AN ORDINANCE ACCEPTING A SANITARY SEWER
EASEMENT FROM DALHOUSIE, L.L.C. , FOR
PROPERTY LOCATED WEST OF BLOOMFIELD ROAD AND
SOUTH OF COUNTY ROAD 208, IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . The City of Cape Girardeau, Missouri hereby
accepts, and agrees to accept, a Sanitary Sewer Easement from
Dalhousie, L.L.C. , for property located west of Bloomfield Road
and south of County Road 208, in the City of Cape Girardeau,
Missouri, described as follows :
A 20-foot-wide strip being 10 feet on either side of
and running perpendicular and adjacent to a center
line beginning at a point near City Sewer Manhole #16
where the existing sewer force main turns east and
turns into a gravity main line; thence running in a
northerly/northwesterly direction to the southern-most
line of Lot No. 1 of Maurer Family Land, a subdivision
as recorded in Document No. 2023-07721 in the land
records of Cape Girardeau County, Missouri, with the
exact boundaries of said Easement Area tobe
determined once the sewer pipeline has been installed,
with the centerline of the Easement Area being the
centerline of the pipeline.
TOGETHER WITH the right of temporary use of Grantor' s
adjacent ground not occupied by improvements for
access to and from the Easement Area during
installation, repair or replacement of the sanitary
sewer line and/or any of the necessary appurtenances
thereto.
ARTICLE 2 . This ordinance shall be in full force and effect
ten days after its passage and approval .
