Improvements Program projects. The cash flow analysis will be provided to the Council. Mr. Tom Grantham, of 1717 Ridgeway Drive, appeared representing the Glenn House Historical Association of Cape Girardeau. He said that the purpose of the Historical Association is to renovate the Glenn House and turn it into a museum. Mr. Grantham distributed a letter to the Council illustrating the historical significance of the property. He said that the Glenn House is an asset to the City and has been open to tours since the 1970's, bringing many tourists to Cape Girardeau. Attendance averages 1,500-2,000 people per year, and 65% of those visitors last year lived outside of Cape Girardeau. Mr. Grantham said that the Historical Association received a grant from the Missouri Humanity Council for interpretive and education programs, and they are working on changing the schedule and the type of events they are doing at the Glenn House for a greater outreach. Mr. Grantham asked for the Council to contribute funds for the maintenance of that property. The Glenn House is 130 years old. A capital fund campaign is in process, and some of the repairs have been started, but a long list of projects remain, including the retaining wall along the sidewalk. Mayor Rediger thanked the Glenn House Historical Association for their work on the historical house. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session February 19, 2013 11-237 Mrs. Schneider said that she served on the Historical Association for many years. The Glenn House has not received funding from the City or the Convention and Visitors Bureau, except about 10 years ago, when the City donated one payment for an improvement. The Convention and Visitors Bureau uses the Glenn House for tourism. Mrs. Schneider stated that the City owns the Red House Interpretive Center, and it is part of the Parks and Recreation facilities. The City also owns the River Heritage Museum and takes care of those repairs. The Glenn House is consistently needing repairs, and the Council owes it to the residents to find some revenue streamfor the Glenn House. Mrs. Schneider said that this is an opportunity for the Rivefront Development Fund. Mr. Loyd Roth, of 2545 Cobblestone Court, addressed the Council and said that there is an article in today's paper about the Capital Improvements Program and stated that some taxes are going to expire between now and 2015. One of those expiring is the City hotel tax, which will either stop or need to be renewed. Then, the fire sales tax will expire. Mr. Roth said that he hears about the Council spending money on things like a dog park, when there are more important things than that. Mr. Roth said that the City should put the casino revenue in a fund to help everyone. Last year, his water pressure was so low that he could hardly take a shower. Mr. Roth said that the money could be used for better improvements. Mrs. Marla Mills, Director of Old Town Cape, appeared and thanked the Council for letting Old Town Cape be part of the prioritization process for downtown projects. She said that downtown lighting and infrastructure arethe greatest needs downtown. Mrs. Schneider asked Mrs. Mills to explain the Riverfront Development Fund, where the funds come from and plans for their use. Mrs. Mills explained that the Riverfront Development Fund was developed as part of the Development Agreement between the City and Isle of Capri. The Fund is separate from monies the Casino pays to the City as required by state law. It is a matching fund by the City to be used for improvements in the downtown area. Mr. Meyer said that the fund is estimated to raise $250,000 per year, with a portion going to Old Town Cape for administrative costs and the remainder for projects. Mrs. Mills said that the Riverfront Development Fund is a City fund. The Old Town Cape Board of Directors will make recommendations on improvement projects, but the City will decide on those projects. Mr. Voss said that this is just in the development agreement and not mandated by state law. At least 70% of the fund must go toward capital projects. Mrs. Mills said that the Development Agreement did not clearly identify the boundaries of the District, but defines the development area as the Old Town Cape area. The Glenn House is part of this area, and was part of the prioritization process. The Old Town Cape District spans from the river to West End Boulevard, and from Missouri Highway 74 to North Street. Mr. Don Howard, of 1 100 Ranney Avenue, addressed the Council and said that the six street lights he had previously requested for safety should have already been installed. He has repeatedly asked that a roof be installed on Fort D, and it still has not been done. Mr. Howard said that the Fort D grounds look nice, but the roof replacement has been put off. The roof should be done first, before other projects. He feels these projects are not being done because they are on the south side of town. Mr. Howard said that he agreed with what Council Member Voss said during the study session about reducing the sewer bills because people cannot afford them and are having their water shut off. There being no further appearances, the hearing was closed. Proceedings of the City Council, City of Cape Girardeau, Mo.
