AN ORDINANCE ACCEPTING A PERMANENT UTILITY
EASEMENT FROM VADA LEASING, LLC, OVER THAT
VACATED PART OF HICKORY STREET, IN THE CITY
OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . The City of Cape Girardeau, Missouri, hereby
accepts, and agrees to accept, a Permanent Utility Easement from
Vada Leasing, LLC, for a 40 foot wide utility easement over that
vacated part of Hickory Street, in the City of Cape Girardeau,
Missouri, described as follows:
That part of vacated Hickory Street located in the
Northeast Quarter of Section 12, Township 30 North, Range
13 East of the Fifth Principal Meridian and as shown on the
Plat of a Part of Lot 1 of the Rodney 400 Arpen Tract & A
Part of the Out Lot 86 as recorded on Plat Book 5, at Page
51 in the land records of Cape Girardeau County, Missouri
Recorder' s Office and being more particularly described as
follows :
All that part of vacated Hickory Street being a 40 foot
wide right of way and lying between the western right of
way line of Commercial St and the eastern right of way line
of U. S . Highway 61, A.K.A. South Kingshighway, said
distance being 240 feet, containing 9, 600 square feet, more
or less
ARTICLE 2 . This ordinance shall be in full force and
effect ten days after its passage and approval.
