ORDINANCE NO. �
AN ORDINANCE VACATING THE CITY'S INTEREST IN
A SEWER EASEMENT IN LOTS 1-7 AND 9-12 OF M.
E. LESEM'S SUBDIVISION TO THE CITY OF CAPE
GIRARDEAU, LYING BETWEEN BROADWAY AND LACEY
STREETS, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, the, City Council has received a request from
Southeast Missouri Hospital that the City vacate a sewer easement
on property owned by them between Broadway and Lacey Streets, and
more particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of December 21, 1988
for a public hearing on this request; and
WHEREAS, at le4st ten (10) days notice of the time and place
of this hearing was published in a newspaper of general
circulation in the City; and
WHEREAS, a public hearing was held on December 21, 1988 at
which all interested parties were afforded the opportunity to
speak in favor of or in opposition to the proposed sewer and
utility easement vacation; and
WHEREAS, the City Council has determined that the sewer
easement in question is not necessary or needed for any of the
purposes for which i't was dedicated and established; and
WHEREAS, it is in the public interest that the easement be
vacated;
NOW, THEREFORE, 'BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The 'City's interest in the sewer easement on the
following described real estate:
A strip of land5 feet wide through Lot 10 of Lesem's
Subdivision, the :center line of said strip being parallel
to and 12.5 feet ",South of the North line of said Lot 10.
Being a strip of land 5 feet wide and 40 feet long.
A strip of land 5 feet wide off the North side of Lot 11,
Lesem's Subdivision. Being a strip of land 5 feet wide
and 40 feet long.
A strip of land 5 feet wide off the North side of Lot 12,
Lesem's Subdivision, said strip being 5 feet wide and 40
feet long.
A strip of land 5 feet wide being in Lot 4 of Lesem's
Subdivision and described as follows: Begin at the
Northwest corner of said Lot 4; thence South along the
West line of said lot, 91 feet; thence East parallel to
the South line of said lot, 5 feet; thence North parallel
to the West line of said lot to the North line of said
lot; thence West along the North line of said lot to the
point of beginning.
is hereby vacated.
SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

Cape Girardeau, Missouri, a Municipal Corporation of the State
of Missouri, and that the seal affixed to the foregoing
instrument is the seal of said City and that the said
instrument was signed and sealed in behalf of said City by
authority of its City Council and acknowledged said instrument
to be the free act and deed of said City.
